FINANCIAL STATEMENT:
The cost for preparation of the PEER and PS&E for the 1-580/
Hacienda Drive Interchange Improvements and for the preparation
of the PEER and PS&E for the left-turn pocket for Koll
Development from Tassajara Road is $219,000.
The agreement provides that ACSP A will pay these costs as
mitigation for ACSPA's projects. The PEER's and the PS&E's are
proposed to be completed by High Quality Engineering (HQE) in a
separate item on this agenda.
The costs for preparation of PEER's and PSE's are as follows:

ACSPA will receive a credit for the preparation of the PEER and PS&E for the 1-580/Hacienda
Drive Interchange against payment of future Eastern Dublin Traffic Impact Fees in an amount
equal to funds advanced for this work. TIF Credit will only be given after the cash deposits have
been received by the City. ACSPA will not receive credit for preparation of the PEER and PS&E
for the left-turn pocket into the Koll Development from Tassajara Road as it is development
related.

It is proposed in another agenda item (Amendment to Agreement with HQ~) to authorize a new
Capital Improvement Project for the 1-580/Hacienda Drive Interchange work. ACSPA will post
an initial deposit of $1 00,000 upon approval of this agreement and advance the additional
contribution as requested by the City as the study progresses.
DESCRIPTION: Improvement of the 1-580/Hacienda Drive Interchange is a required
mitigation for the ACSP A Santa Rita Development. This agreement with ACSP A provides for payment
of costs related to preparation of the PEER and PS&E for the needed interchange improvements. The
preparation of the PEER and PS&E for the left-turn pocket into the Koll Development from Tassajara
Road in connection with improvements in the Caltrans right-of-way is also a required mitigation for the
ACSP A Santa Rita Development. This agreement with ACSP A also provides for payment of costs
related to the preparation of the PEER and PS&E for the Koll Development/Tassajara Road intersection
improvements.
A separate item on the agenda provides for the City's agreement with HQE for preparation of the PEER
and PS&E for both the 1-580/Hacienda Drive Interchange project and the Koll Development/Tassajara
Road project.

Staff recommends that the City Council approve the budget change and adopt the resolution approving the
agreement.

APPROVING AGREEMENT WITH THE ALAMEDA COUNTY SURPLUS
PROPERTY AUTHORITY (ACSP A) FOR THE PREPARATION OF PERMIT ENGINEERING
EVALUATION REPORTS (PEER) AND THE PLANS, SPECIFICATIONS AND ESTIMATES
REPORTS (PS&E) FOR I~580/HACIENDA DRIVE INTERCHANGE AND FOR THE
LEFT-TURN POCKET FOR KOLL DEVELOPMENT FROM T ASSAJARA ROAD
WHEREAS, a part of the mitigation for the Alameda County Surplus Property Authority
(ACSPA) Santa Rita Development requires improvement of the 1-580/Hacienda Drive Interchange and a
left-turn pocket for Koll Development from Tassajara Road within the Caltrans right of way; and
WHEREAS, the City and ACSP A have agreed to the preparation of a PEER and PS&E report
related to this interchange and a PEER and PS&E related to this left-turn pocket; and
WHEREAS, a credit against payment of future Category 1 Eastern Dublin Traffic Impact Fees
will be provided in the amount of ACSPA's payments to the City for costs related to the PEER and PS&E
for this interchange but shall not be provided for the PEER and PS&E for the Tassajara Road left-turn
pocket.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the agreement with
ACSPA regarding preparation ofa PEER and PS&E for the 1-580/Hacienda Drive Interchange and
regarding preparation of a PEER and PS&E for the left-turn pocket for Koll Development from Tassajara
Road within the Caltrans right of way;
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreement.

THIS AGREEMENT is entered into this 16th day of February 1999, between the City of Dublin, a
municipal corporation ("City") and the Alameda County Surplus Property Authority (ACSPA).

A.
ACSPA owns approximately 660 acres of land located within the area generally known as
Eastern Dublin.
B.
City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road
improvements necessary in Eastern Dublin.
C.
City's Eastern Dublin Specific Plan ("Specific Plan") designates land uses for ACSPA's
property. ACSPA will be required to pay an Eastern Dublin Traffic Impact Fee when
ACSPA further develops its property.
D.
A Permit Engineering Evaluation Report or "PEER" and a Plans, Specifications &
Estimates report or "PS&E" is required by Caltrans in connection with improvements to
the Hacienda Drive Interchange.
E.
A Permit Engineering Evaluation Report or "PEER" and a Plans, Specifications &
Estimates report or "PS&E" is required by Caltrans for the left-turn pocket for KolI
Development at Tassajara Roadin connection with improvements in the Caltrans right of
way at the intersection of KolI Development and Tassajara Road.

ACSPA has agreed to advance funds to City for retention of a consultant to prepare a
permit engineering evaluation report and a plans, specifications and estimates report as
provided in this agreement and City has agreed to provide ACSPA a credit against
payment of future Eastern Dublin Traffic Impact Fees in an amount equal to the funds
advanced.

Based on a preliminary traffic analysis, it has been determined that the ACSPA's fair
share portion of the PEER's and PS&E's is 100%.

Now, therefore, City and ACSPA agree as follows:
1. Consultant
City will retain a consultant to prepare a permit engineering evaluation report and a plans,
specifications and estimates report for the Hacienda Drive Interchange and City shall

speel1icatlons and estimates report for the KolI Development at Tassajara Road. City
shaD enter agreements with consultants within 30 days of this agreement.
2. Payment
ACSPA will pay an initial deposit of $100.000 to City contemporaneous with execution of
this agreement to be used by City to cover City's costs of the PEER's and PS&E's as set
forth in paragraph 1 above. Any funds remainIng shall be returned to ACSPA following
completion of th~ PEER's and PS&E's.. ACSPA shall deposit additional fundS when
fsquested by the City's Public Works Director bLlt not to exceed an additional $119.000,
for a total contribution of $219,000.
J. Credit AClainst TIF

City Shall provide a credit to ACSPA in the amount of ACSPA's payment for the PEER
and PS&E for the J.580/Haeienda Drive Interchange project. A credit shall not be
reeeived for the PEER and PS&E for the Koll Oevelopmel'lVTassajara Roa~ project since
it is de\'elopment related. The amount of the credit shall not be increased for inflation nor
shall interest aeerue on the amount of the credit. The credit shall be applied by ACSPA
il~ain:;t the .Section l' portion of the Eastern Dublin iraffic Impact Fee for the Santa Rita
Development project in the mannar and subject to the provision, of City's administrative
guidelines for use of such credits.

4. No Obliaation to Approve Proiect
This agreement shall not be construed as providing ACSPA with any assurance that any
application for a land'us~ entitlement will be granted by City for ACSPA's property.
