Thomas Properties subject to approval of PA 94-005 PETCO
Conditional Use Permit and Site Development Review.
FINANCIAL STATEMENT:
The sale price is proposed to be $8.71 per square foot. The total sale
amount would depend on the total square footage ultimately sold to
Thomas Properties.
DESCRIPTION: At the meeting of February. 27, 1995, the City Council considered the
proposed adoption of a Resolution of Intent to sell excess right-of-way along San Ramon Road to Thomas
Properties in conjunction with development of the old "76" station site on the northwest corner of San
Ramon Road and Dublin Boulevard. The City Council determined to table the issue until the Planning
Commission had acted on the proposed PETCO store project, particularly in reference to concern about an
existing tree on the property. On March 6th, the Planning Commission approved the project, with the large
tree to be retained in a parking lot island. Under the project as approved by the Planning Commission, the
City was to retain ownership of the large evergreen tree and to be responsible for its maintenance. The
decision of the Planning Commission was appealed by Councilmember Barnes on March 7th. The appeal
will be considered by the City Council at the March 27, 1995, City Council meeting.
In order to proceed with the project within time frames, the applicant must have an indication from the City
that it will sell him some property. An alternative development concept to be presented at the March 13th
meeting would require the sale of between 6,000 and 7,000 square feet to Thomas Properties, while
preserving an open space at the corner and preserving the existing trees. The total sale amount would vary
depending on the amount of property that is ultimately sold to Thomas Properties. The City Council may
wish to review possible conditions of sale.
Since the February 27th meeting, the City Attorney has reviewed the proposed transaction and determined
that since the City owns this excess property in fee and that it is not dedicated street right-of-way, the
property may be sold according to the terms of the City's Municipal Code, and a formal public hearing is not
required. However, in view of the public concern expressed at the February 27th meeting, Staff is
recommending that the City Council allow public comment on this issue.
In valuing the excess property at $8.71 per square foot, Staff made deductions because of the earthquake
fault which runs through the property, a gas line easement to be retained, and the fact that the property owner
already had legal access over the existing driveway to San Ramon Road. Staff and Thomas Properties felt
that $8.71 per square foot was fair and equitable.
Staff recommends that the City Council receive Staff' s presentation, hear comments from the public, and
adopt the resolution approving the sale of excess City property to Thomas Properties subject to any
conditions of sale.

APPROVING SALE OF SURPLUS CITY PROPERTY
(NORTHWEST CORNER OF SAN RAMON ROAD AND DUBLIN BOULEVARD
TO THOMAS PROPERTIES SUBJECT TO CONDITIONS
WHEREAS, Thomas Properties requested to purchase excess City property on San
Ramon Road at the intersection of Dublin Boulevard, northwest comer; and
WHEREAS, the City Council declared said property as surplus on October 3, 1995; and
WHEREAS, local park and recreation and public housing agencies were contacted and
declined interest in the property; and
WHEREAS, pursuant to the provisions of the City of Dublin Municipal Code, the City
Manager has negotiated a price with the adjacent property owner; Thomas Properties;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin
does hereby approve sale, subject to conditions, of between 6,000 and 7,000 square feet of surplus City
property as described in Exhibit A (plat and description) attached hereto, to Thomas Properties at a price
of $8.71 per square foot (total price to be determined when total square footage is determined).
BE IT FURTHER RESOLVED that said approval of sale is subject to the City Council's
approval of the PETCO Conditional Use Permit and Site Plan Review.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the deed.
