RECOMMENDATION: � � opt resolution and authorize Staff to accept

FINANCIAL STATEMENT: Streets within this tract are private; the City will
not incur any maintenance or sweeping costs.
Maintenance costs for the soundwall, fencing, and
landscaping along Dougherty Road and Wildwood Road are
paid by Maintenance Assessment District 1986-1 .
DESCRIPTION: In March of 1990, the City Council approved the Final
Map for Tract 6258, "Park Wood," which is Village III of the Villages at
Willow Creek. Park Wood is a 216-unit condominium development located at
Dougherty Road and Wildwood Road, which was developed by Rafanelli and Nahas.
Public improvements associated with Tract 6258 have been completed according
to the approved plans and specifications and to the satisfaction of the City
Engineer. Interior private streets, curbs, sidewalks, and drainage facilities
have also been completed.
Staff recommends that the City Council adopt the resolution accepting
improvements in Tract 6258.

RESOLUTION NO. -91
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTING IMPROVEMENTS IN TRACT 6258
VILLAGE III "PARK WOOD"
WHEREAS, the owner-subdivider of the aforesaid Tract previously
entered into a contract with the City of Dublin to improve said Tract in
accordance with plans and specifications on file with the City Engineer, said
Tract identified as follows:
a) Subdivider: Rafanelli and Nahas
b) Tract location: Westerly of Dougherty Road; southerly of Wildwood
Road
c) Tract size: 216 apartment/condominium units
d) Resolution approving Final Map: No. 30-90
e) City streets affected: None.
WHEREAS, said improvements have been completed in accordance with
said plans and specifications, and any approved modifications thereof, to the
satisfaction of the City Engineer of the City of Dublin; and
WHEREAS, as a condition of said contract, the subdivider is
required to guarantee the improvements and to maintain the completed work for
a period of one year following acceptance of the work by the said City of
Dublin; and
WHEREAS, as the improvements are now completed, the original
performance bond security requirement can be reduced, in accordance with the
authority contained in Section 66499.7 of the Government Code of the State of
California, to an amount found necessary to guarantee maintenance of the
completed work for the aforesaid one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Tract be, and they are
hereby approved and accepted subject to the aforesaid one-year guarantee; and
2. The aforesaid original performance bond security requirement
be reduced from the amount of $294,100 to a revised security requirement in
the amount of $73,525, upon acceptance by Staff of the replacement maintenance
bond in the said amount of $73,525, as security for the aforesaid one-year
guarantee period, and the Mayor of this City Council be, and he is hereby
authorized and directed to execute said bond on behalf of the said City of
Dublin; and
3. The said original performance bond in the amount of $294,100,
posted in connection with the work involved in the construction of said Tract
be hereby released upon acceptance of said maintenance bond.
PASSED, APPROVED, AND ADOPTED this 22nd day of July, 1991.
