FINANCIAL STATEMENT:
Estimated design and construction costs
for this project is $130,000. The
entire cost of this project would be
borne by the City of Dublin as opposed
to 50% as was identified in the 1984-85
budget. The City would not incurr any
future costs associated with the
maintenance, energy or future
replacement of the signal.
DESCRIPTION: In accordance with City Council
direction, at its meeting of February 25, 1985, the city
Staff have met with the City of San Ramon Staff and worked
out the attached draft agreement for construction, and
future maintenance of the traffic signal, at the
intersection of San Ramon Road/San Ramon Valley Boulevard
and Alcosta Boulevard.
In accordance with that agreement the City of Dublin would
pay for 100% of those costs associated with the construction
of the signal system, with the City of San Ramon paying
maintenance and energy costs along with all future signal
replacement costs.
It is recommended that the City Council authorize the Mayor
to execute the attached agreement and further authorize the
City Engineer to commence design of this project.

AGREEMENT FOR THE INSTALLATION AND MAINTENANCE OF A TRAFFIC
SIGNAL SYSTEM AT THE INTERSECTION OF SAN RAMON ROAD/
SAN RAMON VALLEY BOULEVARD AND ALCOSTA BOULEVARD
THIS AGREEMENT is made and entered into this day
of , 1985, by and between the City of Dublin, a
municipal corporation, hereinafter referred to as "Dublin" and
the City of San Ramon, a municipal corporation, hereinafter
referred to as "San Ramon"
WI TNE S SETH:
WHEREAS, since the intersection of San Ramon Road/San
Ramon Valley Boulevard with Alcosta Boulevard is partially within
both Cities;
WHEREAS, a traffic signal system is warranted at that
intersection;
NOW, THEREFORE, based on the foregoing
understandings, Dublin and San Ramon agree as follows:

1. Traffic signal parameters.
a. Signal equipment shall be placed in its ultimate
locations as much as possible given the existing conditions and
right-of-way.
b. A raised traffic island is to be provided only for
protection of signal poles or for pedestrian refuge. Left turn
bays shall be striped.
c. Signs shall be reflectorized on aluminium blanks.
d. Striping in San Ramon shall be thermoplastic.
e. A signal interconnect conduit and cable shall be
provided to the Cal-Trans signal at 1-680 and Alcosta Boulevard.
f. The system shall be to State standards as modified
by San Ramon standards with 8 phase capacity and the capability
to interface with the Cal-Trans signal system.
2. Responsibilities of Dublin.
a. Dublin shall be responsible for 100% of the costs
associated with the construction of the traffic signal system at
the intersection of San Ramon Road/San Ramon Valley Boulevard and
Alcosta Boulevard. Costs to be borne by Dublin include but not
be limited to: design, the contract for construction of the
traffic signal system, construction administration, and primary
project inspection. Dublin shall also be responsible for those
costs incurred by San Ramon related to plan and specification
review and on-site review of the traffic signal system.
b. In the future, should Dublin make improvements to
that portion of San Ramon Road lying within its jurisdiction,
which would require modifications to the ~raffic signal at the
intersection of San Ramon Road/San Ramon-Valley Boulevard and
Alcosta Boulevard, the cost of the signal modification would be
borne by Dublin.
3. Responsibilities of San Ramon.
a. Once the traffic signal system has been
constructed, inspected and accepted by both Dublin and San Ramon,
San Ramon shall be responsible for 100% of the future costs
associated with the traffic signal at the intersection of San
Ramon Road/San Ramon Valley Boulevard and Alcosta Boulevard.
San Ramon's costs shall include utility costs, maintenance,
signal damage repair, modification or upgrading of the signal
system and replacement of the signal at such time that
replacement is warranted.

b. In the future, should San Ramon make improvements
to that portion of San Ramon Valley Boulevard or Alcosta
Boulevard lying within its jurisdiction, which would require
modifications to the traffic signal at the intersection of San
Ramon Road/San Ramon Valley Boulevard and Alcosta Boulevard, the
cost of the signal modification would be borne by San Ramon.
4. Quality of Maintenance.
San Ramon shall, for such period of time at San Ramon
Road, San Ramon Valley Boulevard and Alcosta Boulevard continue
to be used as public streets, maintain the signal system at a
level equal to that provided to the other signal systems within
San Ramon. San Ramon agrees to maintain said signal systems in a
safe manner by use of either its own personnel and equipment or
by contracting for such maintenance.
5. Arbitration.
Any controversy or claim arising out of or relating to
this Agreement, or the breach thereof, shall be settled by
arbitration in accordance with the Rules of the American
Arbitration Association, and judgement upon the award rendered by
the arbitrator(s) may be entered in any court having jurisdiction
thereof.
6. Indemnity.
a. San Ramon shall defend, save harmless and
indemnify Dublin, its officers, agents and employees from all
liabilities and claims for any fines, penalties, or damages of
any type from any cause whatsoever arising from or connected with
the maintenance of the signal system provided for by this
agreement.
b. Dublin shall defend, save harmless and indemnify
San Ramon, its officers, agents and employees from all
liabilities and claims for any fines, penalties, or damages of
any type from any cause whatsoever arising from or connected with
the installation of the signal system provided for by this
agreement.

At its regular meeting of
February 26 the "City Council
of the City of San Ramon approved in concept the proposal to
share the construction and maintenance of the Alcosta/San Ramon
Valley Boulevard signal on the following formula; that the City
of Dublin would pay for 100% of the construction cost for signal
improvements for the four legs at Alcosta:and San Ramon Valley
Boulevard and that the City of San Ramon would pay 100% of the
cost of maintenance and utilities. ·
The approval of this formula in concept is predicated upon
the acceptance of a development plan and agreement mutually
acceptable to both cities for the construction of the signal
improvements. I would suggest that both Lee Thompson and
Marc Goto meet as soon as possible to prepare a proposed plan
and agreement for our respective City Attorneys review so that
this agreement can be finalized. ·
