HomeMy WebLinkAbout5.7 Accept Tract 4569 F A AGENDA STATEMENT CITY COUNCIL MEETING DATE: November 12 , 1985 SUBJECT: Acceptance of work - Tract 4569 EXHIBITS ATTACHED: Resolution, location map RECOMMENDATION: 1 ) Adopt resolution to accept the work completed in Tract 4569 . 2 ) Authorize continuance of a letter of credit in the amount of $172 ,000 in connection with the guarantee of work performed in Tract 4569 . FINANCIAL STATEMENT: The original letter of credit for $172, 000 will be in force for 14 months after acceptance to guarantee repair of any defects . No immediate maintenance costs to the City other than street lights and sweeping. DESCRIPTION: All work in connection with the subject tract has been completed in accordance with the terms of the subdivision contract, and acceptance of the work is now in order . The original approvals were performed under the jurisdiction of the County of Alameda . Pertinent information concerning the tract is as follows : A) Subdivider : Blackwell Homes B) Tract location: Adjacent to and southerly of Shannon Ave. , east of Peppertree Road. C) Tract size: 17 lots D) Resolution approving Final Map: No. 190831 , Alameda Co. Board of Supervisors E) City streets affected: Shannon Court ( formerly Denise Court ) At the time the County and the subdivider executed the contract for the Tract improvements , the subdivider was required to post a letter of credit in the amount of $172 , 000 to provide the necessary security for the performance of the work involved. Under this agreement, the letter of credit is to remain in force until fourteen months after acceptance of the improvements to guarantee maintenance of this work . The subdivider has not requested a reduction of this security. ----------------------------------------------------------------- ITEM NO. 5 COPIES TO: Blackwell Homes RESOLUTION NO. 125-85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ------------------------------------------------------------------ FOR THE ACCEPTANCE OF IMPROVEMENTS TRACT 4569 WHEREAS, the owner-subdivider of the aforesaid tract previously entered into a contract with the County of Alameda to improve the said tract in accordance with plans and specifications on file with the Director of Public Works in the said County of Alameda, said tract identified as follows : a ) Subdivider : Blackwell Homes b) Tract location: Adjacent to and southerly of Shannon Ave. , east of Peppertree Road. C) Tract size: 17 lots d) Resolution approving Final Map: No. 190831 , Alameda County Board of Supervisors. e ) City streets affected: Shannon Court WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of 14 months following acceptance of the work by the said City of Dublin; and WHEREAS, as the tract work is now completed, the original letter of credit security requirement can be reduced, in accordance with the authority contained in Section 66499 . 7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid maintenance period. The subdivider has not requested a reduction. NOW, THEREFORE, BE IT RESOLVED that : 1 . The improvements completed within the said tract be and they are hereby approved and accepted subject to the aforesaid 14 month guarantee ; and 2 . The aforesaid original letter of credit security requirement is to remain in force for a period of 14 months upon acceptance of improvements to guarantee repair of any defects and is hereby accepted as security for the maintenance period. PASSED, APPROVED AND ADOPTED this 12 th day of November 1985 .
