HomeMy WebLinkAbout6.1 MAD 83-2 Public Hear CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: August 8, 1994 SUBJECT: Public Hearing: Landscaping and Lighting District No. 83-2 (Tract 4719) Report by: Public Works Director Lee Thompson EXHIBITS ATTACHED: 1) /Resolution approving Engineer's Report, confirming diagram and assessment, and ordering levy of assessment. 2) �Engineer's Report 3) / Assessment Diagram 4) / Copy of notice and newsletter sent to property owners RECOMMENDATION: 1) Open public hearing 2) Receive Staff report and public comment 3) Question Staff and the public 4) Adopt resolution approving Engineer's Report, confirming diagram and assessment, and ordering levy of assessment FINANCIAL STATEMENT: The 1994-95 assessment as preliminarily approved in the Preliminary Engineer's Report is proposed to be $228.72 per single-family lot and $38.68 per multi-family (condominium) lot (total of$21,351.36 for Amador Lakes). This is the same as last year's assessment. An alternate plan for an increased assessment for landscape work .... on the interior would be $263.72 per single-family lot. The assessment per multi-family lot would remain at $38.68 since the ` single-family homes provide 100% of the funding for the interior slopes. (See Description below regarding percentage of residents that expressed interest in this option.) DESCRIPTION: This is the second of two required public hearings regarding this assessment district. If an assessment is proposed to be increased, State Law requires the City to provide at least a 45-day notice to property owners and to hold two public hearings regarding the assessment. Although Staff is not recommending an increased assessment over the 1993-94 amount, some property owners expressed an interest in a one-time increase to fund additional planting, as • described below. Therefore, Staff proceeded with the steps required for an increased assessment in order to be in compliance, should the increase be approved by the City Council. The Conditions of Approval for development of Tract 4719 required that a homeowners' association be formed to maintain certain common landscaping improvements within the Tract. Landscaping and Lighting Assessment District No. 1983-2 was formed at the request of the developer as an alternative to providing landscaping maintenance through the Amador Lakes and Dublin Hills Estates homeowners' associations. Scope of Work and Assessment Spread This District maintains landscaping and irrigation on the slopes along Stagecoach Road and also on the "interior" slopes of the Dublin Hills Estates development on Agate Way and Coral Way. The cost of maintenance of the Stagecoach Road landscaping is spread 60% to the Amador Lakes development, divided among the 552 condominium lots, and 40% to the Dublin Hills Estates development, divided among the 150 single-family lots. The "interior slopes" maintenance is spread among the 150 single-family lots only. Proposed Assessment �/, / The District diagram remains the same as last year's. Based on the approved Preliminary Engineer's Report, the proposed assessment for the 1994-95 Fiscal Year is $55,659.36, which is the same as last year's assessment. At the time that the Preliminary Engineer's Report was prepared,.the budget for ITEM NO. 6,1 COPIES TO: Ron Nahas CITY CLERK FILE I I3IaOf1oC1UI maintenance in this District was based on a budget which did not include the 3% MCE labor rate increase that the City Council subsequently approved. Consequently, the maintenance cost in the Engineer's Report has been adjusted to be $450 higher to allow for the 3% increase. The Budget Change Form for this increase was approved at the July 25th meeting. The District reserve has been reduced by the same amount so that the assessment remains the same. Some of the property owners in the assessment district had previously expressed interest in paying a higher assessment in order to fund additional planting on the "interior slopes" of Coral Way and Agate Way. As indicated in the agenda statement for the Preliminary Engineer's Report and in the newsletter sent to property owners (Exhibit 1), the additional planting was proposed to consist of 200 five-gallon shrubs at an installed cost of$5,250, or $35 per single-family lot. In order to determine the interest in the additional planting (and increased assessment), Staff mailed a a postage-paid survey card to property owners in the District, along with the annual newsletter and public hearing notice, which asked the property owners their preference regarding the additional planting. Of the 150 single-family property owners, 63-owners (42%) returned their postcards. Of the 63 responding, 13 (20.63%) were in favor of the increased assessment and 50 (79.37%) were not in favor of the increased assessment. Some of those residents not in favor of the increased assessment included comments on the postcards that the benefit of the proposed planting was essentially limited to residents who live in the "interior slope" areas, that there were enough plants on the slopes already, and that there was a concern that maintenance costs might go up. One of those in favor of the increased assessment suggested utilizing volunteer labor to reduce the cost. Staff also scheduled an informational meeting for the evening of June 28th in order to answer questions and address any issues the property owners wished to discuss; however, no members of the public attended the meeting. First Public Hearing The first public hearing for this assessment district was held at the July 25, 1994, City Council meeting. No written protests have been received, nor were any protests received from the public at the first public hearing. Recommendation Since nearly 80% of the residents responding to the survey did not favor the increased assessment, Staff is recommending that the assessment remain the same as the 1993-94 assessment and has not prepared an alternate resolution and engineer's report. Staff recommends that the City Council open the public hearing, receive Staff's presentation, and take any testimony offered by Staff and the public, deliberate, and adopt the resolution approving the Engineer's Report, confirming diagram and assessment, and ordering levy of assessment. a:(ad)l83-2183-2ph Page 2 RESOLUTION NO. -94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT, AND ORDERING LEVY OF ASSESSMENT CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 (STAGECOACH ROAD) WHEREAS, by its Resolution No. 11-94, a Resolution Directing Preparation of Annual Report for City of Dublin Landscaping and Lighting Maintenance Assessment District No. 83-2 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said report was made and filed with the City Clerk and duly considered by this Council and found to be sufficient in every particular, whereupon it was determined that said report should