Devane 6 ) Judgement filed December 6, 1985 7 ) Letter from Amador Worldwide Moving & Storage dated January 2 , 1986 8) Photographs of site will be available at meeting 9 ) Specification No. 01-86 for Demolition 10 ) Specification No. 02-86 for Removal and Storage of Material 11) Plot Plan RECOMMENDATION: 1) Appropriate $50 , 000 from the Street Improvement Reserve to accomplish the demolition of buildings and structures as specified in the Judgement. 2 ) Approve Specifications & authorize the Building Official to advertise for bids to- remove all materials and personal property from the buildings and structures to be demolished and to remove all outdoor display of wares and merchandise except for plant materials authorized by Section 8- 48. 2 of the Dublin Zoning Ordinance . 3 ) Approve Specifications & authorize the Building Official to advertise for bids to demolish the buildings and structures specified in the Judgement. FINANCIAL STATEMENT: Estimated costs to accomplish the demolition and removal of the structures is $50, 000 . The Judgement provides that all costs to the City in performing the abatement. shall be charged to and paid by the owner. DESCRIPTION: This involves five buildings and structures which were built prior to the incorporation without necessary permits from the county. No. 1 is a 19 'x60 ' addition at the rear of the main building. This was built in April, 1972 . No. 2 is a 17 'x90 ' addition on the South side of the main building. This was built in November, 1980 . No. 3 is a 16 'x30 ' storage shed. No. 4 is a 8 'x12 ' storage shed. No. 5 is an uncovered storage rack. The date of construction of buildings #3, #4 , and #5 are unknown but were built prior to 1977 . ----------------------------------------------.------------------- ITEM N0. * COPIES- TO: John .Nichandros 7360 San-Ramon Rd.. a a .. r��'a r�Y'r Y,`�.R r. ��..�i'� � _ j w �ftv'�• On October 8, 1984 , the City Council directed the City Attorney to commence action to abate the building and zoning violations at the address . This action resulted in The Stipulation for Entry of Judgement. The Stipulation for Entry of Judgement set forth a series of steps which would result in the construction of the buildings to code or the construction of a new building and the abatement of the illegal buildings within one year. It also provided that if the owner failed to accomplish the steps within the time specified that the City was authorized to do whatever necessary to remove the illegal buildings and structures . Simply stated the owner has to: 1 . Discontinue outdoor display of wares and merchandise except for plant materials (for the plant nursery operation) authorized by Section 8-48 . 2 of the Dublin Zoning Ordinance by July 17, 1985 . 2 . Remove all excess signage by July 17, 1985 . 3 . Remove the office trailer by August 16, 1985 . 4 . Submit a complete application for a Site Development Review (for the illegal additions or for a building to replace them) by September 15, 1985 . 5 . Submit complete plans and an application for a building permit 90 days after the approval of the Site Development Review. 6 . Remove the buildings and structures 60 days after the issuance of a building permit, or by June 15, 1986 whichever occurs first. If items #1, #2 or #3 were not accomplished in the time specified the City was authorized to demolish the buildings and structures . If item #4 was not accomplished in the time specified the owner was to remove the buildings and structures by October 15, 1985 . The owner was notified July 1, 1985 , as to what was required and the consequences of failure to comply with the terms of The Stipulation for Entry of Judgement . The owner was notified on August 23, 1985, of failure to comply and the owner ' s attorney was notifed on October 28, 1985 that a Judgement would be obtained. In order for the City to demolish the buildings it will be necessary to first remove the merchandise and personal property from the building and place it in storage . This must be done with a Keeper from the Sheriff ' s Department in order to assure that all material is taken to the storage facility. The City will have to pay the first month storage costs . The estimated costs for moving and storage are outlined in the January 2 , 1986, letter from Amador Worldwide Moving and Storage as $21, 617 . 70 . It should be noted that this is only an estimate and that the proposal is on a time and material basis . The cost of a Sheriff ' s Department Keeper will be $51 . 00 per day. It is estimated that 5 days will be required for moving for a total cost of $255 . An informal verbal estimate for demolition of the buildings was obtained from a local demolition contractor. This estimate was $20, 000 . To this must be added cost for City Staff time and a substantial contingency because the moving charges will be on a time and material basis . Defendant shall , within thirty (30) days following 27 the execution of this Stipulation, discontinue the outdoor display 28 of wares and merchandise except for plant materials as authorized I I by Dublin Zoning Ordinance Section 8-48 .2; 2 2 . Defendant shall , within thirty (30) days following 3 the execution of this Stipulation, remove all signs from the 4 premises which exceed the total square feet of signage permitted 5 by Dublin Zoning Ordinance Section 8-48 .8; 6 3 . Defendant shall , within sixty (60) days following 7 the execution of this Stipulation, remove from the premises the 8 trailer which has been used as an office in violation of Dublin 9 Zoning Ordinance Section 8-48 .9 ; 10 4 . Defendant shall remove from the premises the 11 building additions and modifications listed as items 1 , 2 , 3 , 41 12 