CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: July 27, 1992 SUBJECT: Public Hearing: Landscaping and Lighting District No. 86-1 (Tract 5511) Report by: Public Works Director Lee Thompson EXHIBITS ATTACHED: 1) Engineer's Report 2) Resolution Approving Engineer's Report, Confirming Diagram and Assessment, and Ordering Levy of Assessment. 3) Assessment Diagram 4) Newsletter RECOMMENDATION: / v 1) Open public hearing 2) Receive Staff report and public comment 3) Question Staff and the public 4) Close public hearing and deliberate 5) Adopt resolution FINANCIAL STATEMENT: The 1992-93 assessment is proposed to be $84.22 per single-family lot and $41.22 per condominium/townhouse lot. The City's costs for maintaining landscaping within District boundaries are reimbursed by the District. DESCRIPTION: As part of the review and approval of the 145-unit single family development (Ridgecreek) and the other, multi-family Villages, certain landscaping maintenance was made a condition of approval. This maintenance assessment district provides funds for this work. The City Council approved formation of the District on November 10, 1986, with the initial assessment in the 1987-88 tax year. The County Assessor collects these monies for the City for the maintenance of landscaping and irrigation systems, right-of-way fencing, walls, and entrance signs and trash removal. The District's boundaries include all of Tract 5511. In 1991-92, the assessment to property owners was reduced from $120.00 to $78.48 per single family lot and from $60.00 to $39.24 per condominium lot by using a portion of the District' substantial reserve. This year's assessment is proposed to be $84.22 per single-family lot and $41.22 per multi-family lot. This is approximately 7.3% higher than last year's assessment. The increase is primarily due to a significant increase in the cost of water. Staff is again proposing to use a portion of the reserve fund to offset the increased costs. On June 8th, the City Council adopted resolutions approving the Preliminary Engineer's Report and setting a public hearing date of July 27, 1992. Notice of the public hearing was published, posted, and mailed to property owners in accordance with Government Code regulations. Staff additionally mailed a newsletter to property owners which described events that took place in the District over the past year. A copy of the newsletter is attached to this agenda statement. An informal meeting was scheduled for Thursday, July 9th in the Regional Meeting Room; however, none of the homeowners attended the meeting. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the resolution approving the engineer's report, confirming the diagram and assessment, and ordering levy of assessment for the 1992-93 tax year. a: (ad)\86-1\86-lph ITEM NO. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the maintenance of said. improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or . parcels respectively from the maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 1991-92 and includes all of such parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. Dated: June 2, 1992 C' • Engine-r SCOPE OF WORK The following areas are to be maintained by this Maintenance Assessment District: 1) The median and roadside landscaping along the north side of the street for the entire length of Willow Creek Drive. 2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3 , 4, 5, 6, 15, 16, 37, 38, and south of Lot 145, all within Tract 5511. 3) Roadside landscaping, wall, fence, and pathway improvements along the west side of Dougherty Road between Amador Valley Boulevard and the northerly City Limit line, and along the north side of Amador Valley Boulevard between Dougherty Road and Wildwood Road. 4). Roadside landscaping, fence, and pathway improvements along the west side of Wildwood Road. 5) Roadside landscaping, fence, wall, and pathway improvements along the west side of Dougherty Road and the south side of Amador Valley Boulevard adjacent to Lot 150. 6) Roadside landscaping, fence, and pathway improvements along the west and north sides of Fall Creek Road. 7) Roadside landscaping and emergency access surfacing at the north end of Crossridge Road within the street right-of-way. FACTS ABOUT THE ASSESSMENT DISTRICT This assessment district was formed in 1986 for the purpose of maintaining certain landscaping improvements within the Villages at Willow Creek development . The following areas are being maintained by the City at the present time (see map) : 1 1 . The median and roadside landscaping along the north side of the street for the entire length of Willow Creek Drive . 2 . Roadside landscaping along Shady Creek Drive within Lots 1, 2 , 3 , 4 , 5 , 6 , 15, 16 , 37 , 38, south of Lot 145, and at the northerly end of Crossridge Road, all within Tract 5511 . 