CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: February 13, 1995 SUBJECT: Public Hearing: To Consider Adoption of a Resolution of Necessity Directing the Filing of Eminent Domain Proceedings to Acquire Real Property for the Widening of Dublin Boulevard. RECOMMENDATION: 1) 2) 3) 4) 5) Open public hearing Receive Staff presentation and public comment Question Staff and the public Close public hearing and deliberate Adopt resolution (requires 4/5 vote) FINANCIAL STATEMENT: Monies have been budgeted in this Capital Improvement Project for the purchase of right-of-way based on appraisals. Should any of these acquisitions actually go to court, the City would incur additional legal fees. DESCRIPTION: The City desires to complete the widening of the portion of Dublin Boulevard between Donlon Way and Village Parkway. In order to do so, it is necessary for the City to acquire strips of land in fee and temporary construction easements from eight parcels of property. The acquisition and construction shall be funded in major part by Federal monies under the Intermodal Surface Transportation Efficiency Act (ISTEA) program. In order to qualify for the Federal monies, the City must adopt a resolution of necessity not later than March 1, '1995. Adoption of a resolution of necessity is required by California eminent domain law as a condition precedent to the filing of an eminent domain lawsuit. The resolution of necessity basically is a finding that the project is necessary and that the property to be acquired is necessary to the project. The County of Alameda Real Property Department is acting as the City's right-of-way consultant. To date, the County has been able to acquire two parcels (See's Candies and D'Ambrosio). County Staff hopes to acquire several more parcels. However, in the event that the County is unable to acquire all of the required parcels by negotiations, it will be necessary to commence eminent domain lawsuits and obtain possession orders. Because the project involves federal funding, it is subject to both NEPA and CEQA. CEQA and its Guidelines encourage joint preparation of environmental documents for such projects, so an Environmental Assessment (EA) was prepared and reviewed by the City, Caltrans, and the Federal Highway Administration. The EA identified no significant impacts and was the basis for a Finding of No Significant Impact (FONSI) under NEPA, and a Negative Declaration under CEQA. The FHWA issued its FONSI on September 5, 1991. Under the CEQA Guidelines, the City may adopt the FONSI as a Negative Declaration. As required by statute, a noticed public review period was provided for the Environmental Assessment from July 27, 1990 to September 6, 1990. Although not required, the City also held a public hearing on August 27, 1990, to receive public comments on the EA. Because FHWA action was then needed to adopt a FONSI based on the Environmental Assessment, the City's environmental review was on hold for a time. Once the FONSI was received, the City inadvertently failed to formally adopt an environmental review document for the improvement project. Instead, project planning proceeded, and in June, 1993, the project was approved by the City Council for inclusion in the 1993-94 Capital Improvement Program (CIP). The City Council has since formally adopted a Negative Declaration and ratified the previous project approval through adoption of Resolution No. 04-95 at a noticed public hearing on January 23, 1995. A Notice of Determination was subsequently filed with the State Clearinghouse and the County Clerk. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the Resolution of Necessity. g~dbw_rw~agenda~necess Page 2 RESOLUTION NO. -95 THE CITY OF DUBLIN DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN L~ND ~RD DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS Dublln Boulevard Widening Project Assessor's Parcel Nos. 941-1500-15-5; 941-1550-1-?; .941-1500-28; 941-1550-4; 941-1500-44; 941-210-22; 941-210-34; and 941-210-23 follows: IT IS RESOLVED by the city of Dublin, California, as WHEREAS, it is desirable and necessary for the City of Dublin to acquire certain real property, particularly described in Exhibit "A", attached hereto and made a part hereof by reference, in order to widen and improve Dublin Boulevard from Dougherty; WHEREAS, the City of Dublin is vested with the power of eminent domain to acquire real property by virtue of Article 1, Section 19, of the Constitution of the State of California, Section 33391 of the Health and Safety Code of the State of California, and Sections 1240.050, 1240.110, 1240.120, 1240.125, 1240.150, 1240.240, 1240.410 and 1240.610 of the Code of civil Procedure of the State of California; and WHEREAS, pursuant to the provisions of Section 1245.235 of the Code of civil Procedure of the State of California, notice has been duly given to all persons whose property is to be acquired by eminent domain and whose names and addresses appear on the last Alameda County equalized assessment roll, all of whom have been given a reasonable opportunity to appear and be heard before the City of Dublin on the following matters: (a) Whether the public interest and necessity require the Project; (b) Whether the Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (c) Whether the property sought to be acquired is necessary for the Project; and (d) Whether the offer to purchase required by Government Code Section 7267.2 has been submitted to the owner or owners of record of the real property. The public interest and necessity require the Project which is the widening and improvement of Dublin Boulevard. 2. The Project is planned and located in the manner which will be most compatible with the greatest public good and the least private injury; 3. The offer required by Section 7267.2 of the Government Code of the State of California has been made to the owner or owners of record of the real property; 5.
