The total cost for the project study report (PSR) for the
l-580/TassajaralSanta Rita Road Interchange Improvements is
$366,558. Each of five developers initial deposits and additional
contributions are based on the estimated traffic volume that will be
generated by their respective developments. The total contribution
is equal to the total cost for the project study report. See description
below for specific infonnation.
These agreements provide that the five developers will pay the cost
of the project study report for interchange improvements. The
project study report is proposed to be prepared by CCS P]anning and
Engineering, whose agreement for the work is a separate item on
this agenda. The estimated cost breakdovm for preparation of the
project study report by developer is:

These developers will receive a credit against payment of future Eastern Dublin Traffic Impact
Fees in an amount equal to funds advanced for this work. TIF Credit will only be given after the
cash deposits have been received by the City.
It is proposed to establish a new CapitaJ Improvement Project for this work, the cost of v,'hich is
to be offset by new revenue. The developers will post an initial deposit upon approval of this
agreement and advance the additional contribution as the study progresses.
DESCRIPTION: Improvement of the I-580/Tassajara Road Interchange is a required
mitigation for the Dublin Ranch Phase I, Dublin Ranch Areas A-E DeveJopment, ACSPA Santa Rita
Development, Tassajara Meadows I and Greenbriar Development. This agreement with the developers
of these projects (Jennifer Lin, ACSPA, Shea Homes, The Mission Peak Company and Greenbriar Land
Company) provides for payment of costs related to preparation of a Project Study Report for the needed
interchange improvements.
A separate item on the agenda provides for the City's agreement with CCS Planning and Engineering for
preparation of the PSR. The City already has an agreement \\lith George Homolka for consultant services
on 1-580 Interchange improvements.
Staff recommends that the City Council approve the budget change and adopt the resolution approving the
aQreement.

FOR 1-580rrASSAJAR.\ ROAD/SANTA RITA ROAD INTERCHANGE
WHEREAS, a part of the mitigation for the Dublin Ranch Phase I, Dublin Ranch Areas A - E
Development, Alameda County Surplus Property Authority (ACSP A) Santa Rita Development, Tassajara
Meadows I, and Greenbriar Development requires improvement of the I-580/Tassajara Road/Santa Rita
Road interchange; and
\VHEREAS, the City and Jennifer Lin, the ACSPA., Shea Homes, The :Mission Peak Company, and
Greenbriar Land Company have agreed to the preparation of a project study report related to this
interchange; and
\VHEREAS, a credit against payment of future Category 1 Eastern Dublin Traffic Impact Fees will
be provided in the amount ofJennifer Lin's, the ACSPA's, Shea Homes', The Mission Peak Company's,
and Greenbriar Land Company's payments to the City for costs related to the project study report;
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the agreements with
Jennifer Lin, the ACSPA, Shea Homes, The 1\1ission Peak Company, and Greenbriar Land Company
regarding preparation of project study report for the I-580/Tassajara Road/Santa Rita Road interchange;
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreements.

AND CITY OF DUBLIN
REGARDING PROJECT STUDY REPORT
FOR 1-580rrASSAJARA ROAD/SANTA RITA ROAD INTERCHANGE
THIS AGREEMENT is entered into this 2nd day of February, 1999, between the City of Dublin, a
municipal corporation ("City") and the Alameda County Surplus Property Authority (ACSP).
RECITALS
A.
ACSP owns approximately 660 acres of land located within the area generally known as
Eastern Dublin.
B.
City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road
improvements necessary in Eastern Dublin.
C.
City's Eastern Dublin Specific Plan ("Specific Plan") designates land uses for ACSP's
property. ACSP will be required to pay an Eastern Dublin Traffic Impact Fee when ACSP
further develops its property.
D.
A project study report or "PSR" is required by Caltrans in connection with improvements
to the Tassajara Road/Santa Rita Road interchange.

ACSP has agreed to advance funds to City for retention of a consultant to prepare a
project study report as provided in this agreement and City has agreed to provide ACSP a
credit against payment of future Eastern Dublin Traffic Impact Fees in an amount equal to
the funds advanced.
F.
Based on a preliminary traffic analysis, it has been determined that the Lin's initial fair
share portion of the 1-580lTassajara Road/Santa Rita Interchange PSR is 63%.
AGREEMENT
Now, therefore, City and ACSP agree as follows:
1. Consultant
City will retain a consultant to prepare a project study report for the Tassajara/Santa Rita
interchange. City shall enter into an agreement with a consultant within 30 days of this
agreement.
2. Pavment
ACSP will pay an initial deposit of $24,000 to City contemporaneous with execution of
this agreement to be used by City to cover City's costs of the PSR as set forth in
paragraph 1 above. Any funds remaining shall be returned to ACSP following completion
of the PSR. ACSP shall deposit additional funds when requested by the City's Public
Works Director but not to exceed an additional $63,974, for a total contribution of
$87,974.

