Site Development Review to establish the design of the signs and the plan determining the location of the signs would be processed at the expense of residential developers. DESCRIPTION: On September 2, 1997, the City Council adopted the comprehensive revision of the Dublin Zoning Ordinance. Chapter 8.84, Sign Regulations, was adopted as part of that revision. These Regulations addressed signage for residential subdivisions in Section 8.84.050.E, Directional Tract Signs. Since the Ordinance revision, Directional Tract Signs have been erected in Dublin for each new development. These signs have varied in design and color and have sometimes clashed with each other and their surroundings when placed on the same lot. In order to avoid the proliferation of Directional Tract Signs when residential development occurs in many locations at the same time, Staff is proposing that the Sign Regulations be revised to change Directional Tract Signs from Permitted Signs to Prohibited Signs and to add a new type of sign called Off-Site Residential Development Directional Sign. These signs would be paid for and maintained by the residential development industry. Development. Staff is proposing amendments to Chapter 8.84 of the Zoning Ordinance, Sign Regulations, as follows: . Section 8.84.020, Definitions, to delete Directional Tract Signs from, and add Off-Site Residential . Development Directional Signs to, the definition of Off-Site Advertising sign. This section would also be changed to add a definition of Off-Site Residential Development Directional Sign; . Section 8.84.030, Sign Approvals and Decisionmaker Authority by Zoning District, to delete Directional Tract Signs from Matrix A and add Off-Site Residential Development Directional Signs to Matrix A; . Section 8.84.040, Matrix B; Sign Development Regulations, to delete Directional Tract Signs from Matrix B and add Off-Site Residential Deyelopment Directional Signs to Matrix B; . Section 8.84.050, Signs Subject To Permits, to delete Section 8.84.050.E, Directional Tract Signs and add Section 8.84.050.1 (as re-Iettered), Off-Site Residential Development Directional Signs; and . Section 8.84.150, Prohibited Signs, to add Section 8.84.150.D (as re-lettered), Directional Tract Signs and to Delete Directional Tract Signs from Section 8.84.150.E and add Off-Site Residential Development Directional Signs to that section. The text of the new Off-Site Residential Development Directional Sign provisions are as follows: Sec. 8.84.050 Signs Subject To Permits. The following signs shall be allowed pursuant to the permits . required in the Zoning Districts as indicated in Matrix A (Section 8.84.030) and shall be regulated as shown in Matrix B, (Section. 8.84.040) and as follows: J. Off~Site Residential Development Directional Signs. The purpose of this section is to establish and regulate a standardized program of off-site residential development directional sil!ns in areas where many developments are being constructed at the same time. . This will provide attractive and effective sil!nage to help the public find the developments. Off-Site Residential Development Directional Signs. "Signs" for the PUl"Poses of this section. are subject to the Building Permit process. These sil!ns are permitted subject to the following: .L Residential developments of 5 or more dwelliR!! units. Sil!ns shall be prepared for residential developments where 5 or more dwellinl! units are concurrently undergoing construction. 2. On private property with consent of owner. public property or City right-or-way. All sil!ns shall be placed on private property with the written consent of the property owner, public property. or on City ril!ht-of-way subject to a City encroachment permit. 3. Construction and maintenance by one si!:m company. Sil!ns shall be constructed and maintained by one sil!n company and paid for by residential developers within the City. . 2 1..:-"-' -. . . . 4. Design. The design of the signs shall be uniform and shall be to the ~atisfaction of the Director of Community Development by means of a Site Development Review. A modification to the design will be by means of a Site Development Review Waiver. The Citv 10l!0 shall be placed on top of the sil!ns. Any sin2:Ie-sided sil!ns shaIl be painted the same color in the back as in the front side. The sil!ns shall not be illuminated. Off-Site Residential Development Directional Shrn Plan. An Off-Site Residential Development Directional Sil!n Plan shall be prepared to the satisfaction of the Director of Community Development by means of a Site Development Review. A modification to the Plan will be by means of a Site Development Review Waiver. The Plan shaIl show the location of each sign. preferably at maior intersections, prior to the installation of any signs. No sil!n shall be located anywhere other than as shown on the Off-Site Residential Development Directional Sil!n Plan. 6. Maintenance. The si~n companY shall maintain the signs to the satisfaction of the Director of Community Development. If sil!ns are not maintained to the satisfaction of the Director of Community Development. the City shall have the right to remove and confiscate the si l!n. 7. Each development shall he limited to one panel on an individual sien face. 8. Informine: the public. Individual panels on signs shall be used only to inform the public of residential developments within the City of Dublin. 