DESCRIPTION At its meeting of September 12 , 1983 , the City Council
directed Staff to notice a public hearing for its
meeting of October 10 , 1983 for consideration of a
noise ordinance .
The City Attorney has prepared a draft ordinance for
City Council consideration.
It is recommended that the City Council receive public
testimony and consider the appropriateness of
implementing a noise ordinance in the City of Dublin.

AN ORDINANCE OF THE CITY OF DUBLIN
REGULATING THE OPERATION OF
CERTAIN SOUND-MAKING DEVICES
DURING NIGHTTIME HOURS
THE CITY COUNCIL OF THE CITY OF DUBLIN DOES ORDAIN AS FOLLOWS :
Section 1 . PROHIBITED CONDUCT
It is unlawful for a person within a resi-
dential .zone of the town to use or operate a radio receiving
set, musical instrument, phonograph, television set, or other
machine or device for the producing or reproducing of sound
(between the hours of 10 :00 p.m. of one day and 8 : 00 a.m. of
the following day) in such a manner as to disturb the peace ,
quiet and comfort of neighboring residents or of a reasonable
person of normal sensitiveness residing in the area .
Section 2 . VIOLATION OF THIS ORDINANCE
Persons Violating this Ordinance shall be
deemed guilty of a misdemeanor, and upon conviction, shall be
punished by a fine not to exceed $500 .00 or by imprisonment
in the county jail for a period not exceeding thirty ( 30) 'days,
or both such fine and imprisonment.
Section 3 . IMMEDIATE EFFECT
This Ordinance is necessary for the preserva-
tion of the public peace , health .and welfare and shall take
effect immediately .
Section 4 . POSTING OF ORDINANCE
The City Clerk of the City of Dublin shall
cause this Ordinance to be posted in at least three (.3) public
places in the City of Dublin in accordance with Section 36933
of the Government Code of the State of California.

Dublin on this 10th day of October, 1983 , by the following votes :