3 . Roadside landscaping, wall, fence, and pathway improvements along the west side of Dougherty Road between Amador Valley Boulevard and the northerly City Limit line, and along the north side of Amador Valley Boulevard between Dougherty Road and Wildwood Road. 1 4 . Landscaping within the Alamo Creek area is presently being maintained by the developer, Rafanelli and Nahas but will shortly be turned over to the Alameda County Flood Control District, Zone 7 . STREET LANDSCAPES Many of the plant species in this assessment district are California natives or recognized as being drought-tolerant. While the district did not experience any frost damage this past year, some planted areas did incur difficulties nonetheless . :: -+� One plant in particular, Baccharis (also called Coyote 4, 9s Brush or Dwarf Chaparral Broom) is currently not doing well . Baccharis is a ground cover which is planted {Alle- , streets in the assessment district. a long most of the stre 0 �= This 3" to 4" plant has a small , dark green leaf and, lilt „1 _ even when healthy, has a woody appearance. It appears .. yy_ that over-the-top applications of a particular SF -�} �-� ���< herbicide have damaged the plant. While there is no 4 , .� 4; - • � -ti evidence or research to indicate that the herbicide =x� ; :_ 1: would damage this plant, the City has discontinued its Y use in areas where Baccharis is planted. Most of the ` _.,� ,t plants appear to be recovering. The City maintenance °"" '� '"` ' . crews will be pruning out the dead material in July, Baccharis iliclaris' followed by replanting of areas where the. Baccharis has enough damage to warrant replanting. As of July 1 , 1992 , the City will no longer be utilizing the County Sheriff ' s Weekend Work Alternative Program. For many reasons, the program has not worked out as intended. Specifically, the Sheriff ' s Department has not been able to provide a sufficient number of people . The City' s existing maintenance contractor has therefore subcontracted weed control to a firm which will have greater responsibility for maintaining weed-free landscape beds through chemical control . This work will include providing a full-time person to spot spray weeds on a weekly basis . Water availability is much better than it was a year ago at this time. However, the cost of water to the City has risen .5.6% since last year. The City' s maintenance department is very appreciative of those residents of the district who called during the past year to notify us of broken sprinklers and other problems both in and outside of the district. Please continue to let us know when you see broken sprinkler, fallen tree, or any other landscape or irrigation problem. PARK IMPROVEMENTS The cost of park improvements and maintenance is paid by the City and not charged to the assessment district. The City' s park masterplans include a number of improvements for the Dougherty Hills Park (the "hill" to the west of the Villages ) . To date, trails have been cut to allow hiking on the hill . Proposed future projects could provide a parking area along Amador Valley Boulevard, day camp and picnic facilities, restrooms, and naturalized landscaping. Due to the City' s present budget constraints , the Five Year Capital Improvement Program currently lists any future plans or improvements for this area as unfunded. PUBLIC HEARING The City is required to hold a public hearing each year in order to offer property owners an opportunity to protest the proposed assessment for the upcoming tax year. The attached notice provides information regarding the date, time, and place that the hearing will be held. The assessment to property owners for the 1990-91 tax year was $120 . 00 for single family lots and $60 . 00 for condominium lots . For the 1991- 92 tax year, the assessment was reduced substantially through use of a portion of the assessment district' s reserve fund. The City is again proposing to use a portion of the assessment district ' s reserve fund in order to reduce the total assessment to property owners . The 1992-93 assessment is proposed to be $84 . 22 per single family lot and $41 . 22 per condominium/apartment lot. This is approximately 8% higher than last year' s assessment . The cost increase is due primarily to the increase in water rates . Caliicr = 568 • NOTICE OF ASSESSMENT The City Council of the City of Dublin will hold a public hearing for the purpose of hearing protests on the proposed assessments under the City of Dublin Landscaping and Lighting Maintenance Assessment District No. 86-1 (Tract 5511) for Fiscal Year 1992-93. The assessments are proposed to pay for the costs of maintenance of landscaping and associated structures, including weeding, fertilizing, pruning, and plant replacement; the operation of irrigation systems including payment for the cost of water and power utilities; the maintenance of right-of-way fencing, walls , and entrance signs, and trash removal on streets. For further particulars, the Preliminary Engineer' s Report is available at the office of the City Engineer at 100 Civic Plaza in the City of Dublin. The hearing will be held at the regular City Council meeting of July 27, 1992, at 7:30 p.m. in the Council Chambers, Dublin Civic Center, 100 Civic Plaza, Dublin CA 94568. The enclosed, newsletter explains the scope of work for this assessment district, and discusses recent and upcoming maintenance activities and the impact of the drought on water rates and plant replacement. City Staff will also hold an informational meeting on Thursday, July 9th, at 7:00 p.m. in the Regional Meeting Room of the Civic Center for the purpose of discussing these issues and answering any other questions that homeowners may have.
