FINANCIAL STATEMENT: None
DESCRIPTION: On January 17 , 1985, the Alameda County
Planning Department distributed copies of the Draft Environmental
Impact Report for Surface Mining Permit and Reclamation Plan;
SMP-18, an application of R. D. Branaugh to mine over a ten (10 )
year period an approximate 30 acre portion of a 39 . 8 acre parcel
located at 1881 Collier Canyon Road. The subject property is
situated approximately 0 . 6 miles west of Doolan Road, in the
unincorporated portion of Alameda County. The subject property
occupies the most southeasterly corner of the City' s eastern
Extended Planning Area and is situated within the City' s adopted
Sphere of Influence.
Staff has documented the specific comments on the Draft EIR in
the draft memo to William Fraley of the County Planning
Department. The areas of comment/concern are summarized as
follows;
1. Dublin General Plan and Sphere of Influence
The Draft EIR should indicate that the site is within the
Extended Planning Area of the revised draft Dublin General Plan
and the Dublin Sphere of Influence. The southern portion of the
site is designated for Business Park/Industrial ; Low Coverage
Use. The intent is to provide a high quality campus-like setting
for research and development uses .
The northern portion of the site is designated for either
residential or open space uses.

Based on the information presented in the Draft EIR, the proposed
quarry operation would be in conflict with the Dublin General
Plan.
2 . Coordination of Mining Activities with Adjoining Parcels to
the West:
Various sections of the Draft EIR discuss potential benefits to
securing coordination of grading activities between the subject
property and the parcels to the west (increased efficiency,
reduced aesthetic impacts, etc . )
While the Draft EIR cites cooperation between adjoining
properties as a desirable goal, little discussion or analysis is
presented in the form of proposed mitigation measures that would
serve as a basis to entice and/or require said cooperation to
occur. Staff feels this is an area that needs to be analyzed in
the Draft EIR in greater detail to assure that all potential
avenues are explored to secure the desired cooperation between
the affected private property owners.
3 . Detailing Mitigations to Potential Aesthetic Impacts:
In a manner similar with the previous area of concern, the Draft
EIR provides some discussion concerning the potential aesthetic
impacts but seems to fall short in its level of detail of its
discussion about possible mitigation measures . Staff feels it
would be appropriate for specific alternate grading criteria to
be developed as part of the "Project Alternatives" section. The
more detailed analysis should include a graphic depiction of the
resulting modifications to the proposed Mining Plan for this
project.
4 . Methodology Used to Estimate Average Trip Generation Rates
and Average Activity Days:
In Staff ' s opinion it is unclear as to what methodology was
utilized in estimating average trip generation rates and the
average number of annual activity days. Since the identified
traffic impacts would be directly influenced by any fluctuation
of these rates, it is desirable to know if there is any
likelihood that these numbers could significantly understate the
actual trip generation and activity days rates.

Presented herein for review and comment is a copy of the Draft Environmental
Impact Report for Surface Mining Permit and Reclamation Plan, SMP-18,
application of Robert D. Branaugh to mine over a 10 year period an
approximately 30 acre portion of a 39.8 acre parcel located at 1881 Collier
Canyon Road, approximately 0.6 miles westerly of Doolan Road, unincorporated
Alameda County.
All comments on this Draft EIR must be received by February 20, 1985 to be
considered and included in the Final EIR.
A public hearing before the Alameda County Planning Commission has been
scheduled for Monday, February 4, 1985, beginning at 6:00 p.m. in the
Auditorium of the Alameda County Puolic Works Building, 399 Elmhurst Street,
Hayward, California. Interested parties may appear and give testimony with
respect to the Draft EIR at that time.

