DESCRIPTION:
Robert Jean Art Company is requesting the City Council to
consider allowing businesses located within the City of Dublin to
display and sell merchandise outdoors on the first weekend (Friday,
Saturday and Sunday) of the months of April through October subject to
approval of a special permit. The Applicant emphasizes the businesses
would need to be located within the City of Dublin, but does not
address whether the outdoor sales would be restricted to the business
site or whether the outdoor sales would occur off-site.
The Dublin Zoning Ordinance requires all principal uses within
the commercial districts to be conducted indoors, with the exception
of automobile and recreation vehicle storage and rental lots, plant
nursery (plant materials only) , and auto sales and service agency
which may occur outdoors subject to Conditional Use Permit approval .
The Zoning Ordinance does not allow outdoor display and sale of
merchandize. As a special event, the City Council did permit
merchants to conduct outdoor sidewalk sales during the City-sponsored
St. Patrick' s Day celebration.
In past years, the City Council has received requests to allow
outdoor brass sales, hot dog carts and fruit and vegetable stands . In
each case, the City Council has denied the request. When the Police,
Zoning Investigator or Building Inspector witness the outdoor display
and/or sale of merchandize (past situations include the sale of jeans,
sunglasses, and garden decorations) , the individuals selling the
merchandize are typically given a Warning Notice and are required to
cease the operation.

Dear Ms. Keck:
Based on advice from your office, I am writing you' ,this letter to request
that I be allowed to address the 'City Council at their next available meeting
date' in order to discuss a variance to the city code regarding the outside
display and sale of local business-' merchandise.
As. you are aware, other surrounding cities allow their local merchants (Note:
Said. permit would only be given to businesses that are located in the City
of Dublin), based on-a special permit, to hold sidewalk and/or parking .lot
sales: During these economic times it would be: _(1) a great benefit to
the City, of 'Dublin (i.e., additional- revenue from special- permits), (2)
to the local businesses as said sales would generate much needed, cash during
these recessionary times, and .(3) for the Dublin citizen as such sales
normally carry much lower prices, something we all can`use.
As you know, such outdoor sales are limited by weather conditions. .
Therefore, I would also suggest that only for Friday, . Saturday,and Sunday,
of the first week of the months from April through October, that the special
permit be approved.
Upon talking with other local businesses, I feel that they would also like
such a variance.. I look forward . to being able to be part of the City
Council's next earliest agenda to discuss . this request in detail. .Thanking
