The cost of the study is not to exceed $9,700
without written approval. Funds are budgeted
in the Dublin Boulevard/Silvergate Drive
Intersection Modification Capital Improvement
Project for this purpose.
DESCRIPTION: A project is included in the current Capital
Improvement Program (CIP) which will modify the Dublin Boulevard/
Silvergate Drive intersection into a "T" intersection, with Dublin
Boulevard being the through street. The first phase of design for
this project is to obtain specialized geotechnical services. The data
prepared under this agreement will be utilized by the design engineers
to complete project plans and specifications.
Dublin Boulevard is constructed on a fill embankment between Hansen
Drive and Silvergate Drive. Numerous longitudinal cracks have
developed on this section of Dublin Boulevard. Geotechnical
investigation is needed to assess the subsurface condition beneath the
pavement in order to determine the reason for the cause of distress
and to recommend mitigation. The investigation will also include
recommendations for fill materials, compaction requirements, cut and
fill slope stability considerations, pavement design parameters, and
alternative pavement sections for the added lanes and possible
replacement of existing pavement.
On July 24, 1991, the Public Works Department received four (4)
proposals from local qualified engineering consulting firms. After
reviewing all four proposals for past performance, experience,
knowledge of the area and site, ability to complete the project in a
short time, and equipment and staffing, Staff considered Berlogar
Geotechnical Consultants best able to fulfill the City's requirements.
After choosing Berlogar as the consultant, Staff opened the fee
proposal packages and found Berlogar's fees to be in line with the
scope of work to be performed. In accordance with State Law, the
selection of engineers and architects and other specified services
must be based upon qualifications rather than bid prices.
Staff will have an item on a future agenda regarding the selection of
an engineering design firm to prepare plans and specifications for
this project. The geotechnical services will result in
recommendations which will be incorporated into the final design. DUe
to the specialized nature of geotechnical services, it is typical to
utilize two different consultants for this type of work.
staff recommends that the City Council adopt the resolution approving
the agreement with Berlogar Geotechnical Consultants.

WHEREAS, The City Of Dublin plans to widen Dublin Boulevard
between Hansen Drive and Silvergate Drive; and
WHEREAS, a geotechnical investigation is needed to assess
the subsurface conditions beneath the pavement in order to determine

WHEREAS, geotechnical investigation will also include

WHEREAS, contract personnel are needed to perform these
technical services; and
WHEREAS, Berlogar Geotechnical Consultants has demonstrated
adequate ability to perform the work;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Dublin does approve the agreement with Berlogar Geotechnical
Consultants to conduct a geotechnical investigation for Dublin
Boulevard between Hansen Drive and Silvergate Drive.
BE IT FURTHER RESOLVED that the City Manager is authorized
to execute the agreement.

STANDARD
CONSULTING ENGINEERING SERVICES AGREEMENT
THIS AGREEMENT is made at Dublin, California, as of
~ I~_, 1991, by and between the CITY OF DUBLIN, a municipal
corporation ("City"), and Berlogar Geotechnical Consultants,
(..Consultant"), who agree as follows:
1. SERVICE~. Subject to the terms and conditions set
forth in this Agreement, Consultant shall provide to City the
services described in Exhibit A. Consultant shall provide said
services at the time, place, and in the manner specified in
Exhibit A.
2. PAYMENt. City shall pay Consultant for services
rendered pursuant to this Agreement at the time and in the manner
set forth in Exhibit B. The payments specified in Exhibit B
shall be the only payments to be made to Consultant for services
rendered pursuant to this Agreement. Consultant shall submit all
billings for said services to City in the manner specified in
Exhibit B; or, if no manner be specified in Exhibit B, then
according to the usual and customary procedures and practices
which Consultant uses for billing clients similar to City.
3. FACILITIES AND EQUIPMENT. Except as set forth in
Exhibit C, Consultant shall, at its sole cost and expense,
furnish all facilities and equipment which may be required for
furnishing services pursuant to this Agreement. City shall
furnish to Consultant only the facilities and equipment listed in
Agreement

Exhibit C according to the terms and conditions set forth in
Exhibit C.
4. GENERAL PROVISIONS. The general provisions set
forth in Exhibit D are part of this Agreement. In the event of
any inconsistency between said general provisions and any other
terms or conditions of this Agreement, the other term or
condition shall control insofar as it is inconsistent with the
general provisions.
5. EXHIBITS. Ail exhibits referred to herein are
attached hereto and are by this reference incorporated herein.
6. SUBCONTRACTING. The Consultant shall perform the
work contemplated with resources available within its own
organization and no portion of the work pertinent to this
contract shall be subcontracted without written authorization
by the City, except that which is expressly identified in the
Consultant's proposal.
7. CHANGERS. City may from time to time require
changes in the scope of the services by Consultant to be
performed under this Agreement. such changes, including any
change in the amount of Consultant's compensation which are
mutually agreed upon by City and Consultant, shall be effective
as amendments to this Agreement only when in writing.
8. RESPONSIBLE CHARGE. Consultant shall assign
a project manager(s) to the project for the duration of the
project. There shall be no change in the Project Manager or
members of the project team without prior written approval by the