3. Credit Aaainst TIF
City shall provide a credit to ACSP in the amount of ACSP's payment for the PSR. The
amount of the credit shall not be increased for inflation nor shall interest accrue on the
amount of the credit. The credit shall be applied by ACSP against the "Section 1" portion
of the Eastern Dublin Traffic Impact Fee for the Santa Rita Development project in the
manner and subject to the provisions of City's administrative guidelines for use of such
credits.
4. No Obliaation to Approve Proiect
This agreement shall not be construed as providing ACSP with any assurance that any
application for a land use entitlement will be granted by City for ACSP's property.

AND CITY OF DUBLIN
REGARDING PROJECT STUDY REPORT
FOR 1-580rr ASSAJARA ROAD/SANT A RITA ROAD INTERCHANGE
THIS AGREEMENT is entered into this 2nd day of February, 1999, between the City of Dublin, a
municipal corporation ("City") and MSSH Development LLC, a California Limited Liability Company
("Shea").
RECITALS
A. Shea owns approximately 210 acres of land located within the area generally known as
Eastern Dublin. Shea's property is within the City of Dublin.
B. City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road
improvements necessary in Eastern Dublin.
C. City's Eastern Dublin Specific Plan ("Specific Plan") designates land uses for Shea's property.
Shea will be required to pay an Eastern Dublin Traffic Impact Fee when Shea develops its
property.
D. A project study report or "PSR" is required by Caltrans in connection with improvements to
the Tassajara Road/Santa Rita Road interchange.
E. Shea has agreed to advance funds to City for retention of a consultant to prepare a project
study report as provided in this agreement and City has agreed to provide Shea a credit
against payment of future Eastern Dublin Traffic Impact Fees in an amount equal to the funds
advanced_
F. Based on a preliminary traffic analysis, it has been determined that the Shea's initial fair
share portion of the 1-580fTassajara Road/Santa Rita Interchange PSR is 11 %.
AGREEMENT
Now, therefore, City and Shea agree as follows:
1. Consultant
City will retain a consultant to prepare a project study report for the Tassajara/Santa Rita
interchange. City shall enter into an agreement with a consultant within 30 days of this
agreement.
2. Payment
Shea will pay an initial deposit of $11,000 to City contemporaneous with execution of this
agreement to be used by City to cover City's costs of the PSR as set forth in paragraph 1
above. Any funds remaining shall be returned to Shea following completion of the PSR.
Shea shall deposit additional funds when requested by the City's Public Works Director
but not to exceed an additional $29,321 for a total contribution of $40,321.

THIS AGREEMENT is entered into this 2nd day of February, 1999, between the City of Dublin, a
municipal corporation ("City") and Jennifer Lin ("Lin").
RECITALS
A.
Lin owns approximately 1,227 acres of land located within the area generally
known as Eastern Dublin. Some of Lin's property is within the City of Dublin and
the remainder of Lin's property is within the City's sphere of influence.
B.
City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for
road improvements necessary in Eastern Dublin.
C.
City's Ea~tern Dublin Specific Plan ("Specific Plan") designates land uses for Lin's
property. Lin will be required to pay an Eastern Dublin Traffic Impact Fee when
Lin develops her property.
D.
A project study report or "PSR" is required by Caltrans in connection with
improvements to the Tassajara Road/Santa Rita Road interchange.

interchange. City shall enter into an agreement with a consultant within 30 days of this
agreement.
2. Payment
Lin will pay an initial deposit of $63,000 to City contemporaneous with execution of this
agreement to be used by City to cover City's costs of the PSR as set forth in paragraph 1
above. Any funds remaining account shall be returned to Lin following completion of the
PSR. Un shall deposit additional funds when requested by the City's Public Works
Director but not to exceed an additional $167,932 for a total contribution of $ 230,932.
3. Credit Aaainst TIF
City shall provide a credit to Lin in the amount of Lin's payment for the PSR. The amount
of the credit shall not be increased for inflation nor shall interest accrue on the amount of
the credit. The credit shall be applied by Lin against the "Section 1" portion of the Eastern

THIS AGREEMENT is entered into this 2nd day of February, 1999, between the City of Dublin, a
municipal corporation ("City") and The Mission Peak Company ("MPC").
RECIT ALS
A MPC owns approximately 19+ acres of land located within the area generally known as
Eastern Dublin. MPC's property is within the City of Dublin.
B. City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road
improvements necessary in Eastern Dublin.
C. City's Eastern Dublin Specific Plan ("Specific Plan") sJesignates land uses for MPC's property.
MPC will be required to pay an Eastern Dublin Traffic Impact Fee when MPC develops its
property.
D. A project study report or "PSR" is required by Caltrans in connection with improvements to
the Tassajara Road/Santa Rita Road interchange.
E. MPC has agreed to advance funds to City for retention of a consultant to prepare a project
study report as provided in this agreement and City has agreed to provide MPC a credit
against payment of future Eastern Dublin Traffic Impact Fees in an amount equal to the funds

