FINANCIAL STATEMENT: The 1991-92 assessment is proposed to be
$194 . 64 per single-family lot and $36 . 00 per multi-family (apartment)
lot. The City' s costs for maintaining landscaping within District
boundaries are reimbursed by the District.
DESCRIPTION: The Conditions of Approval for development of
Tract 4719 required that a homeowners ' association be formed to
maintain certain common landscaping improvements within the Tract.
Landscaping and Lighting Assessment District No. 1983-2 was formed at
the request of the developer as an alternative to providing
landscaping maintenance through the Amador Lakes and Dublin Hills
Estates homeowners ' associations . This District maintains landscaping
and irrigation on the slopes along'- Stagecoach Road and also on the
"interior" slopes of the Dublin Hills Estates development on Agate Way
and Coral Way.
The cost of maintenance of the Stagecoach Road landscaping is spread
60% to the Amador Lakes development, divided among the 552 condominium
lots, and 40% to the Dublin Hills Estates development, divided among
the 150 single-family lots . The "interior slopes" maintenance is
spread among the 150 single-family lots only.
The District diagram remains the same as last year' s . The proposed
assessment for the 1991-92 tax year is $49,068, which is approximately
$4, 154 higher than last year' s assessment. The increased cost is
primarily due to replacement of plant material that was damaged or
destroyed by the winter freeze and replacement of vandalized
irrigation components . While it is proposed to utilize approximately
$3, 900 from existing reserves to help defray the cost of these
replacements , the use of reserves will not totally offset these
expenses .
The proposed assessment per single-family lot is $194 . 64, as compared
with $181 . 74 last year. The proposed assessment per condominium lot
i°g-- $36 . 00, as compared with $31 . 98 last year.
Notices regarding this public hearing have been published, posted, and
mailed to property owners in accordance with Government Code
regulations . Staff additionally mailed a newsletter to property
owners which described events that took place in the District over the
past year. A copy of the newsletter was previously sent to the City
Council and is also attached to this agenda statement .
Staff recommends that the City Council conduct a public hearing,
deliberate, and adopt the resolution approving the engineer' s report,
confirming the diagram and assessment, and ordering levy of assessment
for the 1991-92 tax year.

ASSESSMENT
WHEREAS, on March 25, 1991, the City Council of the City of
Dublin, California, pursuant to the provisions of the Landscaping and
- Lighting Act of 1972, adopted its Resolution Directing Preparation of
Annual -Report for Maintenance Assessment District 1983-2 for the
maintenance of improvements more particularly therein described; and
WHEREAS, said Resolution directed the undersigned to prepare
and file a report pursuant to Section 22565, et. seq. , of said Act;
NOW, THEREFORE, the undersigned, by virtue of the power
vested in me under said Act and the order of the Council of said City,
hereby make the following assessment to cover the portion of the
estimated cost of the maintenance of said improvements and the cost
and expenses incidental thereto, to be paid by said District.

As required by said Act, a diagram is hereto attached
showing the exterior boundaries of said landscaping maintenance
assessment district and also the lines and dimensions of each lot or
parcel of land within said landscaping maintenance assessment district
as the same existed at the time of the passage of said resolution,
each of which lots or parcels having been given a separate number upon
said diagram.
I do hereby assess the net amount to be assessed upon all
a*sessable lots or parcels of land within said landscaping maintenance
assessment district by apportioning that amount among the several lots
or parcels in proportion to the estimated benefits to be received by
each such lot or parcel from the maintenance of said improvements, and

more particularly set forth in the list hereto attached and by
reference made a part hereof.
Said assessment is made upon the several lots or parcels of
land within said landscaping maintenance assessment district in
proportion to the estimated benefits to be received by said lots or
parcels-respectively from the maintenance of said improvements . The
diagram and assessment numbers appearing herein are the diagram
numbers appearing on said diagram, to which reference is hereby made
for a more particular description of said property.
Each lot or parcel of land assessed is described in the
assessment list by reference to its parcel number as shown on the
Assessor' s Maps of the County of Alameda for the Fiscal Year 1991-92
and includes all of such parcels excepting those portions thereof
within existing public roads or rights of. way to be acquired in these
proceedings for public road purposes . For a more particular
description of said property, reference is hereby made to the deeds
and maps on file and of record in the office of the County Recorder of
said County. Because the names of the several owners are unknown to
me, I hereby place the word "unknown" opposite the number of each lot
of parcel of land assessed, the amount assessed thereon, and the
number of the assessment.

