DESCRIPTION: The building at 6767 - 6787 Dublin Boulevard contains 24,360 square feet and is presently occupied by 5 tenants. (See "Exhibit 2") NAPA Auto Parts Company proposes to occupy 5,100 square feet in the northwest corner of the building. NAPA proposes to install 1,808 square feet of mezzanine floor area in order to provide access to the upper portion of the proposed storage racks. (See "Exhibit" 3) Section 3802(d) of the City of Dublin Building Code provides that automatic fire sprinklers be provided whenever a new building exceeds 5,000 square feet. Section 3802(j) provides that whenever an existing building is enlarged automatic fire sprinklers must be installed throughout the building. Adding the additional mezzanine floor space triggers the requirement for sprinklers throughout the entire building. In this case NAPA intends to install sprinklers in their portion of the building only. The building owner is requesting a variance to allow the addition of the mezzanine floor without sprinkling the entire building. Mitigating factors that justify granting the Variance are: 1. The supply piping for the sprinkler system is designed to provide for complete sprinklers in the _future..~ . 2. Stub.outs.are beingprovided~to extend the system into the nonsprinklered: areas. -. 3. The owner intends to extend the sprinkler system with the ultimate goal of a complete sprinkler system. '4. The additional floor space is small in comparison to the size of the building. s. There is a 2-hour fire wall dividing the building into two separate fire areas. In order to grant the requested variance, the City Council must find that; 1) the variance is consistent with the purpose and intent of the code; and 2) the variance will not lessen the protection to the people or property within the City of Dublin. In this case the portion of the building where the additional floor space is created will have fire sprinklers and this action will eventually lead to complete sprinkler protection. . " I .,. We are hereby requesting that you grant a variance to section 3802J of the building code. As you know Napa intends to add square footage to the premises in the way of a "catwalk", in order to access the parts inventory that they will carry in the store. I have asked the llapa representative to deliver a copy of the blueprint showing the proposed improvements to your office today. We understand that the building code requires that if you add square feet to a building, the requirement to fire sprinkle is enacted. Napa feels that the catwalk system is more efficient and safer than the other alternatives, and therefore is willing to provide fire sprinklers for their space, as well as bringing in properly sized pipes so that the rest of the building can be fire sprinkled at a later date. It certainly is in the best interest of the property owner to fire sprinkle the entire building, however, in light of the current economic conditions we have had to lower rents to our tenants to keep them in business. In turn, this has made it difficult to meet all of the operating and mortgage cost of the property. As soon as economically feasible, we will sprinkle the balance of the building. If we are required to do the entire building now as a condition of leasing space to Napa, that condition will kill our deal with this tenant, ~ho we believe will be a contributor to the DUblin economy. RESOLUTION NO. - 93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN GRANTING A VARIANCE TO SECTION 3802(j) OF DUBLIN BUILDING CODE f WHEREAS, Tom Huening, owner of the building at 6767 - 6787 Dublin Boulevard has requested a variance to section 3802(j) of the Building Code to allow the construction of a 1,808 square foot mezzanine floor without providing automatic fire sprinklers throughout the entire building; and WHEREAS, a portion of the building where the mezzanine floor is to be added will have automatic fire sprinklers. WHEREAS, the City Council finds that the granting of the variance is consistent with the purpose of the code and will not lessen protection to the people or property in the City of Dublin. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin city council does hereby grant the requested variance. PASSED, APPROVED AND ADOPTED this 11th day of October, 1993.
