DESCRIPTION: The Alameda County Urban Runoff Clean Water Program (ACURCWP) faces the monumental task of cleaning up the County's storm water for discharge into the San Francisco Bay through a National Pollution Discharge Elimination System permit. As one way to accomplish this major undertaking, the ACURCWP put aside $300,000 to encourage agencies to propose pilot projects to improve the quality of storm water in a cost effective way that, if effective, other agencies could use. The City of Dublin's Public Works Department developed a pilot project proposal to install a pervious concrete storm water filter in the Shannon Park parking lot, and the City Council, at their meeting of September 28, 1992, authorized Staff to submit this pilot project to ACURCWP. The ACURCWP subsequently approved the City's project for funding. Pervious concrete has been utilized widely in England and Florida for groundwater recharge for several years with considerable success. However, pervious concrete has not been used for the purpose of improving the quality of storm water. This pilot project could show that pervious concrete can be used to improve the quality of storm water in a cost effective way. Pervious concrete is a porous mixture of gravel and concrete which allows storm water with small polluting particles to flow through the concrete. A layer of sand, approximately 1 to 3 feet in depth, would be installed under the pervious concrete to act as a filter. Leaves and larger particles will stay on top of the concrete and be picked up by the parking lot sweeper, and the sand would filter out waterborne pollutants. The pervious concrete would reduce the maintenance cost of cleaning the storm drain inlet by keeping leaves and debris from entering the storm drain. It is estimated that the sand will need to be replaced every 20 to 30 years. After removal, this same sand could be used for roadway construction. The pervious concrete will be cast in blocks so they can be removed and reused after replacing the sand filter. The total estimated project cost, including staff time, is $33,600. If the project shows that the quality of storm water can be improved in a cost effective manner, it could be used not only in our local area/but nationwide. Staff recommends that the City Council adopt the resolution approving the agreement. WITNESSETH: That DUBLIN for and in consideration of the covenants, conditions, agreements, and stipulations of DISTRICT hereinafter expressed, does hereby agree to furnish services and materials to DISTRICT, as follows, and/or as described on exhibits attached to and incorporated herein. EXHIBITS ATTACHED: DUBLIN shall furnish services as described in Exhibit A of this Agreement. Terms and conditions for payment are attached in Exhibit B. DUBLIN as a City is self-insured as to any requirements under this Agreement. No policies or bonds are required of either party as to any provisions of this Agreement. CONTRACT PERIOD will be from through June 30, 1994 COMPENSATION: DISTRICT agrees to pay DUBLIN for services performed hereunder as described in Exhibit B - Payment Schedule. The total amount paid by DISTRICT to DUBLIN under this agreement shall not exceed the sum of $33.600.00. ADDITIONAL PROVISIONS set forth in suceeding pages hereof constitute a part of this agreement. Until the expiration of five years after the furnishing of any services pursuant to this Agreement, DUBLIN shall make available, upon written request, to the federal/State government or any of their duly authorized representatives, this Agreement, and such books, documents, and records of DUBLIN that are necessary to certify the nature and extent of the reasonable cost of services to DISTRICT. If DUBLIN enters into any Agreement with any related organization to provide services pursuant to this Agreement with a value or cost of $10,000 or more over a twelve-month period, such Agreement shall contain a clause to the effect that until the expiration of five years after the furnishing of services pursuant to such subcontract, the related organization shall make available, upon written request, to the federal/State government or any of their duly authorized representatives, the subcontract, and books, documents and records of such organization that are necessary to verify the nature and extent of such costs. This paragraph shall be of no force and effect when and if it is not required by law. 2. MODIFICATION. No alteration or variation of the terms of this Agreement shall be valid unless made in writing and signed by Dublin's City Manager and the District's Public Works Director. Any modification to increase the total amount to be paid by DISTRICT to DUBLIN shall require the recommendation of the Management Committee of the Alameda County Urban Runoff Clean Water Program. Modification to increase the total amount paid to DUBLIN by DISTRICT by no more than twentyfive percent (25%) shall be valid when made in writing and signed by DUBLIN's City Manager and the DISTRICT's Public Works Director. 3. HOLD HARMLESS/INDEMNIFICATION. DUBLIN shall indemnify DISTRICT, its officers and employees against liability for injury or damage caused by a negligent act or omission of DUBLIN in the performance of this Agreement and shall hold DISTRICT harmless from any loss occasioned as a result of the performance of this Agreement by DUBLIN. EXHIBIT A SCOPE OF WORK PERVIOUS CONCRETE & SAND FILTER PILOT STUDY TASKS The work will be conducted according to the City of Dublin's conceptual proposal to develop and demonstrate the performance of a pervious concrete and sand filter system. The proposal Pervious Concrete & Sand Filter Pilot Study Proposal dated August 1992 is incorporated into this agreement by reference. The work described in this proposal will be completed and twenty (20) copies of the final report submitted within the term of this agreement. FINAL REPORT FORMAT The following report format is recommended to describe the study and its results. The seven main sections of the report are indicated by the headings numbered I thru VII. Additional subsections may be added to the report provided they fit within one of the main headings. EXHIBIT B Payment Schedule DISTRICT will pay DUBLIN for conduct of the pervious concrete pilot study upon submission of a completed statement at the conclusion of each phase of the pilot study. Each statement shall include the agreement number, details of tasks performed for the corresponding phase, personnel (staff or contractor) performing the task, and total amount of dollars to be paid by DISTRICT for each task. DISTRICT will pay DUBLIN within thirty (30) working days of receipt by DISTRICT of an invoice from DUBLIN. It is agreed and understood that the line item costs for each project phase are estimates.