As requested in your letter of January 17 , 1985, herewith
submitted are comments on the Draft Environmental Impact Report
for Surface Mining Permit and Reclamation Plan; SMP-18.
The primary concern that the City has with the proposal is that
it would be in conflict with the Dublin General Plan. The
revised draft General Plan designates the southern portion of the
site for Business Park/Industrial ; Low Coverage Uses. The
northern portion of the site is designated for either residential
or open space uses.
Operation of a quarry adjacent to the Business Park/Industrial
area, or residentia/open space areas would not be compatible or
desirable.
Other specific concerns are indicated below:
Page i, Final Paragraph; In addition to the "Partial Mitigation"
spelled out in this paragraph, it should also be stated that
coordination of the proposed mining operation with grading on the
adjoining property to the west would also serve to mitigate
potential adverse aesthetic impacts.
Page ii, Final Paragraph; While the Draft EIR indicates that
coordination with adjoining properties to the west is desirable,
additional analysis to provide a "hook" and/or incentive to
secure that coordination should be made part of this document.
Page 2, Paragraph 5; The Mining Plan submitted should more
precisely detail the envisioned future land uses to assure those
uses will be compatible with the land form proposed by the Mining
Plan.
Page 5, Paragraph 7; It would appear appropriate to require on-
site monitoring of the removal of the existing well by a
representative of Zone 7 of ;the Alameda County Flood Control and
Water Conservation District, rather then just "consultation" with
the District.
Page 7, Paragraph 3; As an elaboration to the stated mitigation
measures, it appears appropriate to require the applicant to
secure review and comment on the proposed reclamation plan by the
Bureau of Reclamation. The basis of this review should be to
assure that the manner topsoil is stockpiled will maximize the
retention of its organic content and assure the soils ability to
support revegative cover of disturbed areas during reclamation
stages.
Page 9, Paragraph 4; It is unclear in the text what methodology
is used in estimating the average number of working days per year
and the average number of truck loads per year. Can these

estimates potentially double or triple? What would be the
corresponding impacts if the estimates proved to be substantially
on the low side?
Page 15, Paragraph 2; Mitigation measures proposed for dust
control (i.e. , working small areas to final or near-final grade
and proceeding outward in a series of vertical lifts) should also
be considered as a possible mitigation for potential aesthetic
impacts.
Page 17, Paragraph 5; The mitigation measures proposed in this
section seem to be overly generalized. Explicit alternate
grading criteria should be offered, perhaps tying into the
"Project Alternative" section of the report and including a
graphic presentation of the alternate grading design. This
paragraph appears to have a typographical error in third sentence
where "2 : 1 slopes" should be replaced with "3 : 1 slopes" . Another
possible mitigation measure that should be discussed is use of a
narrower "mouth" at the south end of the subject valley to limit
views into the area to be mined.
Page 19, Paragraph 1; This section should be expanded and
modified to acknowledge that the subject property is within the
adopted Sphere of Influence and Extended Planning Area the City
of Dublin and is partially slated for a Business Park/Industrial;
Low Coverage land use. A twenty year buildout of this has been
anticipated in the City' s Draft General Plan.
This implies that some development activity in the vicinity of
the site may overlap with the operation of the surface mining
project, which is proposed to run for a period of ten ( 10) years.
Page 20, Paragraph 6; This paragraph cites a requirement that a
periodic review be performed for surface mining permits with time
intervals not to exceed five ( 5) years. The rapid development
rates being experienced in the Tri-Valley area appear to dictate
a shorter time interval, perhaps 2-3 years. A range of
undiscussed potential impacts may come into play if new land uses
in the vicinity are established in the proposed 10-year time
frame of the surface mining permit.
Page 21, Final Sentence; Additional consideration should be
given to entice and/or require coordination of this surface
mining permit with potential mining operations on adjoining
parcels to the west. The impacts cited in this section of the
Draft EIR do not necessarily have to be "Unavoidable Adverse
Impacts" . Various approaches seem to be available to secure the
desired coordination between the adjoining properties. One
approach would be a requirement imposed on the applicant of the
subject permit requiring him to demonstrate he has diligently
pursued an agreement with the adjoining property owner to
coordinate grading activity at the shared property line (s) . The
applicant could also be required to show how the proposed Mining
Plan would interface with potential future mining of the
adjoining property, or properties, to the west. Another approach
would be to require the applicant to record the necessary
agreements that would provide coordination with the adjoining
property to the west if and when that property files a separate
Surface Mining Permit. The adjoining property owner could then
be required to record the corresponding documents if and when he
submits an application for a Surface Mining Permit, thereby
allowing the previous agreement to be exercised.
Page 23, First Paragraph: As mentioned elsewhere in this
transmittal, it appears that additional analysis should be made
in an attempt to find a manner to entice/require coordination
between the subject property and adjoining properties to the west
to allow a move efficient- mining operating and allow for a
diminishment of the potential adverse aesthetic impacts
associated with the subject project.

