SUBJECT: Agreement with Alameda County to Perform
Building Inspection Services for Those
Portions of Tract 5410 (Kaufman and
Broad of Northern California, Inc . )
Located in the Unincorporated Territory
of Alameda County

RECOMMENDATION: Approve Agreement and authorize the
Mayor to execute the Agreement .
FINANCIAL STATEMENT: The Agreement authorizes the City to
collect building permit fees which will
offset inspection costs.
DESCRIPTION: Tract 5410 is located partly in the City
of Dublin and partly in Alameda County, as indicated on the
map of the area (Exhibit 2 ) . An application to annex those
portions of the tracts in Alameda County will be submitted
to LAFCO in the near future .
Issuance of permits and inspection of the construction by
both the City of Dublin and Alameda County would be a
duplication of effort. This has been discussed with the
Alameda County Building Official and he agrees that the
project should be developed under the jurisdiction of the
City of Dublin. The developer has also requested that the
City of Dublin perform all inspections .

AGREEMENT FOR BUILDING CODE ENFORCEMENT
FOR TRACT 5410
THIS AGREEMENT is made and entered into this day
of July, 1986, by and between the CITY OF DUBLIN (hereinafter
"Dublin" ) , a municipal corporation, and the COUNTY OF ALAMEDA
(hereinafter "County" ) , a political subdivision of the State of
California, based on the following understandings :
WITNESSETH
WHEREAS, Kaufman & Broad of Northern California, Inc .
intends in the immediate future to commence construction of Tract
5410, and said Tract lies partially within the unincorporated
portion of the County of Alameda and partially within the
boundaries of the City of Dublin; and
WHEREAS, upon the completion of the construction of
said Tract and the filing of the final subdivision map therefore,
said Tract will be annexed to Dublin; and
WHEREAS, during the construction of said Tract it is
required by the ordinances of Dublin and County that regular
building inspection be conducted by the Building Official of each
agency in order that the Building, Electrical, Plumbing,
Mechanical, and Housing Codes of each agency be enforced; and
WHEREAS, the Building, Electrical, Plumbing,
Mechanical, and Housing Codes of Dublin and County are
substantially identical and building inspection by both agencies
would be a duplication of effort;
NOW, THEREFORE, based on the foregoing mutual
understandings , Dublin and County agree as follows :
1 . BUILDING INSPECTION BY DUBLIN. During the period
that Tract 5410 is being constructed, and in the unincorporated
area of the County and within the boundaries of Dublin, the
Building Official of Dublin shall provide building inspection
service to enforce compliance with the provisions of the
applicable State, County, and City ordinances and regulations set
forth on the plans for which the building permits have been
issued.
2 . COLLECTION OF FEES BY DUBLIN. All building
inspection fees required to be paid by the developers of Tract
5410 shall be paid to Dublin.
3 . INDEMNIFICATION BY DUBLIN. Dublin shall assume
liability and pay all costs of defense, including legal fees and
court costs or expenses caused by any negligent or wrongful acts,
errors or omissions of Dublin ' s Building Official and his
employees, agents and subcontractors which may occur in the
performance of the terms, duties and obligations of this
Agreement.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement in duplicate at Dublin, California, the day and
year first above written.
