050 BJ Dublin Commercial.

DESCRIPTION:
At the March 4, 1997 City Council meeting, the City Council adopted a resolution approving the Negative
Declaration, Planned Development (PD) District Rezone, and Tentative Parcel Map for the BJ Dublin
Commercial project, and introduced the ordinance approving the PD District Rezone.
The PD District Rezone ordinance would allow the rezone of an approximate 7.5 acre site, which includes
two City of Dublin remnant parcels, to a PD District, permitting uses from the C-2, General Commercial
District and P A 96-050 BJ Dublin Commercial. This PD District rezone would revise the existing PD
District zoning (P A 93-052 BJ Dublin Commercial) with the incorporation of alternate on-site circulation
patterns, building configurations, building square footage, lot coverage, landscaping and sign plans. This
PD District Rezone would also allow a hotel/motel use, research and development use and commercial
amusement/recreation facility (indoor) use as permitted uses.
The BJ Dublin Commercial PD District Rezone is consistent with the Dublin General Plan's policies
regarding Retail/Office and Automotive use. The PD District Rezone contains adequate development
standards that will serve as a base and framework for processing future development projects at the BJ
Dublin Commercial site.
Staff recommends that the City Council waive the second reading and adopt the ordinance rezoning the
site to Planned Development (PD) District, P A 96-050 BJ Dublin Commercial.

AN ORDINANCE OF THE CITY OF DUBLIN AMENDING THE ZONING
ORDINANCE TO PERMIT THE REZONING OF PROPERTY LOCATED AT THE
NORTHEAST CORNER OF DUBLIN BOULEVARD AND
DOUGHERTY ROAD (APNS: 941-550-52 through 60, 941-550-10~18 and 12-9)

The City Council of the City of Dublin does ordain as follows:
Section 1
Chapter 2 of Title 8 of the Dublin Ordinance Code is hereby amended in the following
manner:

Approximately 7.5 acres generally located on the east side of Dougherty Road and on the
north side of Dublin Boulevard, more specifically described as Assessor's Parcel Numbers 941-
550-52 through 60,941-550-10-18 and 12-9, are hereby rezoned from a Planned Development
(PD) District permitting uses from the C-2, General Commercial District and PA 93-052 BJ
Dublin Commercial, to a Planned Development (PD) District, permitting uses from the C-2,
General Commercial District and P A 96-050 BJ Dublin Commercial, as shown on Exhibit 1
(project plans), Exhibit 2 (Negative Declaration Resolution), Exhibit 3 (Findings and General
Provisions Resolution), and Exhibit 4 (Tentative Parcel Map Resolution), exhibits to the City
Council Staff Report dated March 4, 1997, on file with the City of Dublin Department of
Community Development, and hereby adopted as the regulations for the future use,
improvement, and maintenance of the property within this District.

This ordinance shall take effect and be enforced thirty (30) days from and after its
passage. Before the expiration of fifteen (15) days after its passage, it shall be published once,
with the names ofthe Councilmembers voting for and against same, in a local newspaper
published in Alameda County and available in the City of Dublin.