PAYMENT SCHEDULE
City shall pay Consultant an amount not to exceed the
total sum of NINE THOUSAND SEVEN HUNDRED DOLLARS ($9,700) for
services to be performed pursuant to this Agreement. Consultant
shall submit invoices at the end of project based on the cost for
services performed in accordance with the Job No. 7992.400 dated
July 24, 1991 cost estimate of $9,400 and City will also pay an
additional $300 for backfilling the bore holes with weak concrete
grout and capped with asphalt patch (the thickness of asphalt
patch shall be equal to existing A.C. plus A.B.).
The total sum stated above shall be the total which
City shall pay for the services to be rendered by Consultant
pursuant to this Agreement. City shall not pay any additional
sum for any expense or cost whatsoever incurred by Consultant in
rendering services pursuant to this Agreement
City shall make no payment for any extra, further or
additional service pursuant to this Agreement unless such extra
service and the price therefor is agreed to in writing executed
by the City ~anager or other designated official of City
authorized to obligate City thereto prior to the time such extra
service is rendered. If the cost for additional services is over
25% of the original contract amount, City council approval is
required.

The services to be provided under this Agreement may be
terminated without cause at any point in time in the sole and
exclusive discretion of City. If the Agreement is terminated by
City, Consultant shall be entitled to receive just and equitable
compensation for any satisfactory work completed on such
documents and other materials to the effective date of such
termination. In that event, all finished and unfinished
documents and other materials shall, at the option of the City,
become City's sole and exclusive property. Consultant hereby
expressly waives any and all claims for damages or compensation
arising under this Agreement. Consultant shall maintain adequate
logs and timesheets in order to verify costs incurred to date.
The Consultant is not authorized to perform any
services or incur any costs whatsoever under the terms of this
Agreement until receipt of a fully--executed Purchase Order from
the Finance Department of the City of Dublin.

City shall furnish physical facilities such as desks,
filing cabinets, and conference space, as may be reasonably nece-
ssary for Contractor's use while consulting with City employees
and reviewing records and the information in possession of City.
The location, quantity, and time of furnishing said physical
facilities shall be in the sole discretion of City. In no event
shall City be obligated to furnish any facility which may involve
incurring any direct expense, including, but not limiting the
generality of this exclusion, long-distance telephone or other
communication charges, vehicles, and reproduction facilities.

volunteers shall be excess of the Consultant's

c. Any failure to comply with reporting provisions of
the policies shall not affect coverage provided to
the City, its officers, officials, employees or
volunteers.
d. The Consultant's insurance shall apply separately
to each insured against whom claim is made or suit
is brought, except with respect to the limits of
the insurer's liability.
Worker's Compensation and Employers Liability Coverage.
The insurer shall agree to waive all rights of
subrogation against the City, its officers, officials,
employees and volunteers for losses arising from work
performed by the Consultant for the City.
Professional Liability.
Consultant shall carry professional liability insurance
in an amount of $500,000 to protect the City against
liability caused by negligent acts, errors or omissions
on the part of the Consultant in the course of
performance of the services specified in this
Agreement.
Ail Coverages.
Each insurance policy required by this clause shall be
endorsed to state that coverage shall not be suspended,
voided, cancelled by either party, reduced in coverage
or in limits except after thirty (30) days prior
written notice by certified mail, return receipt
requested, has been given to the City.

(e) Acce_j~tability of Insurers. Insurance is to be placed

copies of all re?aired insurance policies, at any time.

