the Notice has been legally cleared.
Authorize the transfer of $104,170.00 from
Unallocated Reserve into this project account.

*Council approved $285,000 at award of contract;
however, the figure in the 1990-95 CIP document
did not reflect this increased dollar amount.
This project is $14,321.97 over the total budget as approved at award of
contract and $104,170.00 over the 1990-91 Budget (due to a much higher
percentage of the project extended into this fiscal year than anticipated).

DESCRIPTION:
In March of 1990, the City Council awarded Contract 90-02,
Alamo Creek Park Phase II, to RMT Landscaping.
This project was the second phase in the construction of the Alamo Creek
Park, the first phase being constructed by the responsible developer,
Rafanelli & Nahas. The items included in this phase were the restrooms,
basketball court, picnic area, and a children's playground area.
The construction portion of the project has been completed for some time;
however, there have been delays in the Contractor's completion of some minor
items on his deficiency list.
Overbudget items: the utility fees for the restroom sewer tie-in were
overlooked in the original estimate; overtime inspection was incurred when
the Contractor worked on weekends in an effort to provide public use of the
playground and basketball court earlier than anticipated: and, printing
costs were not included in the preparation of the budget and there were over
30 bidders, an unusually high response. Additional costs were also incurred
when the sub-grade material under the restroom building was found to be
unsatisfactory and therefore required soils tests and corrective measures.
The City Engineer has reviewed the work on the project and determined that
it is complete and in accordance with the approved plans and specifications.
Staff recommends that the City Council accept the improvements and authorize
retention payment to RMT Landscaping in the amount of $17,892.13.

amounts due under the contract unless we are provided with one of the
following documents:
1) A release of the Stop Notice duly executed by the Issuer.
or
2) A Bond to Release Money withheld on Claim in the amount of $15,821.