and 5 on Exhibit "A" , which is attached hereto and incorporated 13 herein. The abatement and removal of said items shall be subject 14 to the following conditions: 15 (a) In the event that Defendant fails to comply 16 with the time limits for performance of any of the 17 obligations set forth above in paragraphs 1, 2 , and 3, 18 Plaintiff shall immediately do whatever is necessary to 19 cause Defendant to comply with said obligations, and 20 Plaintiff shall do whatever is necessary to remove the 21 additions and modifications listed as items 1 , 2 , 3 , 4 , 22 and 5 on Exhibit "A" . Any 'and all costs incurred by the 23 Plaintiff in performing any of the above acts of 24 compliance and/or abatement shall be charged to and paid 25 by Defendant. - 26 (b) In the event that Defendant has not, by 27 September 15 , 1985 , submitted an application to 28 Plaintiff for a Site Development Review of planned -2- 1 improvements at 7360 San Ramon Road, Defendant shall , 2 not later than October 15 , 1985 , remove the additions 3 and modifications listed as items 1, 2 , 3 , 4 , and 5 on 4 Exhibit "A" . 5 (c) In the event that Defendant has not submitted 6 an application to Plaintiff for a building permit within 7 ninety (90) days following Plaintiff ' s approval of said 8 Site Development Review, Defendant shall , not later than 9 one hundred twenty (120) days following said approval, 10 remove the additions and modifications listed as items 11 1, 2 , 3 , 4 , and 5 on Exhibit 12 (d) In the event that Defendant is issued a 13 building permit by Plaintiff, Defendant shall , not later 14 than sixty (60) days following issuance of said permit, 15 remove the additions and modifications listed as items 16 1 , 2 , 3 , 4 , and 5 on Exhibit 17 (e) Notwithstanding any of the conditions set forth 18 above, Defendant shall , not later than June 15 , 1986 , 19 remove the additions and modifications listed as items 20 1, 2, 3 , 4 , and 5 on Exhibit 21 5 . In the event that Defendant fails to comply with any 22 of the conditions set forth above in paragraph 4 (b) , (c) , (d) , 23 and (e) , Plaintiff shall immediately do whatever is necessary to 24 remove the additions and modifications listed as items 1, 2 , 3 , 4 , 25 and 5 on Exhibit "A" . It provides that several actions by you must be accomplished within a specified time frame . In order to assure that there is no misunderstanding of what is required to be accomplished by you, the following shall be done : 1 . By . July 17 , 1985, discontinue the outdoor display of wares and merchandise except for plant materials as authorized by Section 8-48 . 2 of the Dublin Zoning Ordinance. 2 . By July 17 , 1985, remove all signs from the premises which exceed the square feet of signage permitted by Section 8- 48 . 8 ' 3 . By August 16, 1985 , remove the trailer. If you do not comply with the above time table, the City will remove the above items and charge you the costs of removal. Furthermore, if Items 1, 2, & 3, are not accomplished by you on August 16, 1985, the City will remove: a) the 19 ' x 60 ' addition attached to the rear of the building. b) the 17 ' x 90 ' addition on the south side of the building. c) the 16 ' x 30 ' storage shed. d) the 8 ' x 12 ' storage shed. e) the 16 ' x 24 ' uncovered storage rack. 4 . If the first 3 items are accomplished on time, you will submit a complete application for a Site Development Review with all necessary plans and data that may be required by the Planning Department by September 15, 1985 . If the first 3 items are accomplished on time, but a complete application for a Site Development Review has not been filed by September 15, 1985, you will by October 15, 1985, remove the buildings listed above. If you have submitted a complete application for a Site Development Review by September 15, 1985, you will have 90 days after approval of the site review to submit a complete July 1, 1985 John Nichandros Page 2 application for a building permit, along with necessary plans, calculations and, other data as is required by law and conditions of the approved site review. If a complete application is not filed in time, you will have 120 days from the approval of your site review to remove the buildings listed above . Finally, if for some reason the processing of your application for a site review, or building permit is delayed by your inaction, or for any other reason, and you have not secured either a Site Development Review approval, or a building permit, you will by June 15, 1986 remove the 5 buildings listed above . Furthermore, if you fail to meet the time schedule listed above anywhere along the line, the City will remove the 5 buildings listed above and charge you for the costs of removal . Nichandros . In the event the schedule was not complied with, stipulation provided that the City would remove the offending buildings and outdoor storage. Item 1 was complied with as required. Item 2 was not complied with in the time specified, but was eventually complied with. Item 3 was not complied with in the time specified, but was eventually complied with. Item 4 (b) has not been complied with, in that a complete application for a Site Development Review has not been submitted to the Planning Department. The work to be done shall be in accordance with these specifications, terms and conditions pursuant to the judgement filed December 6, 1985 in the Superior Court of the State of California in and for the County of Alameda-Southern Division No. H102786-2 . Each bidder is hereby notified that the owner of the property may demolish the buildings and structures and there is nothing to prevent the owner from performing necessary work before the successful bidder begins the