Resolution Approving Contract RECONIl~ENDATION ~,f~~' Adopt Resolution FIPiANCIAL STATII~EAiT : Cast to City -$164,870; sufficient funds are includec~ in the FY 1992-93 Budget DESCRIPTIOId At the J'une 9, 1992 meeting of the Dublin City Council, the Council approved funding for 19 hours of additional library service at the Dublin Branch of the Alameda County Library from July 1, 1992 through June 30, 1993 as follows: eleven (11) additional hours each Monday, excluding County observed holidays, from 10:00 a.m. to 9:Q0 p.m.; four {4) additional hours each Thursday, excluding County observed holidays, from 5:00 p.m. to 9:0~ p.m.; and four (4) additional hours each Sunday, excluding County observed holidays, from 1:00 p.m. to 5:00 p.m. T~e cost to the City for additional library service is $164,870. The proposed contract agreement for additional library services is attached in Exhibit A. Included in the agreement is a provision whereby the City or the County has the option to terminate or renegotiate the contract in the event that there are changes in the amount of available funding. It is the recommendation of Staff that the City Council adopt the resolutiQn in Exhibit B which approves the contra~t with the County of Alameda for additional lihrary services. -------- - -------------------------------~----------------------- ITEM YdO. COPIES TO: ~PqEDA COUNTY LIBRARY CITY CLERK FILE ~ 0 ~ t ~ • ~ RESOLUTION NO. 77 - 92 A RE50LUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING A CONTRACT WITH THE COUATTY OF ALAMEDA FOR ADDITIONAL LIBRAR,Y SERVICES DURING FISCAL YEI~Et 1992-93 WHEREAS, the City of Dublin and the Alameda County Library are desirous of providinq quality library services to residents of the City of Dublin; and WHEREAS, the services provided at the Dublin Library have been historically reduced by the County due to lack of funding; WHEREAS, the City Council of the City of Dublin wishes to provide additional funds in order that the Library may be open on Monday from 10:OOa.m. to 9:OOp.m., Thursday from 5:OOp.m. to 9:OOp.m., and Sunday from 1:OOp.m. to 5:OOp.m.; and WHEREAS, the Dublin City Council has allocated sufficient funds for Fiscal Year 1992-93 to maintain the additional hours of Library Service to the residents; and WHEREAS, the County of Alameda has agreed to provide the additional Library hours at the Dublin Branch of the Alameda County Library System. NOW THEREFORE, BE IT RESOLVED THAT THE City Council of the City of Dublin does hereby approve the attached Agreement between the City of Dublin and the County of Alameda for additional Library Services and further authorizes the Mayor to execute said agreement. Shauld salary increases be hfgher or lower than anticipated as a result of further pay equity ad~uStments in 1992/93, the County I~ibrarian may return to the Dublin City Council to negotiate a m~d-year funding ad,justment for personnel costs. 7) U tipn to Terminate or Rene otiat9 Contr~ct: This contract is predicated on the assumpti on t a rary servi ce levels wi11 remain canstant. Should any clrcumstance arise which char~ges both County I~ibrary funding levels and levels of service or City fund~ng levels, either party shall have the right to terminate vr renegotfate this agreement by giving at least thirty (30} dsys writ~en notice. 8) Liabl1~i~: a) All persons employed ~n the performance of such serv9ces and functions for City of Dublin shall be County emp1oyees, and no City employees as such sha11 be taken ov~r by the County and no person hereunder shall have any City pension, Civic Service, or other statu5 or right. ,~ , • b) The City shall not be caTled upon to assume any liabili~y for the direct payment of any salary, wages, or other compensation to any County personnel performing services hereunder for the Cfty, or any l~ability other than that provided for in this agreement. ~xcept as herein otherwise sp~cified, the City sha11 not be 11ab1e for compensation or indemnity to any County employee for in~ury or sickness arising out of hfs/her employment. c) 1'he Coun~y will assume liabili-~y and pay cost of defense and hold ~he City harmless fram loss, costs or expenses caused by the negiigent ar wrongful act or omfssion of County officers, agents and empToyees occurring in the perfprmance of agreements between the parties here~o to the extent that su~h l~ability 1s imposed on the City by the provisions af Sectfon 895.2 of the Gov~rnment Code of the State of California.
