DESCRIPTION ADMINISTRATION OF CAMP PARKS AREA - Dublin San Ramon
Services District currently is the agency responsible for the provision of
trash service in the Camp Parks area. The Board of Directors has voted to
request that the City of Dublin exercise its option with Oakland Scavenger
Company to service this area, . on behalf of the District.
DSRSD is the legal entity having jurisdiction for the adoption of
legislation affecting the area in question. The City of Dublin cannot
impose its ordinances on territory which is not within its corporate limits .
However, the Government Code allows a responsible agency to contract with
another public agency for the provision of refuse collection and disposal
services . Staff would propose that in order to have continuity the District
should be required to adopt an ordinance which is materially the same as the
City ' s . It may be possible for DSRSD to adopt the City' s ordinance by
reference .
Some inconsistencies currently exist and would have to be addressed if the
City is responsible for administering the refuse franchise . First, the
County Jail facility has made arrangements to haul their own refuse for
security purposes . The current DSRSD ordinance and the City ' s ordinance
only allow a single residential property owner to haul refuse from their
property. Therefore, it would be recommended that the ordinance adopted by
DSRSD contain language which allowed removal by public agencies operating a
jail or correctional facility. The ordinance would limit removal to solid
waste generated by that facility. The City' s ordinance would need to be
amended prior to the completion of the annexation. Oakland Scavenger and
District representatives have indicated that this arrangement corresponds
with the way this is now being handled.
The City Council should also be aware that portions of the Camp Parks area
are now being serviced in violation of the existing franchise . DSRSD Legal
Counsel has formally noticed the Army and requested that they initiate steps
to have service provided by Oakland Scavenger Company. Portions of Camp
Parks are receiving service from Pleasanton Garbage Service . This has two
impacts on the City of Dublin if the City elects to administer refuse
service to Camp Parks .

The hauling by Pleasanton Garbage Service results in the loss of franchise
fees . The representatives of Oakland Scavenger Company estimate that a
total annual cost of the services to this area is approximately $38, 975 .
They are only servicing approximately $8, 328 of the estimated accounts for
this area. These estimates are based on current rates which do not reflect
the rate structure implemented by the City Council for the existing City
franchise . A rough estimate of the potential annual franchise fees for this
area is $1, 690, if all of the estimated accounts are serviced. If only the
current accounts are maintained, the City would receive an estimated $400 .
The second impact would be the resources required to be expended in order to
enforce provisions of the ordinance . It is important to note that these
efforts would be required now if the City had completed the annexation and
was responsible for these services . The primary efforts would be legal
counsel . DSRSD has begun the process and they are awaiting a response from
the U.S . Army . Staff recommends that the City Council proceed with the
administration of these services despite the drawbacks which have been
noted. The City anticipates that it will complete the annexation of the
entire area in question and a consistent method of providing services in the
entire area which may become part of the City of Dublin, is desirable .
FREE TRASH SERVICE - The DSRSD Board of Directors has also requested that
the City continue to provide trash service to District facilities at no
charge . This provision is included in the City' s agreement with Oakland
Scavenger Company, however, the inclusion of District facilities is at the
discretion of the City.
The provision of these services is included as an operating expense for
rate-setting purposes . This results in these costs being spread across the
entire rate base and they are not paid through the operators profit. The
City will be receiving service at no cost at the City Corporation Yard and
Shannon Center .
DSRSD has service at the following locations : District Offices , Dublin
Sports Grounds , Community Swim Center, and Fire Station #1 . If the rates,
as adopted by the City Council , were paid for these services , the annual
cost to the District is estimated at $1, 350 .
Staff recommends that the City Council approve and authorize the Mayor to
execute the agreement for the City to Administer Refuse services in Dublin
San Ramon Services District territory. The City Council should also
authorize the City Manager to execute an extension of Oakland Scavenger
Company services to the area covered by the agreement between the City and
Dublin San Ramon Services District . Staff requests that the City Council
consider the continued service to District facilities at no charge and
direct a response as is deemed appropriate .

Dear Council Members :
The City 's Request for Proposals for Refuse Service
included a provision for our District to receive free
refuse service within the District 's boundaries in the
City of Dublin . The City ' s RFP also contained an alter-
nate for the City to assume our District 's refuse service
responsibility for the Camp Parks area .
On March 18 , our Board of Directors voted to request
that the City implement both these alternates , effective
April 1 , 1986. Continued free refuse service to the
District ' s Dublin facilities will benefit all of the
District 's residents, and the City 's administration of
refuse service to the Camp Parks area will negate the
District 's need to continue as an active participant in
refuse collection and disposal .

AN AGR_EEMENT BETWEEN
THE CITY OF DUBLIN . AND THE DUBLIN SAN RAMON SERVICES DISTRICT
TO ADMINISTER REFUSE COLLECTION AND DISPOSAL SERVICES
WHEREAS , the Dublin San Ramon Services District is the agency
responsible for the refuse- collection franchise covering Camp Parks
Reserve Forces Training Area and surroundings ; and
WHEREAS, the City of Dublin has submitted an application for annexation
of the subject area to the Alameda County .Local Agency Formation
Commission (LAFCO) ; and
WHEREAS, the Camp Parks refuse contractor also provides services under
an exclusive franchise for customers within the City Limits of the City
of Dublin; and
WHEREAS, a consolidated administration of the provision of refuse
collection services is the most efficient method of providing service;
and
WHEREAS, Section 66756 (b) of the Government Code authorizes the
furnishing of services by another local agency .
NOW, THEREFORE, BE IT RESOLVED that the Dublin San Ramon Services
District, hereinafter DISTRICT -and the City of Dublin, hereinafter
CITY, do agree as follows :
I . Area Serviced
The area to be serviced shall include any property within the
jurisdiction of the District, which is within Alameda County and is not
within the corporate limits of the City.
II . Jurisdiction
The District shall consider adoption of ordinances which are consistent
with the Solid Waste Management Ordinance of the City and as otherwise
may be requested by the City . The City shall arrange for the provision
of collection services with Oakland Scavenger Company . The terms of
said agreement shall be the same as those contained in the City' s
agreement with Oakland Scavenger . This shall include the establishment
of rates and fees .
III . Scope of Agreement
The District shall assign to the City all rights of administering the
contract for the collection and disposal of solid waste in the area
defined in Section I . The City shall represent the District at the
Joint Refuse Rate Review Committee and shall administer all aspects of
the franchise process for the term of this agreement . The District

shall designate all duties of Director as defined in adopted ordinances
to the City representative. The City shall apply all rates , fees, and
charges pursuant to this agreement, in a manner which is consistent
with those enacted for the City .
IV. Consideration
In consideration of the time and effort involved with the
administration, the City shall retain all franchise fees collected
pursuant to the agreement . The District may be requested to adopt
specific documents which will assist with the administration by the
City.
V. Term
This agreement shall terminate at such time as the area described in
Section I is formally included within the City Limits of the City of
Dublin, at which time the City ' s franchise agreement would have
jurisdiction over the provision of garbage service.
VI . Indemnification
City shall assume liability and pay all costs of defense, including
legal fees and court costs , and hold the District harmless from loss ,
damages, costs or expenses caused by any negligent or wrongful acts ,
errors, or omissions of City ' s employees, agents and subcontractors
which may occur in the performance of the terms , duties and obligations
of this Agreement .
District shall assume liability and pay all costs of defense, including
legal fees and court costs , and hold City harmless from loss, damages ,
costs or expenses caused by any negligent or wrongful acts , errors , or
omission of District ' s employees , agents and subcontractors which may
occur in the performance of the terms , duties and obligations of this
Agreement.
