Deny request (Staff recommendation) - OR - Waive reading and INTRODUCE ordinance establishing limited parking zone on Dublin Boulevard FINANCIAL STATEMENT: The cost of installing limited parking zone signs would be approximately $200. The Street Maintenance Operating Budget contains sufficient funds to cover this cost. DESCRIPTION: Staff received a phone call and subsequently a letter from Dr. James Stalker of Stalker Chiropractic requesting a limited parking zone on the south side of Dublin Boulevard west of Golden Gate Drive. Dr. Stalker's office is on the northwest corner of the Great Western Building at 7600 Dublin Boulevard. Dr. Stalker feels that the curbside parking is logistically more convenient for his patients, in that the distance to the office from Dublin Boulevard is shorter than the distance from the parking lot at the rear of the Great Western building. Dr. Stalker contends that the available on-street parking spaces, however, are utilized by commuters who catch the bus at the transfer stop at the southeast corner of Dublin Boulevard and Golden Gate Drive. The location map, Exhibit 2, shows the relationship between the bus stop, the available parking, and the location of Dr. Stalker's office. There is approximately 130' of unrestricted curb from the existing red curb westward to the driveway of the adjacent shopping center. This distance accommodates approximately seven vehicles. Dr. Stalker stated that the property owner denied his previous request to provide reserved parking spaces for patients near the walkway that leads to the chiropractic office, but added that if on-street parking was not available at all, the request for reserved spaces in the lot might be reconsidered. Dr. Stalker has occupied this location for three years and has just signed a new ten-year lease. During the week of February 25th, Staff made the following observations regarding use of the on-street parking: At 10:00 a.m. on Monday, two cars were present; at 5:00 p.m. on Tuesday, one car was present; at 7:30 a.m. on Wednesday, no cars were present; at 6:30 p.m. on Wednesday, two cars were present; at 3:00 p.m. on Thursday, one car was present; and at 7:45 a.m. on Thursday and Friday, two construction trucks were present. This may or may not be representative; however, it appears that sufficient on-street parking is available without changing the time limits. The parking lot behind the building was observed mid-day and was found to be nearly full, with the only available spaces being toward the back of the lot. Four handicapped parking spaces which are closer to the building are available; however, it should be noted that most patients would not have the necessary license plate or placard to use the handicapped spaces. The Traffic Safety Committee considered Dr. Stalker's request on January 29th and again on February 26th and felt that the following issues were involved: (1) The Dublin Boulevard Capacity Improvements project, which is tentatively scheduled to be constructed in the Spring of 1992, will remove all on-street parking on Dublin Boulevard; therefore, any special parking zones installed at this time would only be available for about a year. (2) City Staff does not wish to encourage commuters to park in private parking lots. (3) If patients have limited mobility, it may be safer and easier to exit a vehicle parked in the parking lot than along a busy arterial street. The City could incur some liability exposure by providing a limited parking zone relative to a request of this type. Staff recommends that the City Council conduct a public hearing, deliberate, and deny the request for a limited parking zone at this location. If, however, the City Council wishes to approve the limited parking zone, a draft ordinance has been included as Exhibit 3 for consideration. -2- DR. JAMES W. Box 2340 Dublin, CA 94568 Dear Mr. Thompson: Please allow the following information to be placed on the city Council ag-enda for consideration. As I am sure you are aware, as a Chiropractor, the patients who seek my services have conditions that are quite limiting insofar as their ability to ambulate. I have had people literally carried into my office either by a friend or family member on a stretcher. This is not to say that all of the patients I attend are in such distress, as a significant portion of my practice in on a preventive/ well patient care basis. However, that percentage that does suffer significantly is the motivation for persuing the following. My office is located in the northwest corner of the Great West- ern Bank building on Dublin Blvd. I have currently been practicing in this location for three years, and for five years prior to this office, I practiced in the Stoneridge Medical Center. One of the benefits of my current location is the on street park- ing just in front of the entrance to my office. This was a signifi- cant issue in selecting this office site. Unfortunately, there is also a bus stop at the corner of Dublin Blvd and Golden Gate. Many commuters are using the curbside parking in front of my office as a parking lot. Almost daily, by the time I get to the office at around 9:00 a.m., all the spaces are filled and remain filled, by the same cars, until I leave the office around 6:30 p.m. As you are aware, this is not the only parking in the area. There is a large parking lot in the back of this building that I have yet to see completely full in my three years here. There is a large parking lot across Dublin Blvd khat once again, I have yet to see filled to capacity. I am hereby requesting that the city council approve limited parking on Dublin Blvd of a one or two hour duration to circumvent the aforementioned problem. You may have difficulty understanding just how much pain these people are in if you have never experienced an acute flare up of the neck or back, but I assure you that if my request is granted, those suffering individuals will be deeply grateful. Stal er, D.C. 7600 Dublin Boulevard · Suite 108 (415) 833-8600 -OB O~ 0 ORDINANCE NO. -91 AN ORDINANCE OF THE CITY OF DUBLIN ESTABLISHING A LIMITED PARKING ZONE ON DUBLIN BOULEVARD WESTERLY OF GOLDEN GATE DRIVE The City Council of the City of Dublin does ORDAIN as follows: Section 1. Pursuant to City of Dublin Municipal Code Section 6.04.270, a limited parking zone (one hour parking) is established at the following location: On the south side of Dublin Boulevard, from a point 150 westerly of the westerly curbline of Golden Gate Drive, westerly a distance of 40 feet. Section 2. The provisions of Section 1 shall be added to Chapter 7 of the City of Dublin Traffic Code. Section 3. This ordinance shall take effect and be in force 30 days following its adoption. The City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
