FINANCIAL STATEMENT:

DESCRIPTION:
On February 24, 1992, the City Council adopted Ordinance No. 5-92
approving a Development Agreement for the Hansen Hill Ranch project,
between the city of Dublin and the Donald L. Bren company, now
California Pacific Homes, Inc.
The Development Agreement requires that an annual report be
presented to the city council, as per section 8.12.140 of the Municipal
Code, regarding the status of the project. March 1st was established as
the annual review date.
On February 24, 1994, the city received a letter from Martha
Buxton, representing California Pacific Homes, Inc., for Toohey Homes
Ltd. (see Attachment 1). The letter references 1) the renewed
Department of Fish and Game Agreement Regarding Proposed Stream Bed
Alterations allowing construction to occur between April 15, 1994 and
October 15, 1994, 2) confirmation of reauthorization from the U.S. Army
Corps of Engineers under the current Nationwide Permit Program, 3)
certification or waiver from the San Francisco Bay Region Water Quality
Control Board, and 4) the finalization of terms for an agreement with
the Valley Christian Center allowing construction of the required
roadway through their property.

The letter also conveys the intention of California Pacific Homes,
Inc., to postpone the start of the project for at least one more year,
due to the existing economic conditions which, because of the
substantial expenditure necessary to complete Phase I, does not present
a favorable market risk.
The Public Works Department has indicated that substantial progress
has been made on the Improvement Plans and the Final Map for Phase I.
These plans have been revised and checked several times, and are close
to receiving final approval.
Staff believes that the Developer has demonstrated good faith
compliance with the provisions of the Development Agreement. Staff
recommends the City Council adopt the draft resolution (Exhibit A)
relating to PA 91-099 Hansen Hill Ranch Development Agreement 1993-94
Annual Review.

ESTABLISHING FINDINGS TO SUPPORT GOOD FAITH COMPLIANCE FOR PA 91-099
HANSEN HILL RANCH DEVELOPMENT AGREEMENT 1993-94 ANNUAL REVIEW
WHEREAS, On February 24, 1992, the city of Dublin entered into a
Development Agreement with the Donald L. Bren Company (now California
Pacific Homes, Inc.) for the construction of the Hansen Hill Ranch
project; and
WHEREAS, the city Council is required to hold a public hearing to
conduct an annual review of the Development Agreement; and
WHEREAS, Martha Buxton, representing the Developer, California
Pacific Homes, Inc., has submitted a letter to the city of Dublin to
demonstrate good faith compliance with the provisions of the Hansen Hill
Ranch Development Agreement; and
WHEREAS, this project was previously reviewed in accordance with
the provisions of the california Environmental Quality Act (CEQA) and a
Negative Declaration of Environmental Significance was adopted (City
council Resolution No. 10-92) as it will have no significant effect on
the environment; and
WHEREAS, the city council did hold a public hearing on said annual
review on March 14, 1994.
NOW, THEREFORE, BE IT RESOLVED that the city council finds that
during the 1993-1994 term, the Developer has:
1. Renewed the Department of Fish and Game Agreement Regarding
Proposed stream Bed Alterations allowing construction to occur
between April 15, 1994 and October 15, 1994;
2. Requested confirmation of reauthorization from the U.S. Army
Corps of Engineers under the current Nationwide Permit
Program;
3. Requested certification or waiver from the San Francisco Bay
Region Water Quality Control Board;
4. Finalized the terms for an agreement with the Valley Christian
center allowing construction of the required roadway through
their property; and
5. Indicated that due to the poor economic conditions throughout
the State and the exposure to housing market risks associated
with this project, which requires substantial expenditures to
complete Phase I, construction is unlikely to commence on the
project during 1994.

BE IT FURTHER RESOLVED THAT THE city council finds that during the
1993-94 Annual Review of the Hansen Hill Ranch Development Agreement,
the Developer has demonstrated good faith compliance with the terms and
conditions of the agreement.

As we discussed recently on the phone. it is once again time ror the March annual review .
of the Development Agreement with the City of Dublin for Hansen Hill Ranch.
Since last year's review. California Pacific Homes has complied with all the terI11S and
conditions of the agreement an<1 has accomplished the following to allow constl1lction to
begin in the 1994 building season:
1. Renewed the Department of Fish and Game Agreement Regar<:ting Proposed
Stream Alteration. This approval permits constrUction from Apri11S, 1994
through October 1St 1994.
2. Requested confmnation of reauthorization from the U.S. Army Corps of
Engineers under the current Nationwide Pennit program,
3. Requested certification or waiver from the San Francisco Bay Region water
Quality Control Board.
4. Finalized the termS of an agreement with the V&1ley Christian Center
allowing construction of the required roadway through their property.
Although California Pacific pursued the above in order to keep aU approvals current,
construction is unlikely w commence in 1994 as the market conditions and sales rates for
the types of homes to be COIblrUcted at Hansen Hill Ranch still do not juscify the risk
associated with the huge expendItures required to complete Phase 1 of the project.