Figure 2, Vicinity Map; This map should graphically depict the
adopted sphere lines of the three cities involved. A separate map
may be appropriate to indicate the respective general plan
designations each city has adopted in its adjoining sphere area.

will hold a public hearing to consider SURFACE .4,MINING PERMIT SMP-18,
application of Robert D. Branaugh for approval of a Surface Mining Permit and
Reclamation Plan to`;allow mining over -a ?;10 -r year .:period an -approximately :30
acre area of "'a f39.8 :`acre ' parcel located at 1881 :Collier Canyon Road,' north
side, approximately 0.6 miles west of Doolan Canyon Road, Livermore area,
unincorporated Alameda County.
Said public hearing will be held on Monday, the 4th day-'of `February, x
1985, beginning at 6:00 p.m., in the Auditorium of the Alameda County Public
Works Building, 399 Elmhurst Street, Hayward, California.
A Draft Environmental Impact Report for this project has been
prepared pursuant to the California Environmental Quality Act. Copies of the
Draft EIR are available at Valley libraries and from the Alameda County
Planning Department, Public Works Building, 399 Elmhurst Street, Room 136,
Hayward, California 94544. Responses to the Draft EIR must be received prior
to February 20, 1985, in order to be considered.
All persons interested in the matter may appear and be heard at this
meeting.

SUMMARY
IIRobert D. Branaugh has requested approval of a Surface Mining Permit (SMP-18)
to permit mining over a 10 year period an approximately 30 acre portion of a
I 39.8 acre parcel located at 1881 Collier Canyon Road, adjacent and northerly
of Collier Canyon Road and approximately 0.6 miles westerly of Doolan Road,
unincorporated Alameda County, Assessor's Parcel No. 99B-3200-4-4.
IThis Draft Environmental Impact Report identifies the following principal
impacts which would result from carrying out the project as proposed, with
mitigation measures given where such measures would alleviate impacts:
1. Potential for erosion and sedimentation. Mitigation: Require a
Grading Permit to be obtained, so that a comprehensive erosion and
sedimentation control plan can be approved and implemented to the
satisfaction of the Director of Public Works. Require commitment and
adherence to a detailed reclamation program for resoiling and
revegetating the site.
ii2. Potential for excess surface water runoff and groundwater collection in
the quarry area. Mitigation: Require installation of adequate
subdrains and drainage channels.

3. Potential for surface water contamination possibly leading to
groundwater contamination. Mitigation: Require surface water subject
to contamination to be retained on site.
4. Potential loss of wildlife habitat. Mitigation: Require commitment
f and adherence to a detailed reclamation program for resoiling and
revegetating the site.

5. Generation of 400-900 truck trips daily on peak days, causing potential
deterioration of Collier Canyon Road and contributing to future need
for road improvements. Increase of 12-18% in traffic at Airway
Boulevard/I-580 interchange on peak days of operation; no significant
IIIeffect on interchange operations. Mitigation: Require operator to
establish a trust fund for road cleanup and repair. Require operator
to contribute proportionate share for nearby road improvements.
111 6. Generation of noise, primarily affecting two residences on the Collier
Canyon Road haul route. Partial Mitigation: Various noise reduction
IIIstrategies.
7. Potential dust generation. Mitigation: Require frequent sprinkling,
shakedown berms for trucks, more limited operating hours, other dust
control measures.
8. Adverse aesthetic impacts caused by presence of mining, large exposed
II and visible quarry face, and ultimate artificial land contours, visible
from 1-580. Partial Mitigation: Require flatter and more rounded
final slopes.

Alternatives discussed include "No Project," which would eliminate impacts at
i the site but may increase cost of the commodity and, to the extent demand for
fill must be met by more distant operations, energy consumption and air
pollution may increase. Alternative quarry sites to supply fill material are
Iavailable; some have greater, some lesser impacts.
An alternative of coordinating mining with the property immediately adjacent
i li to the west was found to be environmentally superior to the proposed project,
as it would allow an increase in marketable material to be mined while being
less visible from 1-580 and reduce the need to mine the easterly hill on site
so extensively. Coordination of mining among the existing Bexley Quarry two
properties to the west, the intervening Righetti property, and the subject
property, would enable all properties to be mined to the property line, thus
maximizing use of the fill resource, while potentially creating a useable, ,
11 aesthetically decent land area upon reclamation.
