RECOMMENDATION Authorize the Mayor to execute the agreement
FINANCIAL STATEMENT: Cost to develop plan - $2 , 000. Sufficient funds are
budgeted.
DESCRIPTION The City is responsible for the health, safety and
welfare of the residents during a disaster. The State has recently changed
the format required in disaster plans. The City is required to have an
approved plan in place by October 1986.
The City currently uses the plans developed by Alameda County . However, as
the organizational structure has changed , it is important to have a plan
which reflects existing responsibilities . The County workload is such that
a plan would not be developed in the time frame allowed by law. The new
State format requires each responsible agency to assess potential hazards .
The response plan must then designate potential responses to each hazard by
key areas of responsibility. For example , Fire , Law Enforcement , Care &
Shelter, etc . This is shown in the attached outline under the heading of
"Functional Annexes" . It should also be noted that an approved plan is a
prerequisite to any application for grant funds related to the provision of
emergency services .
Representatives of the City Staff , Dublin Police Services and DSRSD Fire
Department have met with Mr. Robert Nickelson of Disaster Consultants , Inc .
The use of an outside consultant will allow for the coordination of
information related to this project . Mr. Nickelson is familiar with the
State of California Office of Emergency Services requirements for approval .
Also , the use of contract services and provision of safety services by more
than one entity make the City of Dublin' s situation unique . The plan must
reflect these differences in order to be useful upon completion. The Fire
Department representative has indicated their willingness to cooperate with
the development of the City' s plan. This process will also require some
Staff time of the City' s contractors and in-house staff . Although DCI will
be preparing the plan, the provision of the necessary information does
require resources .
Given the ability to obtain contract services for the development of a plan
in a cost effective manner, Staff recommends that the City Council authorize
the Mayor to execute the proposed agreement .

AGREEMENT
FOR DISASTER PREPAREDNESS SERVICES
This agreement , made and entered into by and between the City of
Dublin hereinafter referred to as "CITY" and Disaster
Consultants , Inc . , a California corporation hereinafter referred
to as "DCI" .
WHEREAS , the City desires to obtain the services of DCI to assist
in the field of emergency and disaster preparedness planning.
WHEREAS , DCI desires to aid the City by performing such services
(hereinafter sometimes referred to as "Services" ) in the capacity
of an independent contractor and not as an employee of the City;
NOW, THEREFORE, in consideration of the premises and mutual
covenants of the parties , it is agreed as follows :
SECTION I . STATEMENT OF SERVICES
A. DCI shall provide services as outlined in the proposal
dated December 17 , 1985 (Exhibit A) attached hereto and a part of
this agreement . The overall intent is to have an approved
Multihazard Functional Disaster Response Plan completed by
October 1 , 1986.
B. . DCI shall consolidate information provided by the City,
its contractors , and various public and private agencies into an
acceptable format as defined by the State of California Office of
Emergency Services Multihazard Functional Planning Guide ( 1985 ) •
C . DCI agrees that they will periodically during the term of
this Agreement , keep City advised as to DCI ' s progress in
performing the services hereunder, and that DCI will , as
requested by the City Manager or his/her designee , prepare
written reports within 20 days of City ' s request therefor.
SECTION II . TERM
A. The term of this agreement shall be for one year
beginning February 10, 1986 and ending February 9, 1987. The
agreement may be terminated by either party provided that written
notice of not less than thirty days is provided to the other
party. Notices shall be addressed as follows :

B. This agreement may be renewed on an annual basis provided
that both parties agree to the extension. Following the first
year of the agreement , the scope of services and fees shall be as
outlined in Exhibit A. Any modification to the agreement shall
be in writing.
SECTION III . COMPENSATION
A. City agrees to pay DCI , as consideration for services
rendered according to the following schedule :
FIRST YEAR OF AGREEMENT
$1 , 000 paid after agreement is executed
$1 , 000 paid on completion of Multihazard Functional
Plan for City of Dublin, as approved by
Regional Office , Governor' s Office of Emer-
gency Services
SECOND AND SUBSEQUENT YEARS
$1 , 000 paid annually upon renewal of contract
SECTION IV. NONDELEGATION OF DUTIES
A. DCI shall not delegate , subcontract , or transfer the
completion of its duties pertaining to this agreement without the
prior written consent of City except as provided in Exhibit A.
SECTION V. OWNERSHIP OF MATERIALS
A. The originals of any and all notes , records and drawings
made or kept by DCI in connection with the services performed
under this agreement shall be and are the exclusive property of
the City.
B. DCI agrees that upon the termination of this agreement ,
DCI shall be authorized to retain copies of any of the materials .
Said copies shall be prepared at DCI ' s expense .
SECTION VI . INSURANCE AND INDEMNIFICATION
A. It is understood and agreed that DCI , in the performance
.of this contract , is an independent contractor and not an
employee of the City.
B. DCI further agrees to assume all hazards and risks which
DCI may incur in the course of performing the outlined services
and agrees to indemnify and hold the City of Dublin harmless and
release the City, its officers , employees , agents and
participants , from any and all liability for any injury arising
out of, or in any way connected with performance of the services .

