On June 10, 1991, the City Council initiated a General Plan Amendment Study and a Rezone Study for the existing DRFA Fire Station #1 site at 7494 Donohue Drive. On August 5, 1991, the Planning Commission adopted Resolution No. 91- 032 recommending the City Council adopt the DRFA General Plan Amendment, Resolution No. 91-033, recommending the City Council approve the DRFA rezone request, and Resolution No. 91-034 recommending the City Council approve the DRFA Conditional Use Permit request. On August 21, 1991, the Planning Director approved PA 91-044 Whitney Investment Company Site Development Review application for the construction of two new buildings, totalling 4, 801 square feet, on a 42 , 791 square foot portion of the existing 56 ,478 square foot site, located at 7601-7603 Amador Valley Boulevard. The approved development plan will result in a 13, 687 square foot portion of the parcel remaining undeveloped. This vacant portion of the site is being acquired by DRFA. A lot line adjustment is currently being processed to add the contiguous 13, 687 square foot vacant portion of the parcel located at 7601 Amador Valley Boulevard to the existing 15, 000 square foot DRFA Fire Station #1 parcel located to 7494 Donohue Drive. This will provide an approximate . 658 acre building site to accommodate the proposed reconstruction of DRFA Fire Station #1 . -2- i S Analysis The Applicant, DRFA Fire Chief Harold Ritter, also representing Robert Glockner of Whitney Investment Company, is requesting approval : 1) to amend the General Plan to designate the land use of the existing DRFA Fire Station #1 site at 7494 Donohue Drive from Public/Semi-Public Facility to Retail/Office; 2 ) to rezone the combined parcels at 7494 Donohue Drive ( from R-S-D-20, Suburban Residential Combining District to C-1, Retail Business District) and 7601 Amador Valley Boulevard (portion) ( from PD, Planned Development to C-1, Retail Business District) ; and 3) of a Conditional Use Permit to allow the establishment of a community facility, a fire station, on the combined parcels within the C-1 District. General Plan Amendment The existing DRFA Fire Station #1 site has a General Plan land use designation of Public/Semi-Public Facility. The General Plan land use designation for the proposed acquisition site is Retail/Office. The Applicant is requesting to amend the General Plan to designate the existing DRFA Fire Station #1 site as a Retail/Office land use. This will provide a consistent General Plan land use designation for the combined parcels . Uses permitted within the Retail/Office General Plan land use designation include retail shops, business and professional offices, and service stations . The fire station use will include primarily office activities, with minor maintenance of the emergency vehicles occurring on-site. The nature and intensity of the fire station use is consistent with that normally found within the Retail/Office land use designation. The proposed General Plan Amendment is consistent with other small public facilities in Dublin which are located on parcels with General Plan land use designations other than Public/Semi-Public Facilities . Some of these include: Dublin San Ramon Services District, Retail/Office land use designation; Senior Center, Single Family Residential land use designation; and the City Corporation Yard, Business Park/Industrial : Outdoor Storage land use designation. Staff and the Planning Commission recommend approval of the proposed General Plan Amendment. Rezone The existing DRFA Fire Station #1 site is zoned R-S-D-20, Suburban Residential Combining District. The proposed acquisition site is zoned PD, Planned Development. The Applicant is requesting approval to rezone both sites to the C-1 Retail Business District in order to prevent a split zoned parcel . State Law requires consistency between the General Plan and the Zoning Ordinance. The proposed rezone will be consistent with the General Plan. -3- a The C-1, Retail Business District has been established within the Zoning Ordinance to implement the policies of the Retail/Office General Plan land use designation. The establishment of community facilities (a fire station) are allowed within the C-1, Retail Business District subject to the approval of a Conditional Use Permit. State law requires two public hearings for an ordinance change. Staff and the Planning Commission recommend that the Rezone Ordinance be introduced and continued to the City Council meeting of September 9, 1991, for the second reading and adoption. Conditional Use Permit The proposed project includes a request for approval of a Conditional Use Permit to allow the establishment of a community facility, a fire station, on the combined parcels within the C-1 Retail Business District. The proposed DRFA Fire Station #1 will contain approximately 8, 000 square feet of building area which will include: a three bay wide, two bay deep apparatus room; offices; dormitory for a minimum of eight firefighters; an above-ground 1,000 gallon fuel tank; restroom facilities ; kitchen; dayroom; exercise area; locker room; workshop; and communications area. Approximately 18 calls per week are dispatched from the existing DRFA Fire Station #1 . It is anticipated that the new fire station will accommodate this same level of activity. Staff and the Planning Commission recommend approval of the proposed Conditional Use Permit. Site Development Review approval is required prior to the rebuilding of DRFA Fire Station #1 on the combined parcels . The proposed DRFA Fire Station #1 will be built primarily on the southern portion of the combined parcels . The existing DRFA Fire Station #1 must remain operational until the new station is completed. The existing station will then be demolished to provide parking and landscaping for the new station. -4- v r RESOLUTION NO. - 91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------------------------------- ADOPTING