Severance of Road Rights-of-Way from Remnant Parcels on
Dublin Boulevard Extension

FINANCIAL STATEMENT: None
DESCRIPTION: In the process of purchasing property for the Dublin Boulevard
Extension, the City acquired two parcels which were larger than necessary for the street right-of-way,
and three remnant parcels will be created over and above the street fight-of-way. Under State Law,
the City was required to purchase this excess property because the remnants were not large enough for
the previous property owner to develop for another use. Staff is presently preparing to negotiate with
adjacent property owners for sale of these remnant parcels.
This resolution will sever the actual street fight-of-way from the remnant parcels for the purpose of
the County records. After recording the description of the actual street right-of-way, Staff can
proceed to obtain a record of survey which will better define the remnant parcels and simplify the
future sale.
Staff recommends that the City Council adopt the resolution.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
SEVERING ROAD RIGHTS-OF-WAY FROM THREE REMNANT PARCELS
ON DUBLIN BOULEVARD EAST OF DOUGHERTY ROAD
WHEREAS, the City of Dublin has purchased an existing parcel of land and a portion
of an existing parcel of land for the purpose of extending Dublin Boulevard to the east of Dougherty
Road; and
WHEREAS, the purchases were larger than necessary for the street right-of-way,
resulting in three remnant parcels of land; and
WHEREAS, it is necessary to split the road rights-of-way from the remnant parcels;
and
WHEREAS, by describing and recording the City Council's intent to utilize the
rights-of-way for City street purposes, the severance of the road rights-of-way from the remnant
parcels will be achieved; and
WHEREAS, the City is not required to comply with the Subdivision Map Act in order
to convey property (Government Code Section 66528);
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin does hereby designate the parcels described in Exhibit "A" as public street right-of-way for the
use of vehicles, pedestrians, utilities, and related roadway purposes.
BE IT FURTHER RESOLVED that the City Clerk is directed to submit this
resolution to the Alameda County Recorder for recording.
