DESCRIPTION At its meeting of October 10 , 1983 , the City Council
introduced a curfew ordinance which prohibits
loitering of minors under the age of 18 years between
the hours of 10 : 00 p.m. and daylight immediately
following. Since that meeting, Staff has noticed the
curfew ordinance in a local newspaper.
It is recommended that the City Council receive public
testimony and consider the desirability of
implementing a curfew ordinance in the City of Dublin.

AN ORDINANCE OF THE CITY OF DUBLIN
ESTABLISHING A CURFEW
THE CITY COUNCIL OF THE CITY OF DUBLIN DOES ORDAIN AS FOLLOWS :
Section 1 . PROHIBITED CONDUCT
It is unlawful for any minor under the age of eighteen
( 18 ) years to loiter, idle, wander, stroll or play in or upon the public
streets, highways, roads, alleys, parks, playgrounds, or other public
grounds , public places and public buildings, places of amusement and eating
places, vacant lots or any unsupervised place between the hours of 10 : 00 p.m.
and daylight immediately following.
Section 2 . EXCEPTIONS
The provisions of Section 1 do not apply when the minor
is accompanied by his or her parents, guardian or other adult person having
the care and custody of the minor, or when the minor is upon an errand
directed by his or her parent or guardian or other adult person having the
care and custody of the minor or when the minor is en route to or returning
directly home from a meeting, entertainment, recreational activity, dance or
on the way to or from employment.
Section 3 . VIOLATION OF THIS ORDINANCE
Each violation of this Ordinance shall constitute a
separate offense; and, persons violating this Ordinance shall be deemed
guilty of a misdemeanor, and upon conviction, shall be punished by a fine not
to exceed $500 . 00 or by imprisonment in the county jail for a period not
exceeding thirty ( 30 ) days , or both such fine and imprisonment.
Section 4 . POSTING OF ORDINANCE
The City Clerk of the City of Dublin shall cause this
Ordinance to be posted in at least three ( 3 ) public places in the City of
Dublin in accordance with Section 36933 of the Government Code of the State
of California.