stand as Engineer's Report for all subsequent proceedings under and pursuant to the aforesaid Resolution and that July 25, 1994 and August 8, 1994, at 7:30 p.m. in the Council Chambers, Dublin Civic Center, 100 Civic Plaza, Dublin, California, were appointed as the time and place for a hearing by the Council on the question of the levy of the proposed assessment, notice of which hearing was mailed, published and posted in accordance with Government Code Section 54954.6; and WHEREAS, at the appointed time and place, said hearings were held, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters pertaining to said levy were heard and considered by this Council, and this Council thereby acquired jurisdiction to order said levy and°.confirmation of diagram and assessment prepared by and made a part of the report of said engineer to pay the cost and expenses thereof; - NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve that: (a) The property owners owning more than fifty percent of the area of assessable land within the District had not, at the conclusion of said hearing, filed written protests against the said proposed levy, or against the Engineer's Estimate of costs and expenses, or against the maps and description, or against the diagram or the assessment to pay for the costs and expenses thereof; (b) The public interest, convenience, and necessity require that said levy be made; (c) The District benefited by said improvements and to be assessed to pay the costs and expenses thereof, and the exterior boundaries thereof, are as shown by a map thereof filed in the office of the City Clerk, which map is made a part hereof by reference thereto. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment-is made upon the several lots orparcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or parcels respectively from the maintenance of said improvements. The diagram and assessment 2 numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 1993- 94 and includes all of such parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. Because the names of the several owners are unknown to me, I hereby place the word "unknown" opposite the number of each lot of parcel of land assessed, the amount assessed thereon, and the number of the assessment. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719. The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single-family area (above Agate Way and Coral Way) shall be evenly spread over Lots 1 through 150 of Tract 4719. Lots 152 and 153, being park and open space, shall have a zero assessment. Lots 154 and 155, being public agency owned, shall have a zero assessment. • 5 SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit. CD))15, • • STAGECOACH ROAD (TRACT 4719) LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NEWSLETTER FACTS ABOUT THE ASSESSMENT DISTRICT This assessment district was formed in 1983 for the purpose of maintaining certain landscaping improvements along Stagecoach Road and on the "interior slopes" of the Dublin Hills Estates development(Coral Way and Agate Way). The following areas are being maintained by the City at the present time: • Landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between Amador Valley Boulevard and the northerly City Limit. • Slopes and landscaping and irrigation of the slopes within a public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48 of Tract 4719. These are the "interior slopes"which face houses on Agate Way and Coral Way. In order to arrive at the annual assessment, estimated maintenance costs for the ensuing year are divided among residents of the single-family homes of Dublin Hills Estates and the owners of the Amador Lakes Apartments as follows: • Sixty percent(60%) of the annual cost of maintaining the landscaping within and along Stagecoach Road has been assigned to the 552 apartment/condominium lots of Amador Takes, distributed on an equal basis. The remaining 40% of this annual cost has been divided equally among the 150 single-family lots in Dublin Hills Estates. • The cost of maintaining the excavated slopes, concrete culverts, and landscaping on the interior slopes of the . ',z-Single-family area(Agate Way and Coral Way)is divided evenly among the 150 Dublin Hills Estates lots. The funds collected through assessments are accounted for separately from other City funds. These funds can only be used for specified expenses within the boundaries of the Assessment District. Each year, the City is required to notify you of one or more public hearings that are being held regarding the proposed assessment for the upcoming fiscal year. The public hearing notice is included in the envelope with this newsletter. These public hearings are held at regular City Council meetings; this year's hearings are July 25th and August 8th. LANDSCAPING Oleander Planting: The City has issued a purchase order to Four Seasons Landscaping to plant 200 oleanders on the Stagecoach Road slope at Jade Circle as the first phase of the landscaping upgrade plan developed about a year ago. This work will be performed by the end of June. The funding for the plant material was contributed by Rafanelli and Nahas, the owner of the Amador Lakes apartment complex. The Assessment District is paying the cost of the labor to install the oleanders as part of the maintenance assessment already received this fiscal year. VANDALISM The Stagecoach Road area continues to experience a significant amount of vandalism. While vandalism affecting the assessment district landscaping remains at approximately the same level as last year, Stagecoach Park has been hit very hard and frequently. The City has spent nearly$3,000 in vandalism or graffiti-related repairs at Stagecoach Park in less than a year. The vandalism has consisted of damage to plant material and irrigation systems, as well as defacing some of the park furniture and equipment. We have received some requests to upgrade the plant material on the two interior slopes(Coral Way and Agate Way). The estimated cost to plant 200 five-gallon bushes on these two slopes is$5,250,which would be a one-time additional assessment of$35.00 per single-family home. The district was formed as an alternative to utilizing a homeowner's association to maintain the landscaping. The activities funded by this assessment district include irrigation maintenance(including utility costs), weeding, pruning, fertilizing, and other activities associated with maintenance of landscapes. The assessment for this district is spread between the property owners of the Amador Lakes Apartments,who pay 60% of the cost of Stagecoach Road landscape maintenance, and the property owners of the 150 single-family homes of the Dublin Hills Estates development, who pay 40% of the cost of Stagecoach Road landscape maintenance and 100% of the cost of the interior slopes landscape maintenance.