9. Sie:ht distance. The sil!ns shall not interfere with the sight distance of motorists, pedestrians. or bicycle riders. 10. Sidewalk circulation. The signs shall not impede pedestrian circulation of sidewalks. 11. Freeways. The sil!ns shall not be located within 660 feet ofI-580 or 1-680. 12. Weeds. The site where sil!ns are located shall be kept free of weeds to the satisfaction of the Director of Community Development to a distance of two feet around each sign. 3 13. 14. 15. 16. 17. 18. 19. When a dven development is completely sold out or leased. the panel representing that development shall be removed from.all signs. Removal of silm. The signs shall be removed at the time the last dwelling unit of the developments is occupied. Relocation/reduction in size. The sil!n company shall post a bond satisfactorY to the Director of Communitv Development to assure timely removal of the signs. BACKGROUND: . The proposed Off-Site Residential Development Directional Sign provisions have several benefits. 1. Easy approval. The signs can be approved easily with a building permit once the design and location of the signs are established by means of a Site Development Review. 2. For large projects only. They would be applied to developments where 5 or more dwelling units are being built and would not be applied to small builders who are building 4 or fewer dwellings at one time. 3. Can he located in most places. They could be located on private property with the consent of the owner, on public property, or even in a City right-of-way if an encroachment permit is granted. 4. One sign company. One sign company would be chosen by the developers to manufacture, erect and maintain the signs. This would proyide continuity and avoid conflicting designs. 5. Sign Design/Sign Plan. The design of the signs and the plan showing the location of each sign will be approved by the Director of Community Development through a Site Development Review. Any modification of the design or plan would be through a Site . Development Review Waiver. The sign will have a flexible multiple-panel design with the City logo at the top. The size-of the sign depends on the amount of development in the vicinity. For example in areas where only a few developments were occurring, like Hansen 4 . . . Hill and Starward Drive, the sign would have only a few panels. In an area where many developments w~re occurring, the sign could have many panels. 6. Regulations. The Ordinance modification will contain several regulations addressing maintenance, limits on the number of panels that can be used by a developer on each sign, sight distance protection, sidewalk circulation, devices, prohibited signs and removal. 7. Existing Directional Tract Signs. The Ordinance modification would prohibit Directional Tract Signs. As such, all existing Directional Tract Signs wO}lld be come non- conforming. This Ordinanc~ y.'ould allow the City to pursue amortization of the signs pursuant to Section 8.140. 070. 8. Relocation/reduction in size. Similar signs in other cities have ended up with only a few panels in use as developments have sold out and their panels have been removed. When this happens the signs should be relocated to be nearer the developments they advertise and where more panels could be used. If there are few developments, the sign should also be reduced in size to make it more attractive. 9. Bond. It is important that a bond be posted to ensure removal of the signs in a timely way. ENVIRONMENTAL REVIEW: The City Council on August 18, 1997, adopted Resolution 103-97 finding that the Comprehensive Revision to the Zoning Ordinance, including Chapter 8.84, Sign Regulations, is exempt from the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that revising the Zoning Ordinance would have a significant effect on the environment (Section 15061 (b )(3). Amending the Sign Regulations to revise that portion relating to Directional Tract Signs and Off-Site Residential Development Directional Signs is also exempt from the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that such amendment would have a significant effect on the environment because they would be uniform, well-designed and would avoid the use of Directional Tract Signs which are not subject to design review. PLANNING COMMISSION RECOMMENDATION The Planning Commission adopted Resolution 98-47 (Exhibit 2) on October 13, 1998, recommending that the City Council amend Chapter 8.84, Sign Regulations, of the Municipal Code. RECOMMENDATION Staff recommends that the City Council: Open public hearing and hear staff presentation, take testimony from the public, question staff and the public, close public hearing and deliberate, waive reading and introduce the Ordinance amending Chapter 8.84 (Exhibit 1) of the Municipal Code, and continue public hearing to the November 3, 1998 meeting. 