METHOD OF APPORTIONING
Sixty percent ( 60a) of the annual cost of maintaining the landscaping
within and along Stagecoach Road has been assigned to the 552
condominium lots within the multifamily portion of the original Tract
4719, d.isributed on an equal basis . The balance of this annual cost
has been divided equally among Lots 1 through 150, inclusive, of Tract
4719 .
The cost of maintaining the excavated slopes and concrete culverts
together with its landscaping on the interior slopes of the single-
family area (excluding those slopes and concrete culverts adjacent to
Stagecoach Road) shall be evenly spread over Lots 1 through 150 of
Tract 4719 .
Lots 152 and 153, being park and open space, shall have a _zero
assessment. Lots 154 and 155, being public agency owned, shall have a
zero assessment.

SCOPE OF WORK
The scope of work shall be the maintenance of landscaping and
irrigation within the road right-of-way and within a public easement
along Stagecoach Road between the limits of Amador Valley Boulevard
and the" northerly City Limit.
Further, the scope of work shall include the maintenance of the slopes
and landscaping and irrigation of the slopes within a public easement
for those slope areas to the rear of Lots 80 through 86 and 37 through
48, all within Tract 4719 .

APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT,
AND ORDERING LEVY OF ASSESSMENT
CITY OF DUBLIN LANDSCAPING AND LIGHTING
MAINTENANCE ASSESSMENT DISTRICT NO. 1983-2
WHEREAS, by its Resolution No. 29-91, a resolution directing
preparation of Annual Report for City of Dublin Landscaping and
Lighting Maintenance Assessment District No. 1983-2 (the "District" ) ,
this Council designated the City Engineer as Engineer and ordered that
Engineer to make and file a report in writing in accordance with and
pursuant to the Landscaping and Lighting Act of 1972 ; and
WHEREAS, said Engineer of Work has made and filed with the
City Clerk a preliminary report in writing as called for, which report
was presented to the City Council on June 24, 1991; and
WHEREAS, said Engineer of Work has filed with the City Clerk
an Engineer' s Report for final consideration; and
WHEREAS, the City Council has duly considered said Report and
each and every part thereof and ids that each and every part of said
Report is sufficient; and that said Report nor any part thereof
requires modification in any respect;
NOW, THEREFORE, BE IT RESOLVED as follows :
a) That the Engineer' s estimate of the itemized and total
costs and expenses of maintaining said improvements and of the
incidental expenses in connection therewith be; and each of them are
hereby finally approved;
b) That the diagram showing the assessment district,
description of improvements to be maintained; and the boundaries and
dimensions of the respective lots and parcels of land within said
district as contained in said report be, and it is hereby finally
approved;
c) The assessment of the total amount of cost and expenses of
the proposed maintenance of said improvements upon the several lots
and parcels of land in said District in proportion to the estimated
refits to be received by such lots and parcels, respectively, from

FACTS ABOUT THE ASSESSMENT DISTRICT
This assessment district was formed in 1983 for the purpose of
maintaining certain landscaping improvements along Stagecoach Road and
on the "interior slopes" of the Dublin Hills Estates development
(Coral Way and Agate Way) . The following areas are being maintained
by the City at the present time:
• Landscaping and irrigation within the road right-of-way and
within a public easement along Stagecoach Road between
Amador Valley Boulevard and the northerly City Limit.
• Slopes and landscaping and irrigation of the slopes within a
public easement for those slope areas to the rear of Lots 80
through 86 and 37 through 48 of Tract 4719 . These are the
"interior slopes" which face houses on Agate Way and Coral
Way.

this annual cost has been divided equally among the 150
single-family lots in Dublin Hills Estates .
• The cost of maintaining the excavated slopes, concrete
culverts , and landscaping on the interior slopes of the
single-family area (Agate Way and Coral Way) is divided
evenly among the 150 Dublin Hills Estates lots .
The monies collected through assessments are carefully accounted for
separately from other City funds . These funds can only be used for
specified expenses within the boundaries of the Assessment District.
LANDSCAPING DAMAGED BY FROST AND INSECTS
Once again, the winter freeze severely damaged the flowering gazania
groundcover on all slopes . While the clumping variety of gazania on
the interior slopes rebounded fairly well from the frost damage, it
became infested with snails in the spring. These events , coupled with