C . Both parties recognize that in the event of a disaster it
is impossible to predict human behavior.
SECTION VII . SEVERABILITY
A. If any provision of this agreement is found illegal by a
court of competent jurisdiction, the remaining portion thereof
will remain valid and effective for the term.
IN WITNESS WHEREOF, the parties have executed this agreement as
of this 10th day of February, 1986.

PROPOSAL
Disaster Consultants, Inc. does hereby propose that the City of Dublin use
their services for the following:
A. Development and Completion of the Multihazard Functional Plan for
the city as mandated by the State of California under the Emergency
Services Act, Section 8568.
B. Provide scenario, planning sessions, observers and monitors for
a scheduled exercise in response after the City Multihazard Funct-
ional Plan has been approved by the Regional Office, Governor's
Office of Emergency Services.
C. Ongoing consultation services, which include revisions in plan
when necessary and assistance in application for Federal Financial
Assistance when needed in a declared disaster.
D. Consultation services to provide total community disaster prepared-
ness planning involving business, industry, volunteer groups, and
.other governmental agencies.
Time Frame For Completion of Multihazard Functional Plan; assuming the City
approves of the proposal during January, 1986:
February, 1986 - Required City Resolution Action, Appointing a City
Emergency Council and Director of Emergency Services
(usually the City Manager, Mayor or an assistant),
requiring one meeting with the City Council.
Review and Clarification of existing Contracts for
Fire, Water, Sewer, Public Works, Building Inspection,
Engineering and County Sheriff; requiring a meeting
with the designated representative by our consultant.
Completion of Matrix of Emergency Management.
March/April" - Preparation of Draft of the Basic Plan, Annex A and
Response Plan for Annex A. Presentation to the City
Director of Emergency Services for approval to for-
ward to the State Office for approval.
May-July, 1986 - Completion of Draft for Annexes B thru K and their
appropriate Response Plans and submitted to the
City Director of Emergency Services and after appr-
oval, forwarded to the State Office for approval.

September, 1986- Prepare and Publish the City of Dublin Multi-
hazard Functional Plan. Finalize distribution
procedures.
October, 1986 - Plan for exercise of response teams in a planned
scenario of disaster.
To provide the Services as outlined on Page 1, subparagraphs A thru D, our
firm would require a a contract with the City of Dublin, approving our fees
for the First Calendar Year for all services described at a total of:
$ 29000.00, one-half or $ 1,000.00 payable on signing of contract
and balance payable immediately on completion of the Multihazard
Functional Plan for the City of Dublin as approved by the Region-
al Office, Governdr's Office of Emergency Services.
Disaster Consultants, Inc. is agreeable to enter into an annual renewable
contract to render services as described on Page 1, subparagraphs B thru
D for a fee of $ 1000.00 paid annually upon renewal of service contract.
Although the prime consultant would be the undersigned, there will be a
need for the services of a fire expert and law enforcement consultant on
our staff to be involved.

SUBJECT: Preparation of Dublin Hazard Response Plan
This is in response to your letter dated April 19, 1985, subject as above.
Alameda County Office of Emergency Services currently performs emergency
management administration on a contract basis with seven cities of the county.
Annual cost to client cities is approximately Four Thousand Five Hundred Dollars
($4,500) . By resolution of the Board of Supervisors, the amount paid by client
cities is reviewed and recomputed each year.
To formulate a multi-year emergency management development plan involving city
service chiefs and personnel of this office is estimated to require a minimum
of four years for coordination, review and completion.
Attached is a proposed City Emergency management ,Mork Plan for the years 1036
through 1989.