5 /~1 ORDINANCE NO. . AN ORDINANCE OF THE CITY OF DUBLIN AMENDING CHAPTER 8.84, SIGN REGULATIONS, (RELATING TO DIRECTIONAL TRACT SIGNS AND OFF-SITE RESIDENTIAL DEVELOPMENT DIRECTIONAL SIGNS) OF THE MUNICIPAL CODE (ZONING ORDINANCE) THE CITY f:OUNCIL OF THE CITY OF DUBLIN DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 8.84.020.V (as re-lertered), Off-Site Ad~ertising Sign, of the Dublin Municipal Code is amended to read as follows: "V. Off-Site Advertising Sign. The term Off-Site Advertising Sign shall mean any sign which advertises or informs about a business organization or event, goods, products, services or uses, not available on the property upon which the sign is located. Signage for a business within a shopping center under multiple ownerships shall not be considered an Off-Site Advertising Sign even though it is not located on the same property as the business being advertised. The term Off-Site Advertising Sign does not include Special Easement Signs, Community Identification Signs, Off- Site Residential Development Directional Signs or Off-Site Temporary For Sale Or Lease Signs." Section 2. .Section 8.84.020.W (as re-lertered), Off-Site Residential Development Directional Sign, is added to the Dublin Municipal Code to read as follows: "W. Off-Site Residential Development Directional Sign. The term Off-Site Residential Development Directional Sign shall mean a uniformly designed sign which advertises or informs the public about a residential development where 5 or more dwelling units are undergoing construction. ., Section 3. Section 8.84.030, Sign Approvals And Decisionmaker Authority by Zoning District, of the Dublin Municipal Code is amended to delete Directional Tract Signs from Matrix A. . Amendments. Chapt~ 8.84 shall be re-numbered and/or re-lettered as necessary to accommodate and/or reflect the forgoing amendments. Section 12. Severabilitv. The provisions of this Ordinance are severable and if any provision, clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, sections, words or parts thereof of the ordinance or their applicability to other persons or circumstances. . Section 13. Effective Date and Postin2 of Ordinance This ordinance shall take effect and be in force thirty (30) days from and after the date of its final adoption. The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 39633 of the Government Code of Cali fomi a." Zoning Ordinance would have a significant effect on the environment (Section 15061(b)(3)); and WHEREAS, an Environmental Impact Report, SCH#840 11 002, was prepared for the Dublin General Plan and certified on February 11, 1985; which addressed impacts of the future development of the City of Dublin; and which impacts and analysis exceed the impacts of the amendments to Chapter 8.84 the Zoning Ordinance, Sign Regulations; and WHEREAS, Staff has prepared an amendment to Chapter 8.84, Sign Regulations; to change Directional Tract Signs from Permitted Signs to Prohibited Signs and to establish the Off-Site Residential Development Directional Sign and regulations therefore and; WHEREAS, a staff report analyzing the amendments was submitted for P A 98- 058, which stated that the amendments to Chapter 8.84 (P A 98-058) do not represent changes that can have any environmental effect because it can be seen with certainty that there is no possibility that reyising the Zoning Ordinance would haye a significant effect on the environment (Section 15061(b)(3)); and WHEREAS, the Planning Commission held a public hearing on said amendment to Chapter 8.84, Sign Regulations, on October 13, 1998, for which proper notice was . given in accordance with California State Law; and 1 EXHIBIT 2 741 . WHEREAS, the Planning Commission at its October 13, 1998, meeting considered all written and oral testimony submitted at the public hearing. NOW THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that the amendments to Chapter 8.84 (P A 98-058) do not represent changes that can have any environmental effect because it can be seen with certainty that there is no possibility that revising the Sign Regulations for residential subdivisions in such a manner would have a significant effect on the environment (Section 15061 (b )(3)), and does recommend that the City Council amend Chapter 8.84, Sign Regulations, of the Municipal Code (Zoning Ordinance) as shown in Exhibit 1 and Exhibit 2 to the October 13, 1998 staff report for PA 98-058. .:..
