Cost of staff time associated with processing these traffic devices is expected to decrease due to simplification of procedures. These changes are also anticipated to save time for the City Council and for the public. DESCRllYrION: In November of 1992, the City Council adopted an ordinance which modified specific sections of Chapter 6.04 of the Municipal Code (Traffic Ordinance) to simplify the procedures for approval of certain traffic devices. This ordinance related to Stop Signs, Yield Right-of-Way Signs, Traffic Signals, Through Streets, and Street Closures. Staff is proposing two additional modifications to the Traffic Ordinance which are simi.!ar in nature and intended to reduce the amount of time required for processing approvals. This would not only save the cost of Staff time but would allow more time for other, more pressing activities, for Staff, the City Council, and the public. Also, these changes will allow Staff to correct hazardous conditions in a shorter period of time. Following are the Municipal Code sections which are proposed to be changed at this time: 6.04.030 and 6.04.050 Turning Movements This section currently requires City Council approval for restrictions on turning movements; i.e., No U Turn, No Left Turn, and No Right Turn. The California Vehicle Code (CVC) does not require a local jurisdiction to take any spec. ific type of action to approve turning regulations. Staff recommends that turning regulations not require City Council approval by resolution or ordinance. Many of these turning movement regulations are installed as part of a Capital Improvement Project, which has already been reviewed and authorized by the City Council. When turning movement prohibitions are needed at a later date, it is usually as a result of a potentially hazardous condition and needs to be dealt with promptly, without the delays associated with preparing staff reports and conducting hearings. Section 6.04.050 concerning Right Turn movements is proposed to be deleted, as it repeats language contained in Section 6.04.030. 6.04.290 (D) Green Curb Markings A green curb denotes short-term parking and is normally used in front of businesses whose customers typically conduct their business in a short amount of time. Businesses often request this type of restricted parking so that the spaces will not be taken up by drivers who park for several hours or all day. The current traffic ordinance specifies that green curbs are for 20-minute parking zones only; there is no option to use green curb for 10- or 15- or 30-minute parking. The CVC will allow any amount of limited time for a green curb. Staff is proposing to change the ordinance to allow variance in the time period in order to better suit a specific situation, to allow the parking restriction to be in NO.j TO: / CITY CLERK I effect on Sundays (if desired) as well as other days of the week, and to eliminate the current restriction of 9:00 a.m. to 9:00 p.m. only. The City Council would remain the approving body for this type of time-limited parking. Recommendation As noted above, the intent of these proposed changes is to simplify procedures where public hearings are typically not necessary and therefore save time for the City Council, Staff, and the general public. Also, these changes will allow Staff to correct hazardous conditions in a shorter period of time. YELLOW indicates no stopping, standing, or parking at any time between the houn; of eight a.m. (8:00 a.m.) and five p.m. (5:00 p.m.) of any day except Sundays and holidays, for any purpose other than loading or unloading freight onto or from a commercial vehicle, or passengers, in an expeditious manner, and in no case for more than twenty (20) minutes for loading or unloading freight onto or from a commercial vehicle nor for more than three (3) minutes for load- ing or unloading passengen;, except as otherwise indicated by signs placed pur- suant to ordinance. Any duly authorized and acting police officer of the city is authorized to remove or cause removal of a vehicle from any street within any area hereinafter desig- nated during the houn; in which parking is prohibited at such location. The vehi. cle shall be removed to a garage or other place of safety designated or maintained , by the city. (Ord. 55-87 ~ 25: Ord. 13 ~ I (part), 1982) 6.04.310 Payment of charges- Vehicle owner responsibility. The owner or pen;on having the right to possession of any vehicle removed pursuant to this chapter shall pay all such removal, towing and storage charges before he shall be entitled to regain pos- session of such vehicle. Whenever a vehicle is removed under this chapter, the officer authorizing such removal shall ascertain from the registra. tion records in the vehicle or from the registration records of the Department of Motor Vehicles the name and address of the registered and legal owner thereof. If the vehicle is not claimed within twenty- four (24) hours fOllowing removal, the Police Department shall give or cause to be given written notice to the registered and legal owner of the fact of such removal, the grounds therefore and of the place to which such vehicle has been removed. The City Council shall, by resolution, designate the streets, or portions of streets, to which this article applies. Signs shall be posted giving notic.e that such streets, or portions thereof, are towaway zones. (Ord. 55-87 ~ 28: Ord. 13 ~ I (part), 1982) Article IV. Speed Limits 6.04.340 Designated by Council. Pursuant to the procedures set forth in the California Vehicle Code, the City Council shall by ordinance detennine the prima facie speed limit for any streets, or portions of streets, so designated by ordi- nance. (Ord. 55.87 ~ 29: Ord. 13 ~ I (part), 1982) 226 ORDINANCE NO. -93 AN ORDINANCE OF THE CITY OF DUBLIN AMENDING CHAPTER 6.04 OF THE CITY OF DUBLIN MUNICIPAL CODE (TRAFFIC) The City Council of the City of Dublin does ordain as follows: Section 1: Sections 6.04.030. and 6.04.290(D) of the City of Dublin Municipal Code shall be amended to read as follows: (a) Section 6.04.030 Turning movements unlawful where marked. It is unlawful for the driver of any vehicle to turn such vehicle, either left hand turn, right hand turn, or U-turn, at the intersection or between the intersections and between the hours and on the days designated by the City Engineer or his/her designee when signs are erected giving notice thereof. (b) Section 6.04.290 (D). GREEN indicates no stopping, standing, or parking, for a period of time greater than that indicated by adjacent signing or stenciling on the curb, between the hours indicated by adjacent signing, or at any time, for any day, and except as otherwise indicated by signs placed pursuant to ordinance. Section 2. Section 6.04.050 is repealed. Section 3: This ordinance shall become effective 30 days after its final passage and adoption by the City Council. The City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