5. CONSULT~NT NO AGENT. Except as city may specify in writing,
Consultant shall have no authority, express or implied, to act on
behalf of city in any capacity whatsoever as an agent. Consultant
shall have no authority, express or implied, pursuant to this
Agreement to bind city to any obligation whatsoever.
6. ASS!G~XTMENT PROHIBITE~D. No party tc this Agreement may
assign any right or obligation pursuant to this Agreer~ent. Any

9. HOLD HARMLESS AND p~SPONSIBILITY OF CONSULT~-NTS- Consultant

Dear Mr. Thompson:
We are pleased to present this proposal to perform a geotechnical
investigation for the subject site. This proposal is in response
to your ,,Request for Proposal" (RFP) letter submitted to our
office. We previously submitted a proposal to perform a pavement
distress investigation for Dublin Boulevard, dated November 5,
1989. According to your "RFP" Dublin Boulevard will be widened
between Hansen Drive and approximately 400 feet west of Silvergate
Drive and the intersection with Silvergate Drive will be
reconstructed. The existing road is about 15 to 20 years old and
is constructed on a fill embankment ranging in height from about
5 to 25 feet. During a visit to the site prior to the preparation
of our initial proposal letter, we observed numerous longitudinal
cracks in the pavement with most of the cracks on the northern side
of the east-west trending roadway. At that time, you informed us
that these cracks had been present for several years and had
increased since they were sealed in May 1989. During a recent
visit to the site, we noted the cracking patterns are still present
and appear to have increased since our previous site visit.
The purpose of our geotechnical investigation would be to assess
the subsurface conditions beneath the pavement in order to
determine the cause of distress and to provide recommendations for
mitigation and repair. It shall also include the preparation of
recommendations for the roadway widening including recommendations
for fill materials, compaction requirements, cut and fill slope
stability considerations, pavement design for the added lanes and
recommendations for possible replacement of the existing pavemen%.
Our initial observations and our experience with other projects in
the area suggest that the pavement distress may be caused by
shrinking and swelling of the expansive embankment soils. The
shrinking (from drying) of the expansive embankment soils may be
influenced by the large trees located along the slopes on both
sides of the roadway. Root systems from large trees can remove
significant amounts of moisture from the surrounding soil resulting
in shrinking of the surrounding soils and subsequent depressions

or cracking in the overlying pavement. We have observed the
phenomenon in other parts of the Livermore Valley and are currently
performing investigations on two nearby sites where this phenomenon
has resulted in major distress to pavement areas. It is also
possible that slope failure related to creep or seismic affects may
be at least a contributing cause to the observed distress.
SCOPE OF WORK
The scope of our investigation will follow the outlined tasks
presented in your RFP.

We will perform a reconnaissance of the site and review the
available reports, drawings and maps related to the project.
Task 2
We will perform a field investigation which will include the
drilling a total of five borings within the roadway area. Three of
the borings will be drilled in the area of pavement cracking to
depths ranging from 20 to 35 feet below existing grade. The other
borings will be drilled to depths of 10 feet in the area of
proposed widening. The borings would be drilled under the
supervision of our field engineer who would prepare detailed logs
of the materials encountered and obtain both bulk and relatively
undisturbed samples of the earth materials for laboratory testing.
The bore holes will be backfilled with soil cuttings and capped
with asphalt patch.
Task 3
We will perform laboratory testing on selected soil samples which
will include moisture content and dry unit weight determinations,
Atterberg Limits and shrink-swell tests to evaluate the expansion
potential of the existing fill soils, and static strength test to
evaluate slope stability characteristics of the subsurface
materials. We will also perform R-value tests on the existing
subgrade soils for design of the proposed new roadway section.
Task 4
After we have completed our field and laboratory testing we will
analyze the data and meet with your staff to discuss the findings.
Task 5
We will prepare a written report presenting our findings along with

stability considerations; alternative pavement sections
and possible replacement of the existing pavement; and

seismic considerations.
Our work will be performed by our qualified staff of professionals
and technicians under the supervision of Mr. Dan O'Connell,
principal engineer, a registered civil engineer in the State of
California. We will submit ten (10) copies of our final report to
the city of Dublin.
We are prepared to begin our site reconnaissance services
immediately upon authorization. We expect to be able to perform
our field investigation within one to two weeks after
authorization, depending on availability of a subcontracted drill
rig. We expect that our laboratory testing would be completed
within one week after completion of our field investigation and we
would be available to meet with the city to discuss our findings
within two weeks. We would complete our written report within one
week after meeting with your staff.
our firm has provided geotechnical services for the city of Dublin
and other clients on numerous projects in the site vicinity. For
the city of Dublin, we recently provided consultation regarding
pavement distress on Juarez Court and performed a geotechnical
investigation for improvements to Shannon Park. We are on the
project team providing consultation to the city for the West Dublin
Study Area which is located due west of the subject project. We
have also provided consultation to the major property owner in the
East Dublin Planning Area.