interchange. City shall enter into an agreement with a consultant within 30 days of this
agreement.
2. Payment
MPC will pay an initial $700 to City contemporaneous with execution of this agreement to
be used by City to cover City's costs of the PSR as set forth in paragraph 1 above. Any
funds remaining shall be returned to MPC following completion of the PSR. MPC shall
deposit additional funds when requested by the City's Public Works Director but not to
exceed an additional $1,866 for a total contribution of $2,566.
3. Credit Aaainst TIF
City shall provide a credit to MPC in the amount of MPC's payment for the PSR. The
amount of the credit shall not be increased for inflation nor shall interest accrue on the
amount of the credit. The credit shall be applied by MPC against the "Section 1" portion
of the Eastern Dublin Traffic Impact Fee for the project in the manner and subject to the
provisions of City's administrative guidelines for use of such credits.

THIS AGREEMENT is entered into this 2nd day of February, 1999, betvveen the City of Dublin, a
municipal corporation ("City") and Greenbriar Land Co. ("Greenbriar").
RECITALS
A. Greenbriar is under contract to purchase approximately 12.2 acres of land located within the
area generally known as Eastern Dublin. Some of Greenbriar's property is within the City of
Dublin and the remainder of Greenbriar's property is within the City's sphere of influence.
B. City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road
improvements necessary in Eastern Dublin.
C. City's Eastern Dublin Specific Plan ("Specific Plan") designates land uses for Greenbriar's
property. Greenbriar will be required to pay an Eastern Dublin Traffic Impact Fee when
Greenbriar develops its property.
D. A project study report or "PSR" is required by Caltrans in connection with improvements to
the Tassajara Road/Santa Rita Road interchange.
E. Greenbriar has agreed to advance funds to City for retention of a consultant to prepare a
project study report as provided in this agreement and City has agreed to provide Greenbriar
a credit against payment of future Eastern Dublin Traffic Impact Fees in an amount equal to
the funds advanced.
F. Based on a preliminary traffic analysis, it has been determined that the Greenbriar's initial
fair share portion of the 1-580lTassajara Road/Santa Rita Interchange PSR is 1.3%.

Now, therefore, City and Greenbriar agree as follows:
1. Consultant
City will retain a consultant to prepare a project study report for the Tassajara/Santa Rita
interchange. City shall enter into an agreement with a consultant within 30 days of this
agreement.
2. Pavment
Greenbriar will pay an initial deposit of $1,300 to City contemporaneous with execution
of this agreement to be used by City to cover City's costs of the PSR as set forth in
paragraph 1 above. Any funds remaining shall be returned to Greenbriar following
completion of the PSR. Greenbriar shall deposit additional funds when requested by the
City's Public Works Director but not to exceed an additional $3,465 for a total
contribution of $ 4,765.

That your Board, sitting as the Commission of the Surplus PropeI1y Authority of
.AJarm:da County authorize the e:::\.-penditure of up to $75,000 from surplus;
property development funds to pay for the City of Dublin's expenses relating to
the Project Study Report for planned improvements to the Tassajara RoadfI-580
interchange adjacent to the Santa Rita property.

One of the major Uoffsite" improvements requir'.....d for the build out of the ~
County's Santa Rita property in Dublin (as well as the rest of Eastern Dublin) is
th~ expansion of the 1-580lTassajara Road interchange. Several of the :
development agreements that the County has enrered into with th~ City fot
development on the Santa Rita property require that the County undertake~
improvements to this interchange when dictated by the City. With most of the
Santa Rita property DOW underway, these improvements will soon be required.
The City has decided to talæ a holistic approach towards the interchange and start
the process with Caltrans for constructing all improvements as part of one:
project, rather than in a piecemeal fashion. Therefore, the City is undertaking to
do a Project Study Report (PSR) with Caltrans as the fIrst step in reconstI'9-cring
the intercÌ1arlge to support fuil build out of Eastern Dublin, including the Santa
Rita development.
Per City policy that development pay for itself, the City has distributed the cost
of doing the PSR among the Eastern Dublin landowners according to traffic
volumes. According to the City, the Santa Rita property will contribute

approximately 24% ofth~ traffic, so the City is requesting that the County còntribute 24% of
the cost of the PSR. With the costs for City staff time and contingencies, the County's share
will Ix up to $Î5,OOO in addition to a $24,000 deposit previously made as parr of an earlier
agreement.
The PSR is only the fIrst stage in reconstructing the interchange. With the Project Report,
construction drawings and actual construcrion, the County's share of the interchange, at 24 %
of the: projected total, could approach $2 million. However, the County will receive credits
aga.inst the City's Traffic Impact Fees, which will then be reimbursed by Santa Rita and other
Eastern Dublin developers.
