HomeMy WebLinkAbout7.1 Additional Library Services Agreement CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: June 25, 1984 SUBJECT Contract Agreement with the County of Alameda Library for Additional Library Services EXHIBITS ATTACHED Contract Agreement ; Letter from Ginnie Cooper , County Librarian dated May 3 , 1984 ; Letter from Eleanor Tandowsky, Dublin Library Branch Manager dated June 8 , 1984 ; Resolution RECOMMENDATION : Adopt Resolution approving a contract with the County of Alameda for additional Library services FINANCIAL STATEMENT: Annual cost to the City is $41 ,437 DESCRIPTION In September , 1983 , the City Council approved a contract with the County of Alameda to provide additional Library services on Mondays from 10 : 00 a .m, to 5 : 00 p.m. , effective October 1, 1983 thru June 30 , 1984 . The total cost to the City for providing these additional hours was $29 ,600 . Prior to October of last year , the Dublin Library, as well as other County Libraries had been closed on Mondays due to a lack of funding by the County. During the last 9 months, the Dublin Library Staff has documented that there has been an increase in the amount of Library activity as a result of the addition of Monday hours . As indicated in a letter from Eleanor Tandowsky dated June 8 , 1984 , circulation is 2% higher for the period beginning October 1983 thru May 1984 when compared to the similar period for the previous year . Reference questions are 12% higher for that same period. Staff has discussed the funding of Monday Library hours for Fiscal Year 1984-85 with the County Librarian. The County Librarian has indicated that the cost to the City would be $41 , 437 for the entire fiscal year . This represents an increase of 5% over the annualized cost of providing services for Fiscal Year 1983-84 which would have been $39 ,467 . The County Librarian has indicated that there is a possibility that the Library System may receive additional funding from the State after November of 1984 . If this should occur , the City would have the option of reducing or eliminating the cost of its participation in the funding of Monday Library hours (depending upon the level of funding from the State) , or receive additional hours of service at the Dublin Library. The County has prepared a contract agreement for Fiscal Year 1984-85 . This agreement is substantially the same as the agreement approved by the City Council during Fiscal Year 1983-84 with the following exceptions : 1 . In last year ' s agreement , there was a paragraph providing that the County Librarian could return to the City Council to negotiate a mid- year funding adjustment to pay for any additional staff necessitated by a significant increase in the volume of activity. This paragraph has been eliminated this year . 2 . Last year ' s agreement provided for quarterly activity reports, whereas this year ' s agreement provides that activity reports will be provided to the City Council upon request . ".*AR�`fi4�' � 'R"rP�M?�tl .. . , '.s. :.'.�,w�^_*5` t C, CIMEC JUN 121984 CONTRACT AGREEMENT BETWEEN THE CITY OF DUBLIN -IIY OF DIVItl AND THE COUNTY OF ALAMEDA FOR ADDITIONAL LIBRARY SERVICES INTENT WHEREAS, current funding level for County Library Services prevent increasing the number of open hours per week at the Dublin Branch of the Alameda County Library System, and WHEREAS, the citizens of Dublin wish to have the Dublin Branch Library open more than the current 37 hours per week, and WHEREAS, the members of the Dublin City Council have authorized funding for the increases in staffing and utility costs required to open the Dublin Branch seven (7) additional hours for a total of 44 open hours per week; therefore, The City of Dublin and the County of Alameda agree to provide seven (7) additional hours per week of Library Services at the Dublin Branch of the Alameda County Library System subject to the following terms and conditions. TERMS AND CONDITIONS 1) Effective Dates: This contract will be in effect from July 1, 1984 to June 30, 1985. 2) Services Described: The County of Alameda agrees to provide seven (7) additional hours of Library Services at the Dublin Branch Library each Monday, excluding County observed holidays, from 10:00 a.m. to 5:00 p.m. 3) Payments: The City of Dublin agrees to pay the County of Alameda $41,437 in four (4) quarterly installments as follows: September 30, 1984 - $10,360 December 31, 1984 - $10,359 March 31, 1985 - $10,359 June 30, 1985 - $10,359 4) Extension: All terms and conditions of this contract may be extended, by mutual agreement, on a year-to-year basis, provided the amount paid by the City of Dublin to the County of Alameda is adjusted annually to reflect increases/decreases to the costs connected with providing the services. 