INTRODUCTION
We present our following cost estimates for providing a
geotechnical investigation for the subject project. Our proposed
scope of work is presented in a separate proposal letter. Our work
would be performed in accordance with our attached Fee Schedule -

Overtime work performed at the request of the client or necessitated by contractor working
overtime will be billed at 1.5 times the hourly rates listed above.
Expert witness testimony/deposition minimum charges: $850/half day; $1,500/full day;
preparation at applicable hourly rates.
Project related costs including: printing and Reproduction, Special Fees, permits or
insurance, Telegrams, Telephone, Shipping, Equipment Rental, Meals and Lodging and
other similar items are billed at cost plus 15 percent. Copies of previously issued
reports of up to 50 pages will be billed at $35.00 for the first copy, and $25.00 for
each additional copy. Specific quotes for larger reports and/or reports containing

A new Fee Schedule is issued at the beginning of each year. Unless other arrangements have

(e) Consultant will make borings and/or trenches during subsurface exploration of the site.
Consultant will attempt to backfill att borings and/or trenches but will make no attempt to
compact said backfill so Jt is probable that settlement of the backfill will occur. Client hereby
agrees to accept a~l responsibility for conditions related to backfill settlement, if Client

(f) All samples of soil or rock will be discarded thirty days after submission of our report
unless specific arrangements are previously made by Client.
LABORATORY TESTS
(Unit charge for laboratory testing including the normal laboratory work and reporting of results
only. Unusual or time-consuming sample preparation or special tests are billed at hourly charge
for the laboratory technician. Charges for testing which are not listed will be given upon

In the event that the Client requests termination of the work prior to completion of a report, we
reserve the right to complete such analyses and records as are necessary to place our files in
order and, where considered by us necessary to protect our professional reputation, to complete a
report on the work performed to date. A termination charge to cover the cost thereof in an amount
not to exceed 30 percent of all charges incurred up to date of the stoppage of the work may, at
the discretion of BERLOGAR GEOTECHNICAL CONSULTANTS, be made.
ALL work including Letters and reports prepared by BERLOGA~ GEOTECHNICAL CONSULTANTS shall remain
the sole property of BERLOGAR GEOTECHNICAL CONSULTANTS until payment in full is received.
LIMITATIONS
BERLOGAR GEOTECHNICAL CONSULTANTS provides services in the field of
Soil Engineering - Engineering Geology, in accordance wi:h presently
accepted professional practices. No warranty, either expressed or
implied, is granted as part of performance of our work.
For any damage on account of any error, omission or other professional negligence, our Liability
will be limited to a sum of $50,000 or our fee, whichever is greater.
In the event the Client makes a claim against BERLOGAR GEOTECHNICAL CONSULTANTS at Law or
otherwise, for any alt ged error, omission or other acts arising out of the performance of our
professional services, eand the Ciient fails to prove such claim, then the Client shall pay all
costs incurred by BER~OGAR GEOTECNNICAL CONSULTANTS in defending itself against the claim.
BILLING
Invoices will be issued every month, payable upon receipt, unless otherwise agreed. CLient agrees
to pay on receipt all invoices not questioned within 10 days after mailing by BERLOGAR
GEOTECHNICAL CONSULTANTS. Any questions raised after this lO-day period will be answered by
BERLOGAR GEOTECHNICAL CONSULTANTS and should any credit be due, BERLOGAR GEOTECHNICAL CONSULTANTS
will apply the credit to future invoices, or if requested by CLient, refund any amount due.
A service charge of 2 percent per month (but not exceeding the maxirr~Ja rate allowable by Law) will
be payable on any amounts not paid within 30 days, payment thereafter to be applied first to
accrued interest and then to the principal unpaid amount. Any attorney'S fees or other costs
incurred in collecting any delinquent amount shall be paid by the Client.

REQUEST FOR PROPOSAL (R.F.P.)
GEOTECHNICAL AND SOILS INVESTIGATION
FOR DUBLIN BOULEVARD BETWEEN
HANSEN DRIVE AND APPROXIMATELY
400' WEST OF SILVERGATE DRIVE
The City of Dublin invites Submittals of Proposals to perform and
prepare reports for geotechnic~l and soils investigation for Dublin
Blvd. between Hansen Drive and approximately 400' west of Silvergate
Drive.
Backqround
Currently, Dublin Blvd. west of Silvergate is a two-lane street that
ends in a cul de sac west of Silvergate Drive with few residences and
businesses. Most of the traffic travels between Dublin Blvd. east of
Sitvergate Drive and Silvergate Drive. This pattern will change in
the future due to development west of Silvergate Drive close to Dublin
Blvd. and the extension of Dublin Blvd. further west with interchanges
to the 1-580 freeway. The expected increase in traffic on Dublin
Blvd. makes it necessary to widen Dublin Blvd. and modify its
intersection with Silvergate Drive. Dublin Blvd. is constructed on a
fill embankment between Hansen Drive and Silvergate Drive. Numerous
longitudinal cracks can be seen on this section of Dublin Blvd.
Geotechnical Investigation shall include assessing the subsurface
condition beneath the pavement in order to determine the reason for
the cause of distress and recommending mitigation for it. It shall
also include providing recommendations for fill materials, compaction
requirements, cut and fill slope stability considerations, subgrade
R-value(s), and alternate pavement sections for the added lanes and
possible replacement of the existing pavement.
Scope of Work
The Consultant's work scope shall include the tasks outlined below:
TASK I.
Perform a site reconnaissance and review existing geotech-
nical reports, construction drawings, aerial photographs,
topographic maps, and pertinent documents in order to assess
the conditions prior to construction and the manner in which
the existing two-lane section of Dublin Blvd. (between
Hansen Drive and Silvergate Drive) was constructed.

