HomeMy WebLinkAbout4.13 Approve Final Map Tract 5900 r• CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: April 27, 1992 SUBJECT: Approval of Final Map - Tract 5900 (BJ Dublin Commercial, Inc. - Dougherty Road) Report by: Public Works Director Lee Thompson EXHIBITS ATTACHED: 1) Resolution approving Final Map 2) Resolution releasing Developer Agreement 3) Location Map 4) Reduced copy of Final Map RECOMMENDATION: �/" Adopt resolutions FINANCIAL STATEMENT: Construction of public improvements within this Tract will take place as part of City Contract 92-01, which is paid for by the Dublin Boulevard Extension Assessment District. Inspection costs are also paid by the Assessment District. The City will incur maintenance and sweeping costs once the improvements have been constructed and accepted. DESCRIPTION: Tract 5900 is located on Dougherty Road just north of Scarlett Court and adjacent to the Borchers Brothers building supply business. In May of 1984, the City Council approved the Final Map for Tract 4978 and the tract developer agreement therefor and accepted a Letter of Credit in the amount of $460,000 as security. This Tract included street right-of-way dedication for the easterly extension of Sierra Lane; however, no improvements were ever constructed in this Tract, and the property was sold by the original subdividers. In 1989, the City Council approved a substitution of developer and an amendment to the developer agreement. The developer agreement and securities from the original developer were released. The new developer, BJ Dublin Commercial, Inc. (John Moore) provided a Declaration of Restrictions which prohibited sale of individual lots in the Tract until a new Tract Map was filed. The Tract 5900 Final Map combines the five individual lots of Tract 4978 and one additional lot to the north into one lot and eliminates the Sierra Lane dedication. The Dublin Boulevard Extension is located along a portion of the south side of the Tract, as shown in the Location Map, Exhibit 3. All public improvements in this Tract are to be built by City Contract 92-01, and the Dublin Boulevard Extension Assessment District guarantees payment for the work; therefore, no new developer agreement or performance or labor and materials bonds are necessary. The Declaration of Restrictions is automatically released upon establishment of the Dublin Boulevard Extension Assessment District, 31 days following the levy of assessments, AND upon recordation of the Final Map for Tract 5900. Staff recommends that the City Council adopt the resolution approving the Final Map and the resolution releasing the 1989 developer agreement. ITEM NO. ® COPIES TO: BJ Dublin Commercial, Inc.OF X REF 600-6C CLE[CITY E I OfE RESOLUTION NO. -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING FINAL MAP TRACT 5900 DOUGHERTY ROAD .(BJ DUBLIN COMMERCIAL) WHEREAS, the Final Map for Tract No. 5900, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval, all in accordance with the provisions of -the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, funding for the public improvements in said Tract is guaranteed by the Dublin Boulevard Extension Assessment District and therefore no developer agreement or bonding is necessary; NOW, THEREFORE, BE IT RESOLVED that the Final Map of Tract No. 5900 be and the same is hereby approved; and that those strips of land designated as "P.U.E." or "Public Utility Easement" as offered for dedication to public use in conformity with the terms of dedication be, and they are hereby accepted; and that the Clerk of this City Council be and is hereby directed to transmit said Map to the County Recorder for filing. AYES: NOES: ABSENT: Mayor ATTEST: City Clerk a:(corres)\apr\res5900m WSO aft3ftv194& F AL MAP RESOLUTION NO. -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN RELEASING DEVELOPER AGREEMENT TRACT 4978 DOUGHERTY ROAD (BJ DUBLIN COMMERCIAL) WHEREAS, on March 27, 1989, the City Council approved a developer agreement for Tract 4978 with BJ Dublin Commercial, Inc. , and WHEREAS, on September 25, 1989, the City Council approved an amendment to said developer agreement and a Declaration of Restrictions as security for improvements in said Tract; and WHEREAS, on April 27, 1992, the City Council approved the Final Map for Tract 5900 which consists of all lots or parcels within Tract 4978; and WHEREAS, upon recordation of the Final Map for Tract 5900, the developer will have met the obligation of the Declaration of Restrictions; NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby release the developer from the developer agreement for Tract 4978.