5) Periodic Activity Reports: Activity Reports will be provided by the County Librarian to the Dublin City Council. Dublin City Council can request such reports at any time. 6) Option to Terminate or Renegotiate Contract: This contract is predicated on the assumption that Library Service levels will remain constant. Should any circumstance arise which changes both County Library funding levels and levels of service, either party shall have the right to terminate or renegotiate this agreement by giving at least thirty (30) days written notice. 7) Liability: a) All persons employed in the performance of such 'services and functions for City of Dublin shall be County employees, and no City employees as such shall be taken over by the County and no person hereunder shall have any City pension, Civic Service, or other status or right. -1- +`k,rw:tiirhn.�+-�'LN i'k+ C+!"'s".,_+....'"_°' '"Y'"�i,i�N.'!,""" '' ., •cK'-"+:C'°.t!��f"?'. 't+'%4n-h6'T^�',x" `�u"` n;'.§*.:^".r�a. b) The City shall not be called upon to assume any liability for the direct payment of any salary, wages, or other compensation to any County personnel performing services hereunder for the City, or any liability other than that provided for in this agreement. Except as herein otherwise specified, the City shall not be liable for compensation or indemnity to any County employee for injury or sickness arising out of his/her employment. c) The County will assume liability and pay cost of defense and hold the City harmless from loss, costs or expenses caused by the negligent or wrongful act or omission of County officers, agents and employees occurring in the performance of agreements. between the parties hereto to the extent that such liability is imposed on the City by the provisions of Section 895.2 of the Government Code of the State of California. In addition, when liability arises pursuant to Section 830 et seq. , of the Government Code, by reasons of a dangerous condition of public property of the County, the County shall assume liability and pay cost of defense and hold the City harmless from loss, costs or expenses caused by the negligent or wrongful act or omission of County officers, agents and employees, whether or not arising in the performance of an agreement between the parties hereto. Box 2340 Dublin, CA 94568 Dear Rich: I am delighted that the City of Dublin is interested in continuing its financial support for Monday library service. The estimated cost of library service for the eight months from October, 1983 through June, 1984 was $29,600. The projected annualized cost of Monday service for Fiscal Year 1984/85 is $41,437 (see attachment). This amount includes an anticipated 5% increase in Salaries and Employee Benefits and required increases in Services and Supplies to cover actual costs. As was the case in 1983/84, neither administrative overhead nor the cost of library materials is included. As reported in my March 6 letter to the City Council, circulation and reference inquiries have shown an increase over the previous year. For 1984/85, we anticipate a continued but modest growth as usage patterns stabilize; perhaps a 2-3% increase in circulation and a 5% increase over the already substantial increase in reference. Over the next year, we will continue to track reference, circulation, and gate count. Public reactions to Monday open hours continue to be very positive. The County Library budget for 1984/85 will not be set until September. At this point, it appears that at least part of the State's funding of the Public Library Foundation Program will be approved by the Legislature. If that happens, and we receive supplemental funding as a result, our first priority will be to fund our computer operation on Monday evenings, which would allow Dublin the option of being open Monday afternoon and evening. The County Library would then fund additional open hours at Dublin over and above those financed by the City. Although no final decisions have been made, we would anticipate adding approximately eight additional open hours to Dublin's current schedule by November, so that Dublin would not be 'penalized' by having chosen to finance Monday service. I'm encouraged by Dublin's May statistics, which show a 7% increase in circulation and a 43% increase in reference questions over May of 1983. You also asked for gate count figures. I am unable to provide you with comparative figures or percentages because we did not collect gate count statistics before mid-September of 1983. However, I do have daily figures from September 13, 1983, to the present if you require them. Monday's total is consistently second to Saturday for days when the library closes at 5 o'clock. The count is higher for Tuesday and Wednesday when we stay open until 9 p.m. Please contact me if you need additional information. NOW, THEREFORE, BT IT RESOLVED that the Dublin City Council hereby approves the attached contract between the City of Dublin and the County of Alameda for additional Library services and further authorizes the Mayor to execute said agreement.
