DESCRIPTION: The original dedication from Jim Geldermann on Tract
4978 dedicated Sierra Lane (east of Dougherty Road) to the City of Dublin as a fee
right-of-way.
When the City Council recently approved the Final Map for Tract 5900, the Sierra
Lane right-of-way was intentionally not shown and was thereby abandoned as a public
street. Since the original dedication was a fee dedication instead of just a street
right-of-way dedication, the City still has some land rights on the old street.
This quitclaim action will transfer the City's rights back to the developer, BJ
Dublin Commercial, as intended. The City no longer has a need for the Sierra Lane
right-of-way as it has been replaced by the Dublin Boulevard Extension.
Staff recommends that the City Council adopt the resolution.

RESOLUTION NO. -92
A RESOLUTION OF THE CITY COUNCIL
OF THE GITY OF DUBLIN
APPROVING QUITCLAIM DEED FOR
FEE TITLE FOR SIERRA LANE WITHIN TRACT 5900
TO BJ DUBLIN COMMERCIAL
WHEREAS, the Final Map for Tract 4978 dedicated Sierra Lane as a fee
right-of-way to the City of Dublin; and
WHEREAS, the City Council approved and accepted said fee dedication of
Sierra Lane on May 29, 1984; and
WHEREAS, the City Council approved the Final Map for Tract 5900 on
April 27, 1992, and thereby approved abandonment of said Sierra Lane right-of-way as
a public street; and
WHEREAS, the City no longer requires said property for any purpose;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin does hereby approves quitclaim of fee title to said Sierra Lane within Tract
5900 to the property owner, BJ Dublin Commercial.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the
quitclaim deed.
PASSED, APPROVED, AND ADOPTED this 8th day of June, 1992.

does hereby remise, release and forever quitclaim to
B. J- DUBLIN COMMERCIAL, A CALIFORNIA LIMITED pARTNERSHIP
all right, title and interest in and to all that real property situate in the City of
Dublin, County of Alameda, State of california, described as follows:
ALL THOSE PORTIONS OF SIERRA LANE AND DOUGHERTY ROAD SHOWN ON THE MAP OF TRACT
4978, FILED JUNE 5, 1984, IN BOOK 145 OF MAPS, PAGE 3, ALAMEDA COUNTY RECORDS,
WHICH LIE WITHIN THE BOUNDARIES OF SAID TRACT 4978.
THE INTENT OF THIS DEED IT TO RELINQUISH AND VEST IN THE GRANTEE ALL RIGHT,
TITLE AND INTEREST OF GRANTOR IN THE SUBJECT REAL PROPERTY ACQUIRED PURSUANT
TO THAT DEDICATION IN FEE SIMPLE OF THE SUBJECT LAND EVIDENCED ON SUCH TRACT
4978. THIS DEED SHALL NOT BE CONSTRUED AS EXTINGUISHING OR RELEASING ANY
RIGHT, TITLE OR INTEREST GRANTOR MAY SUBSEQUENTLY ACQUIRE IN THE SUBJECT LAND,
INCLUDING BUT NOT LIMITED TO PROPOSED DOUGHERTY ROAD WIDENING DELINEATED ON
TRACT 5900, RECORDED CONCURRENTLY HEREWITH.