demolition. In the event the owner does complete the work after the award of the contract but prior to commencement of the work by the successful bidder, the contract will be cancelled by the City. Each bidder shall include in his bid liquidated damages to be charged to the City in the event the City cancels the contract. Each bidder in determining the cost of the work shall include the value, if any, of any material that may be salvaged from the project and the cost of the work shall be reduced by the value of the salvaged materials . If the value of the salvaged materials exceed the cost of the work, the bid shall provide for payment to the City of the excess value . Any salvaged material shall become the property of the successful bidder. WORK TO BE DONE 1 . Demoliton and removal of an approximately 17 ' x 90 ' addition attached to the south side of the main building. 3 . Demolition and removal of an approximately 16 ' x 30 ' storage shed. 4 . Demolition and removal of an approximately 8 ' .x 12 ' storage shed. 5 . Demolition and removal of an approximately 16 ' x 24 ' uncovered storage rack. SPECIFICATIONS AND CONDITIONS GOVERNING DEMOLITION page 2 The above five items are shown on the sketch identified as EXHIBIT "A Any electrical wiring, water piping or gas piping serving the structures to be demolished shall be disconnected and capped off where wiring or piping enter the main building. Due care shall be exercised by the contractor to prevent damage to the existing main building to which items 1 & 2 are attached. Contractor shall also protect any plant materials in the nursery area from damage . FIRE PREVENTION No material shall be disposed of or burned on the site . During all aspects of the work the successful Contractor shall exercise extreme caution and employ appropriate measures to insure against any structural or grass/brush fire. INVESTIGATION OF SITE Each bidder shall study the specifications . By the submission of his bid the bidder certifies that if he is awarded the contract he will make no claim against the City based upon ignorance of local conditions or misunderstanding of the provisions of the specifications . COMMENCEMENT AND COMPLETION The Contractor has ten (10 ) calendar days in which to begin work, and this 10-day period shall start with the date of the Notice to Proceed. The Contractor shall complete all work in accordance with the specifications to the entire satisfaction of the City within twenty (20 ) calendar days, and this period of time for completion of the work shall also commence with the date of the Notice to Proceed. INSURANCE Contractor shall at all times during the terms of the contract with the City maintain in force the following insurance policies . 1 . Workers Compensation a. Staturatory Compensation coverage b. Employers liability insurance with a limit of not less than $100, 000 per occurrence 2 . Comprehensive General Liability a. INDEMNITY (Hold Harmless ) The Contractor agrees to defend, indemnify and hold harmless the City of Dublin, its officers, employees, agents and servants for any and all liability caused by the negligence or wrongful act of the Contractor arising out of the performance of this agreement, and to pay all claims, damages, judgements, legal costs, adjuster fees and attorney fees related thereto. GUARANTEE The Contractor shall guarantee his work free from defects in material and workmanship for a period of one year from the date of acceptance and shall agree to replace at his own expense any said defect that may occur within tht time. PERMITS AND LICENSE The Contractor shall give all notices and shall procure and pay for all permits, licenses , etc . , that may be required to commence, carry on and complete the contract. The Contractor shall possess such state and local licenses as are required by law, and shall furnish satisfactory proof to the City upon request, that such licenses are in effect during the entire period of the contract. SANITARY ARRANGEMENTS The Contractor shall make provisions for and maintain in a sanitary manner, at the worksite, all necessary and sanitary conveniences for workers, in accordance with the rules and regulations of CAL/OSHA. DEMOLITION Demolition of the building shall conform to the City of Dublin Building Code and all workmanship shall be in accordance with the best demolition practices known to the trade . No material shall be stored on public rights-of-way or on adjacent properties without arrangement with the owners . SPECIFICATIONS AND CONDITIONS GOVERNING DEMOLITION 4 DUST CONTROL The Contractor shall apply water during his operations by hoses with nozzles that will insure a uniform application of water for laying dust. REMOVAL AND CLEANUP After demolition, the Contractor shall remove all items of construction, equipment and debris . Floor slabs at grade may remain but all foundation bolts or other protrusions above the slab shall be cut off flush with the slab. Removal of debris shall include the removal of all debris caused by the Contractor ' s operations together with all other debris existing on the site . Debris shall be defined as including all waste materials resulting from the Contractor' s operations (including loose or broken concrete or masonry) , and all rubbish and disused items or equipment or furnishings on the premises . Debris shall include all cut or uprooted trees or other vegetation, necessary to be removed as a result of the demolition and removal . Removal of growing trees and shrubs is not required. The Contractor shall uniformly grade the site to eliminate humps and depressions . Acceptance will not be given until the final cleanup and grading has been approved by the City ' s representative .