the consistent vandalism of .irrigation equipment, has made
establishment of the gazania groundcover very difficult.
The trailing variety of gazania on the top half of the slopes along
Stagecoach Road sustained the most frost damage since this variety
does not have the root structure necessary to recover. Given the fact
that we-have experienced three successive winters of damaging frost,
the City' s maintenance department has determined to replace both types
of gazania with another type of groundcover called Hypericum. This is
the same dark green groundcover which is presently planted just behind
the curbs along Stagecoach Road. Work is slated to begin in the
middle of August on the interior slopes and the corners of each of the
three slopes on Stagecoach Road. Hypericum was chosen after
consultations with a local plant pathologist and several
horticulturists because of its adaptability to poor soil conditions ,
its erosion control capabilities, its overall hardiness, and its
drought tolerance once established. It is also not a host plant for
snails . Existing healthy groundcovers will remain until such time as
the Hypericum establishes itself . City Staff anticipates that the
proposed replanting of these slope areas will be a two-year program
which will be completed in Fiscal Year 1992-93 .
The groundcover on the lower half of the Stagecoach Road slopes is
Vinca. This groundcover experienced very little freeze damage;
however, it has a fungal disease called Pythium. The City currently
has submitted leaf and water samples to U. C. Berkeley in an attempt
to determine and isolate the source of the disease . Pythium becomes
most evident during hot weather and is aggravated by the increased
watering that can occur during summer months . This disease causes the
leaves of the Vinca to turn yellow and in some cases , to burn out to a
brown color.
The Ash trees along Stagecoach Road suffered significant damage from
two sources . The frost from last winter either damaged or killed many
Ash trees throughout the City. Additionally, the trees have an
infestation of Ash whitefly, which is a growing pest problem
throughout California. Currently, there is no chemical control for
these insects . Biological controls such as Stingerless Wasps , which—'
are a natural enemy of the whitefly, are being developed, but the
success rate is still unknown. The whitefly causes a slow decline in
the health of the tree and may eventually kill it. City Staff is
monitoring developments in the area of whitefly control, but as of
yet, there is no known control that has proven successful . The Ash
trees that have died will not be replaced until such time as the
drought situation eases . This will also allow City Staff time to
research an alternative tree for this area.
IRRIGATION
.- mother factor affecting the replacement of plant material is the
drought. The City, like all residents, been asked to reduce its
normal water use by 25% . Dublin has been able to do this to date;
however, we would like to ask residents to help by reporting any

damage to the irrigation systems from vandalism or any other cause .
Unfortunately, irrigation systems have been vandalized throughout the
district. If you notice a broken or malfunctioning sprinkler head,
please advise the City maintenance department at 833-6630, and a
repair will be made as quickly as possible so that unnecessary waste
of water is avoided. Many of you have called us with information in
the past, and your efforts are sincerely appreciated.
PARK IMPROVEMENTS
The cost of park maintenance, including that of Stagecoach Park, is
paid entirely by the City and is not charged to the assessment
district.
The City' s park masterplans include a number of future improvements
for the Dougherty Hills Park (the "hill" to the east of Stagecoach
Road) . To date, trails have been cut to allow hiking on the hill .
The City' s Five Year Capital Improvement Program indicates funding for
design after July 1, 1994 . The process will include public meetings
with the Park and Recreation Commission, as well as the City Council,
to obtain input on the designs . Upon completion of the design, the
Rotary Club has expressed an interest in pursuing volunteer projects
for development of portions of the site masterplan.
PUBLIC HEARING
The City is required to hold a public hearing each year prior to
establishing the assessment for the upcoming tax year. The attached
notice provides information regatd,iing the date, time, and place that
the hearing will be held.
This year, the City proposes to use a portion of the assessment
district reserve fund to help defray the cost of replacing frost- and
drought-damaged plant material . Use of this reserve will not,
however, totally offset the plant replacement cost nor the cost of
repairs of vandalized irrigation systems . The 1991-92 assessment is "'
therefore proposed to increase to $194 . 64 per single-family lot (as
compared with $181 . 74 last year) . This amounts to an increase on a
monthly basis of approximately $1 . 08 per month. The condominium/
apartment lot assessment is proposed to be $36 . 00 (as compared with
$31 . 98 last year) .
This year' s assessment is lower than the 1988-89 assessment of $206 . 00
per single-family lot, which included the maintenance costs for
Stagecoach Park. In 1989-90, the City Council determined that the
City would pay for park maintenance, thus lowering the assessment .
