FINANCIAL STATEMENT: The cost of installing signage for the combination of Resolutions l and 2 OR for Resolution 3 would be approximately $800. DESCRIPTION: At the October 24th meeting, the City Council conducted a public hearing regarding a proposal to establish parking restrictions on Donlon Way. This proposal was to preclude the use of a City street in a commercial area for storage of vehicles, specifically trailered boats. After receiving testimony from several residents and business owners, the City Council continued the public hearing in order to allow the City Attorney to determine whether parking of specific types of vehicles (boats, trailers, RV's, and trucks over a certain size) could be prohibited on specific City streets. The City currently has a City-wide two-hour parking limit for commercially-licensed vehiclesl over 10,000 pounds gross weight. This would preclude longer term parking of most of the larger delivery type vehicles but would probably not affect the smaller utility body pickup trucks or vans. Regarding the non-commercial vehicles, the City Attorney has concluded that California Vehicle Code (CVC) Section 22507 authorizes the City Council to prohibit or restrict parking of certain vehicle types on specific streets, either "at all times" or for certain hours of the day. A boat on a trailer falls under the CVC definition ora "vehicle" as a "device by which any person or property may be propelled, moved, or drawn upon a highway, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks." The City Council can preclude trailers of any kind from any particular street. The City Council can also preclude RV's and trucks over a certain size by limiting the vehicle size (weight or dimension). As the complaint was related to trailered boats and not sight distance problems related to large vehicles, Staff`has prepared a draft resolution covering only trailers. Exhibit 1 is a draft resolution which would prohibit trailers from parking on Donlon Way, north of Dublin Boulevard, between the hours of 8:00 a.m. to 5:00 p.m. on weekdays. This draft resolution as written does not pertain to types of"RV's" such as motorhomes, campers, or mobile homes. If the City Council wishes to extend the restriction to include vehicles other than "trailers," these restrictions can be added to the resolution. If the restriction is to include trucks, the resolution would need to specify either gross vehicle weight rating (GVWR) or vehicle height or length. It should be noted that an action such as this on an individual street may precipitate similar requests from specific residential areas or a request for a City-wide restriction. Exhibit 2 is a draft resolution which would establish a three-hour parking zone (8:00 a.m. to 5:00 p.m. except Saturday, Sunday, and holidays) on a portion of Donlon Way south of Dublin Boulevard. (See location map Exhibit 4C.) This the same location that was proposed as a two-hour zone but has been changed to a three-hour zone per the request of Pastor Bigelow of the Dublin Christian Church (Exhibit 6). Exhibit 3 is the original drag resolution which would establish two hour parking (8:00 a.m. to 5:00 p.m. except Saturday, Sunday, and holidays) on Donlon Way both north and south of Dublin Boulevard. (See location map Exhibit 4B.) This is the original proposal that was presented at the October 24th meeting. It appears from observation and from comments received that the office complexes on Donlon Way north of Dublin Boulevard have sufficient on-site parking, and that the Heritage Park office complex and the Dublin Christian Church south of Dublin Boulevard tend to need some on-street parking. The Springs Apartments complex has 176 covered, assigned spaces (one space per apartment) and an additional 176 Page 2 open spaces which are available for tenants or guests on a first-come, first served basis. The Springs does not allow parking of boats within the complex. The Kildara Townhouse complex has two spaces per unit, one of which is in the garage, and an additional 26 spaces for guests. The CC&R's for Kildara prohibit parking of boats, recreational vehicles, or commercial utility vehicles within the complex. An additional notice was mailed to residents and businesses on November 3 rd advising them of the three- hour parking proposal and the "no trailers" proposal. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt resotution(s) or provide other direction. Staffhas provided three draft resolutions as potential options. Exhibit 1 would prohibit parking of trailers on Donlon Way north of Dublin Boulevard. Exhibit 2 would establish 3-hour parking on Donlon Way south of Dublin Boulevard and provide for no parking zones at driveways. These two resolutions could be adopted together or separately. Exhibit 3 (original proposal) would establish two-hour parking zones both north and south of Dublin Boulevard and provide for no parking zones at driveways. Page 3 RESOLUTION NO. - 95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN PROHTBITENG PARKING OF TRAILERS ON DONLON WAY NORTHERLY OF DUBLIN BOULEVARD The City Council of the City of Dublin hereby resolves as follows: Section 1' Pursuant to California Vehicle Code (CVC) Section 22507, and in the interest of public safety, No trailer (as defined by CVC Section 670) may be parked on Donlon Way, from the northerly curbline of Dublin Boulevard to the northe,rly end Donlon Way between the hours of 8:00 a.m. and 5.'00 p.m. (Saturdays, Sundays, and holidays excepted). Section 2. Said parking restriction shall be added to Section 6.28.030 of the City of Dublin Traffic Code. PASSED, APPROVED AND ADOPTED this 14th day of November, 1995. I would like to request that you consider a 3 hour zone south of Dublin Blvd. on Donlon ¼ray because our church which covers a large portion of the street frontage .in that area often has Bible studies on mornings that last longer than 2 hours sometimes 2 ll/2 or 3 hours. Due to the cramped parking conditions in the office complex which shares our parking .lot as well those who arrige at 9 o'clock are often unable to find a parking space in the heritage park center. This would facilitate short term parking for users of our building While still discouraging those who want to park on a permanent basis. Thank you for your consideration in th{s matter. Box 2340 Dublin, California 94568 Dear Mr. Thompson: We have some questions relating to parking on Donlon Way which has some connection with the widening project on Dublin Boulevard and the elimination of all on-street parking between Donlon Way and Village Parkway. If you make a right turn from Dublin Boulevard onto Donlon Way (coming from downtown Dublin), you will see on the right an apartment complex which ends at the Kildara Townhouse project. Commercial buildings are located along the left side of Donlon Way. Right now, all property o~ers--both commercial and residential--are maintaining their properties in a good to superior manner. A problem which detracts from the overall attractiveness of the location and which influences impressions which clients, customers, and potential tenants have about the area has to do with parking. We have vehicles using on-street parking which are not moved for days at a time and these vehicles are not late models in prime condition. However, the most damaging impression comes from two BOATS which are almost always parked on the street--one of which is not usually even attached to a towing vehicle. And these boats are not "Ms. Budweisers" Since our relocation to Dublin, we have spent considerable time, money --and efforn to make our properny aS5racnive and desirable and have plans 'to continue to improve our property for years to come. .' It is currently being used for Boat, Campers, and other vehicle long term parking. I am not sure if longer residential term parking is even appropriate during nights and weekends! They will tend to "forget" to vacate during business hours. Perhaps a four hour time limit at ail times is better. Please do something! Thanks Donald N. As you know, parking within the boundaries of the development is limiied to one assigned parking stall and a single car garage for each unit. In several instances, including my own, the occupants in the unit will have more than two vehicles (owning multiple vehicles, multiple people living in one unit, guests). One of my criteria when selecting a home was extra parking, and Kildara had this available with the Donlon Way street parking. I do not support enacting the proposed 2-hour parking restriction. Restricting parking near driveways for visibility is a valid concern, as is retaining existing no- parking zones. However, I do not believe that businesses along Donton Way north of Dublin Boulevard need the street parking for customers. Alt of these businesses have their own oCt-street parking lots, which provide more than enough stalls without having to utilize street parking. One possible compromise may be allowing unrestricted parking along the east side, and restricted parking on the west side of Donlon, north of Dublin Boulevard, as the businesses are all located on ~he west side.
