This amount is to be funded by the following sources of revenue: (1) $160,956 in storm water utility fees, (2) $21,000 in Alameda County and U.S. Army contributions, (3) $500 from fund interest, and (4) $4,500 from 1993-94 carryover fund balance. It is important to note that in order to raise the $160,956 in revenues, it is anticipated that property owners will have to be charged $166,377 to account for an estimated delinquency of payment by property owners of 1.6% and the cost of collection charged to the City by the County in the amount of 1.7%. The proposed fee for Fiscal Year 1994- 95 will remain at $14.72 for a single-family property. This is the same as the 1993-94 storm water fee. DESCRlYfION: ..'.:'.:In July 1991, the City Council approved a Storm Water Utility Fee which would be charged to all property owners in the City in order to offset the cost of the Federally mandated National Pollution Discharge Elimination System (NPDES) Program. The program is designed to reduce urban stormwater runoff pollutants which enter the storm drain system and eventually deposit in the south San Francisco Bay. These pollutants do permanent damage to the birds and marine life of the Bay. Dublin's funds go to supporting the County-wide effort, street sweeping, catch basin cleaning, and a little over one half staff person to carry out the local information/education program and make industrial site inspections. The County-wide program includes mass advertising, program coordination, and stream monitoring. The fees are based on an Equivalent Runoff Single-Family Residential Unit (ERSFRU) of 1. Duplexes also have an ERSFRU of 1. Condominiums have an ERSFRU of 0.6 and multi-family and commercial properties have an ERSFRU of 9 per acre. These factors are an approximation of the ratio of the impervious surface area as compared to an average single-family lot. Vacant properties have one half the fee of an improved lot. Federal, State, County, City and other publicly owned land is exempt from this fee, except that the Dublin! Alameda County Annexation Agreement allows for certain fees to be collected by the City of Dublin from the County. Also, Staff has been negotiating with the Camp Parks Staff to have the Army pay its share of the general program expenses which the City must pay to the County program based on population and area of runoff. It is anticipated that the Army and County fees will be in the range of $19,000 to $23,000. The fees are collected by Alameda County through the property tax bills and passed on to Dublin less collection fees. At the time of the preparation of the budget, it was anticipated that the NPDES fees would need to.. be increased by about 4.8%. Since that time, Staff has made further calculations on the public agency contributions and upgraded the estimated revenue from $14,000 to $21,000. Also, based on the 1993-94 tax roll delinquencies, Staff has reduced the percent delinquencies from 3% to 1.6%. These two factors have eliminated the need for a fee increase for the 1994-95 fiscal year. RESOLUTION NO. .94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLlN APPROVlNG AND ESTABLISHlNG STORM WATER UTILITY FEE WHEREAS, the California Regional Water Quality Control Board's San Francisco Region has required the City of Dublin to obtain a National Pollutant Discharge Elimination System (NPDES) permit to discharge its storm water into streams which lead to San Francisco Bay; and WHEREAS, as part of the NPDES permit, the City is required to implement a Storm Water Management Plan for the Alameda County Urban Runoff Clean Water Program (Program); and WHEREAS, the main objective of the Program is to protect the quality of water and life in San Francisco Bay and tributary streams in Alameda County from potentially adverse effects of storm water pollution; and WHEREAS, funding was not provided for this Federally mandated Program by Federal, State, Regional, or other sources for the Program and permit cost, and each city in Alameda County is responsible for funding its portion of the program and permit cost; and WHEREAS, Staff has developed a method of establishing a City-wide fee to cover the costs of the Program, including the cost of collecting fees and an estimated 3 % delinquency; and WHEREAS, storm drainage systems help to prevent flooding of properties; and WHEREAS, the cost to each property owner is proposed to be calculated based on equivalent runoff area for a single-family residential unit (ERSFRU) as set forth in the report prepared by the City Public Works Department; and WHEREAS, a noticed public hearing was held for purposes of considering adoption of this Resolution and the proposed Storm Water Utility fee; and WHEREAS, the report was available for public inspection and review more than ten (10) days prior to this public hearing; and WHEREAS, said Council has duly considered said report and each and every part thereof, and all testimony received at the public hearing finds that each and every part of said report is sufficient, and that said report, nor any part thereof requires or should be modified in any respect; WHEREAS, the Council finds that: A. The purpose of the Storm Water Utility Fee is to provide a program for storm water drainage for all properties within the City; B. The fees collected pursuant to this Resolution shall be used to provide funds to implement Dublin's share of the Storm Water Management Plan for the Alameda County Urban Runoff Clean Water Program: D. The amount to be raised through the Storm Water Utility Fee for 1994-1995 does not exceed the estimated total cost-of the Program and related expenses described in the report for Fiscal Year 1994-95; and NOW, THEREFORE, BE IT RESOLVED that the City of Dublin establishes and adopts a City-Wide Water Utility Fee. BE IT FURTHER RESOLVED that the following method be used to calculate the City-Wide Storm Water Utility fees for different land uses for the 1994-95 fiscal year: Land Use Each Single-Family Residential Each Duplex Each Condominium Fee Cost 1 x unit price of ERSFRU 1 x unit price of ERSFRU 0.6 x unit price of ERSFRU Commercial, Industrial and Multi-Family Residential Each Vacant Lot Lot size (sf) x unit price of ERSFRU 4,840 sf One-half of the fee for an equivalent improved lot ERSFRU = Equivalent Runoff Single-Family Residential Unit. The fee for Fiscal Year 1994-95 for each ERSFRU shall be $14.72, based on the total number ofERSFRU's appearing on the 1994-95 Alameda County Assessor's roll and a total cost of $166,377. BE IT FURTHER RESOLVED that the City Manager is authorized and directed to enter into all necessary agreements with Alameda County for collection of the fees along with property taxes, including payment to Alameda County of its reasonable costs of collection not to exceed 1.7% of the total amount collected.