TASK II.
Perform a field investigation as necessary, including
borings and test pits as necessary. Soils Consultant shall
be responsible for the proper backfill of these test holes.
TASK III. Perform laboratory soil testing, as necessary.
TASK IV. Analyze the data and meet with the city of Dublin Public
Works staff to discuss findings.
TASK V.
Prepare a written report addressing the following:
a. Establish the soil profile, including thickness of fill
under the existing pavement.
Address the cause(s) of existing pavement and embank-
ment distress evidenced by numerous pavement cracks and
recommend mitigation measure(s).
Provide recommendations for excavation and subgrade
preparation, cut and fill slopes, and surface and
subsurface drainage for the roadway widening.
Provide recommendations for fill materials, compaction
requirements, slope stability considerations and
related factors involved in this project.

Provide recommended subgrade R-value(s) and alternate
pavement sections for the added lanes and possible
replacement of the existing pavement.
Comment on necessary precautions for slopes during
construction.
Provide design parameters for retaining structures to
retain the added embankments, if necessary.
Provide additional pertinent geotechnical information
related to this project.
Ail work shall be performed by qualified personnel under the super-
vision of a Registered Civil Engineer. The final report shall be
signed by a Registered Civil Engineer. Ten (10) copies of the final
report shall be provided by the Consultant to the City of Dublin.

Consultant Selection
All Consultants' proposals submitted in response to this request will
be screened by the city of Dublin. The City will determine through
this process which consultant will be awarded the project.
The selection of the Consultant could be based on the following:
o How adequately equipped and financially able the Consultant
is to perform the project.
o Necessary experience, organization, technical qualification,
skills, and facilties to perform this work.
o Ability to complete the project in a timely matter and in a
fairly short time frame.
o Satisfactory record of performance and compilation of
projects on time.
o Knowledge of sites near this one.
o Qualifications of staffmembers to be assigned to this
project.
Final selection of the Consultant will take place no later than
fifteen (15) working days after the deadline for the submittal of
proposal.
Requirements and Authority of City of Dublin
Ail reports, maps, plans, specifications and pertinent data or
materials prepared under this agreement shall be the property of the
City of Dublin and may not be used or reproduced in any form without
the explicit written permission of the city of Dublin.
This Request for Proposal does not commit the City to award a contract
or to pay any costs incurred in the preparation of the proposal to
this request. The City reserves the right to accept or reject any or
all proposals received as a result of this request, to negotiate with
any qualified source, or to cancel in part or entirely this Request
for Proposal if it is in the best interest of the City to do so. The
city may require the proposers selected to participate in negotiations
and to submit such price, technical or other revisions of their
proposals as may result from negotiations.
The City has the authority to terminate its contract with the
Consultant at any time during the period of the study if it is found
by the City that the Consultant's performance is not satisfactory.

Proposal Requirements
The Consultant's proposal should provide a critique of the work
program and describe the program, scheduling and methodology of
carrying out its tasks. The Consultant shall include:
a. A time schedule for each task.
b. In a separate sealed envelope, provide a fee estimate for
performing each task as a starting point for negotiation.
This envelope will be opened after the preferred Consultant
is selected.
This cost estimate must include the required project related
meetings (at least tw~ meetings: one at the beginning of
the project and one at the end of the project).
The proposal shall identify the project manager for the study and
preparation of reports. The proposal shall be signed by an individual
authorized to bind the Consultant and shall contain a statement to the
effect that the proposal is a firm offer for a 75-day (or more)
period.
The proposal shall also provide the following information: name,
title, address and telephone number of individual(s) with authority to
negotiate and contractually bind the company and who may also be
contacted during the period of proposed evaluation.
Proposal Submittal
Three (3) copies of the completed proposal must be received by
the Public Works Director/City Engineer by 5:00 p.m. on Wednesday,
July 24, 1991.
