Request For Alameda County Transportation Authority (ACTA) To
Recognize Local Match Payment As Consistent With Policy On
Reimbursement

direct the City Manager to execute the letter on behalf of the City.
FINANCIAL STATEMENT:
This will assure that funds advanced can be reimbursed from Tri-
Valley Transportation Development Fees, once the Alameda County
Transportation Authority has received its full local match
requirement.

DESCRIPTION: The City Council has previously adopted the Tri-Valley
Transportation Development Fee, which is scheduled to go into effect September 1, 1998. A Joint Powers
Agreement (JP A) has also been approved by the Council, which establishes a structure for the use of
TVTD Fees collected by the participating agencies. The lPA has not yet been approved by all seven
emities, so it is not effective yet. The first project to be funded from this regional effort is the 1-680 II -
580 Direct Connector Project. Prior to the implementation of this regional fee, the Alameda County
Transportation Authority had entered into an Agreement with the City of Dublin to provide for a Local
Match Contribution.
The structure established by the Tri- Valley Joint Powers Agreement includes a provision to reimburse
agencies, which contributed to the 1-6801I-580 project through their Local Match Agreements in advance
of the Tri-Valley Fee becoming effective. The City of Dublin has received notice from the Alameda
County Transportation Authority that as of June 30, 1998, $171,290 is now due under the Local Match
Agreement. This payment must be made in advance of the effective date for the Tri-Valley
Transportation Development Fee.
Under the Tri- Valley JP A the future reimbursement of such payments is subject to having been found by
the ACTA Board to meet its "Policy on Reimbursement or Credit".(JPA Section 7d.) The ACTA policy
(see Exhibit 1- Section 4(d)) states that the Governing Board must formally request reimbursement or
credit. Attached as Exhibit 2, is a Draft letter to ACTA which would accomplish this requirement.
It is recommended that the City Council authorize the formal request as outlined in Exhibit 2 and that
payments by the City of Dublin be subject to prior approval of this request.

POLICY ON REIMBURSEMENT OR CREDIT
1) All Measure B capital projects shall be completed as quickly
as practical given funding and. resource considerations. Project
sponsors are encouraged to advance projects as rapidly as
possible with the understanding that no project will jeopardize
the funding of any other project. Expenditure Plan Project
Sponsors, as defined in the Expenditure Plan, are recipient
transportation agencies charged with maintenance of the completed
work. . ,

2) No expenditure of Measure B',funds will be made to any
capital project until all costs ar~ detailed in Project Reports
and the Authority has entered into a Project Agreement with the
Project Sponsor.
3) .Reimbursement does not allow the project to exc~ed the
funding or the scope of the project as defined in the Expenditure
Plan or as modified in the Annual Strategic Plan.
4) Project Sponsors who wish to expend their own f4nds in
.advance of a project agreement\Jl\ay do so. The Authority will. '.:':.:(

local match if the, expenditures meet the following requirements:
a) Project expenditures were made after passage of Measure
B. This requirement does not apply to incorporation of
locally owned right of way where the estimated cost and
the need to incorporate the right of way are made

b) Detailed records of expenditures are maintained and

c) All wo~k can be demonsfrated to be directly related to
the project as defined in the Measure B'Expenditure
Plan and as agreed to in a signed local
Agency/Authority agreement.

reimbursement or credit.

RE: Local Match Agreement - Payment for Fiscal Year 1997-98
Request For Finding By ACTA Board - "Policy on Reimbursement or Credit"
Dear Ms. Monsen:
In accordance with the Alameda County Transportation Authority "Policy on Reimbursement or Credit", the City
Council of the City of Dublin formally requests a finding by the ACTA Board that the cash monies deposited to meet our
Local Match Obligation as of June 30, 1998, are in full compliance with this policy.
As you are aware the City of Dublin has a Local Match Agreement with ACTA, providing for a contribution of $462,395
on June 30, 1997 and $462,395 on June 30, 1998. These amounts have been to a large extent offset by approved credits
in the amount of$753,500. A check for the balance of$171,290 is enclosed herewith. ACTA is authorized to negotiate
this check;. however, only following a written finding by the ACTA Board that this payment meets ACTA's "Policy on
Reimbursement or Credit" (attached to this letter as Exhibit 1).
The City of Dublin is making this payment from funds collected in advance of the Tri-Valley Transportation
Development Fee (TVTDF). The JPA related to the implementation of the TVTDF has certain criteria, which apply to
the future reimbursement by the Tri-Valley Transportation Development Fee Fund, to member agencies which made
local match contributions in advance ofthe collection ofthe TVTDF.

The Tri-Valley JPA specifically provides that contributions prior to the TVID Fee Effective Date, which are found by
the ACTA Board to meet its "Policy on Reimbursement or Credit", are subject to reimbursement from Tri-Valley
Transportation Development Fees. This only occurs after the full local match obligation has been paid to the Alameda
County Transportation Authority. Therefore, the action requested from your Board in essence will have no impact on
ACTA project financing. However, it will protect the interest of our agency, in obtaining reimbursement for funds
advanced by the City of Dublin to assure that this regional project could proceed.
The Dublin City Council considered this item on their meeting of July 21, 1998, and formally approved this request. It is
important that the ACTA Board consider and act on this request before September I, 1998. As noted above, the enclosed
check cannot be negotiated until the ACTA Board has approved this request.