PA 91-042 DOUGHERTY REGIONAL FIRE AUTHORITY GENERAL PLAN AMENDMENT WHEREAS, Harold Ritter, on behalf of the Dougherty Regional Fire Authority and Robert Glockner of Whitney Investment Company, submitted an application requesting approval 1) to amend the General Plan to designate the land use of the existing DRFA Fire Station #1 site at 7494 Donohue Drive from Public/Semi-Public Facility to Retail/Office; 2 ) to rezone the combined parcels at 7494 Donohue Drive ( from R-S-D-20 to C-1) and 7601 Amador Valley Boulevard (portion) ( from PD to C-1) ; and 3) of a Conditional Use Permit to allow the establishment of a community facility, a fire station, on the combined parcels at 7494 Donohue Drive and 7601 Amador Valley Boulevard (portion) ; and WHEREAS, the Planning Commission did hold a public hearing on said application on August 5, 1991 and did adopt Resolution No. 91- 032 , recommending the City Council adopt the DRFA General Plan Amendment, Resolution No. 91-033, recommending the City Council approve the DRFA Rezoning request, and Resolution No. 91-034 , recommending the City Council approve the DRFA Conditional Use Permit request; and WHEREAS, the City Council did hold a public hearing on said application on August 26 , 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and a Negative Declaration of Environmental Significance has been adopted by the Dougherty Regional Fire Authority on March 18, 1991 (DRFA Resolution No. 1-91) for this project, as it will have no significant effect on the environment; and WHEREAS, the Staff Report was submitted recommending that the application be approved; and WHEREAS, the City Council did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby approve the Dougherty Regional Fire Authority General Plan Amendment PA 91-042 to amend Figure 1 of the Dublin General Plan - Primary Planning Area map to amend the land use designation for APN 941-173-1-2 designating the existing DRFA Fire Station #1 site at 7494 Donohue Drive as Retail/Office (See Attachment A-1) ; and UH Vi , i BE IT FURTHER RESOLVED THAT THE Dublin City Council does hereby direct Staff to edit, format, and print the up-to-date Dublin General Plan with all City Council approved revisions and without any other substantive changes . The establishment of a Community Facility ( fire station) will serve the public need by providing essential emergency services to the community in a central location. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located in that conditions have been applied to ensure conformance with the applicable zoning. E. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin City Council does hereby conditionally approve PA 91-042 Conditional Use Permit, subject to approval of the related General Plan Amendment, Rezoning, and a subsequent Site Development Review application, to be submitted for review and approval per Section 8-95 . 0 of the Zoning Ordinance, and subject to the following conditions : CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval . The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval . [PL1 Planning, [B] Building, [P01 Police, [PW1 Public Works, ADM_ Administration, [FIN1 Finance, [F1 Dougherty Regional Fire Authority, [DSR1 Dublin San Ramon Services District, [C01 Alameda County Department of Environmental Health. 1 . This approval is for the establishment of a fire station facility consisting of : an apparatus room; administrative offices; dormitory for a minimum of eight firefighters; an above ground 1, 000 gallon fuel tank; restroom facilities; kitchen; dayroom; exercise area; locker room; workshop; and communications area, on the combined parcels located at 7494 Donohue Drive and 7601 Amador Valley Boulevard (portion) . Said approval shall be contingent upon the Applicant receiving approval of the related - 2 - General Plan Amendment and Rezoning requests and subsequent Site Development Review. [PL] 2 . The Applicant shall be responsible for clean-up and disposal of project related trash to maintain a clean and litter-free site. [PL] 3 . Site Development Review approval pursuant to Sections 8-48 . 4 and 8-95 . 0 of the Zoning Ordinance is required prior to issuance of a building permit. [PL] 4 . All signs shall be subject to the requirements of the Sign Regulations within the Zoning Ordinance. [PL] 5 . This use shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval . [PL] 8 . This approval shall become null and void, in the event the approved use ceases to operate for a continuous one year period. [PL] 9 . The range allows duplex, townhouse, and garden apartment development suitable for family living. Except where mixed dwelling types are designated, unit types and densities may be similar or varied. Where the plan requires mixed dwelling types, listed policies specific to the site govern the location and distribution of dwelling types. Assumed household size is two persons-per. unit. Recently reviewed projects in the medium density range include-Parkway Terrace (7.8) and Amador Lakes west of the Dougherty Hills (13.5) . Residential: Medium-High Density (14.1 to 25.0 units per gross residential acre) . Projects at the upper end of this range normally will require some under-structure parking and will have three or more living levels in order to meet zoning ordinance open space requirements. This classification includes all retail/office uses and adds auto dealerships, auto body shops, and similar uses. Residential uses are not permitted. Business Park/Industrial. Uses are non-retail businesses (research, limited manufacturing and distribution activities, and administrative offices) that do not involve heavy trucking or generate nuisances due to emissions, noise, or open uses. Residential uses are not permitted. Maximum attainable ratios of floor area to site area (FAR) are controlled by parking and landscaping requirements and typically result in .35 to .40 FAR's.
