HomeMy WebLinkAbout7.1 Transfer of Arroyo Vista Project Y � --7Q-90 CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: January 27, 1986 SUBJECT Adoption of Dublin Housing Authority Organizational Resolutions and Report on Process Required to Provide for Transfer of the Arroyo Vista Project EXHIBITS ATTACHED 1 ) Resolution No. 101-85 declaring the need for a Housing Authority 2 ) A Resolution appointing the first Chairperson of the Dublin Housing Authority 3 ) A Resolution appointing a temporary Secretary and Executive Director of the Dublin Housing Authority 4) Anticipated schedule for completion of process RECOMMENDATION Adopt Resolutions FINANCIAL STATEMENT: Undetermined at this time DESCRIPTION At the regular City Council meeting on September 9 , 1985 , the City Council adopted Resolution No. 101-85 declaring the need for a housing authority. This Resolution also establishes as Commissioners of the Dublin Housing Authority each of the City Councilmembers . Also at that meeting, the Council authorized the procurement of special legal services from Ms . Joyce Glatt . Ms . Glatt is familiar with the transfer process and has prepared the documents attached to this item. The first order of business is for the City Council to appoint the first Chairperson of the Dublin Housing Authority. A Resolution has been prepared in which the appointees name and title should be placed and then the City Council should adopt the Resolution. Once the Chairperson is selected , it is appropriate for the City Council to nominate and elect a Vice Chairperson of the Dublin Housing Authority. This action can be reflected in the minutes and a Resolution noting the Vice Chairperson is not required. In order to facilitate the organization of the Dublin Housing Authority, it is necessary to appoint a Temporary Secretary and Executive Director. Legal Counsel has advised that it would be appropriate to appoint the City Clerk to this position. These duties will be conducted without compensation until a permanent Secretary and Executive Director is employed . Ms . Glatt has prepared an outline of the schedule required to accomplish the transfer of the Arroyo Vista project . The exact timeframe cannot be specifically determined due to the need for review of the specific documents and proposals by both the HUD Office in Washington, D .C . , and the Regional Office in San Francisco . It is anticipated that by mid-March, all of the required documents for a final decision from HUD will have been prepared by the City. This includes the review and proposal for the management of the Arroyo Vista project . Ms . Glatt has also indicated that the City Council should be aware of the final number of Commissioners serving the Housing Authority Board of Directors . Pursuant to law, the Housing Authority must have two members which are tenants of the Dublin Housing Authority. One individual must be over the age of 62 years if the Dublin Housing Authority has tenants of such age . Due to the fact that the Dublin Housing Authority has no tenants at this time , the tenant Commissioners will need to be appointed within one year of the date the Housing Authority has such tenants . Provided that the City is successful in obtaining the transfer of the Arroyo Vista project , the additional appointments would have to be made within one year of that transfer. It is recommended that the City Council adopt the resolutions and take such actions as outlined above. Staff will be returning to the City Council at a future meeting with a presentation on the management alternatives of the Arroyo Vista project . ---------------------------------------------------------------------------- COPIES TO : ITEM N0. RESOLUTION NO. 101-85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN DECLARING THE NEED FOR A HOUSING AUTHORITY, ESTABLISHING THE DUBLIN HOUSING AUTHORITY AND APPOINTING THE MEMBERS OF THE CITY COUNCIL OF DUBLIN TO BE THE COMMISSIONERS OF THE DUBLIN HOUSING AUTHORITY WHEREAS , the City Council of the City of Dublin finds that there is a shortage of safe or sanitary dwelling accommodations in the City of Dublin available to persons of low income at rentals that they can afford; NOW, THEREFORE , BE IT RESOLVED that pursuant to Health and Safety Code Section 34240, the City Council of the City of Dublin does hereby declare that there is a need for a Housing Authority in the City of Dublin; and , IT IS FURTHER RESOLVED that the Dublin Housing Authority is hereby established; and IT IS FURTHER RESOLVED that the following members of the City Council of the City of Dublin are appointed to serve as Commissioners of the Dublin Housing Authority: Peter W. Snyder , Linda J. Jeffrey, Peter J. Hegarty, Paul C. Moffatt , and Georgean Vonheeder. PASSED, APPROVED AND ADOPTED by the City Council of the City of Dublin on this 9th day of September, 1985 , by the following votes: AYES: Snyder , Jeffery, Hegarty, Moffatt, and Vonheeder NOES: None ABSENT: None Mayor ATTEST: City Clerk RESOLUTION NO . - 86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- APPOINTING THE FIRST CHAIRPERSON OF THE DUBLIN HOUSING AUTHORITY WHEREAS , the City Council of the City of Dublin established the Dublin Housing Authority and appointed the members of the City Council to be the Commissioners of the Dublin Housing Authority; and WHEREAS , it is necessary and desirable for the City Council to appoint the first Chairperson of the Dublin Housing Authority. NOW, THEREFORE, BE IT RESOLVED that is appointed to serve as the first Chairperson of the Dublin Housing Authority; and BE IT FURTHER RESOLVED that this resolution shall be effective immediately. AYES : NOES : ABSENT: Mayor ATTEST: City Clerk RESOLUTION NO . - 86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- APPOINTING A TEMPORARY SECRETARY AND EXECUTIVE DIRECTOR OF THE DUBLIN HOUSING AUTHORITY WHEREAS , pursuant to Health & Safety Code Section 34240, the City Council has established the Dublin Housing Authority; and WHEREAS , during the initial organization of the Housing Authority , it is necessary to appoint a Temporary Secretary and Executive Director; and WHEREAS , the City Clerk of the City of Dublin is qualified and capable of performing the necessary duties . NOW, THEREFORE , BE IT RESOLVED that the City Council of the City of Dublin does hereby appoint Richard C . Ambrose , City Clerk, as the Temporary Secretary and Executive Director of the Dublin Housing Authority. BE IT FURTHER RESOLVED that Mr. Ambrose shall serve without compensation and this appointment shall be rescinded once a permanent Secretary/Executive Director is employed , or this action is further modified by Resolution. A meeting has been scheduled with the Dublin City Attorney on January 14, the purpose of which is to discuss the organizational documents for the Dublin Housing Authority which have been prepared (Parts A & B of Section I of the List of Documents) . Copies of the documents will be transmitted to the Dublin City Council and the Dublin Housing Authority for adoption as soon as possible thereafter. 2. After the adoption of the various resolutions by the Dublin City Council and the Dublin Housing Authority, the organizational transcript will be sub- mitted to HUD. My submission of the transcript to HUD will be done within a week of my receipt of certified copies of the City of Dublin's and the Dublin Housing Authority's resolutions. 3. During this time, the City of Pleasanton and the Pleasanton Housing Authority should be discussing the alternative proposals which will be sub- mitted to HUD concerning the management of Kottinger Place. The same should be done by the City of Dublin and the Dublin Housing Authority with respect to the Arroyo Vista Project. 4. The form of documents relating to the transfer of ownership (Section III of the List of Documents) and the Cooperation Agreement (Section IV of the List of Documents) will be completed. FEBRUARY 1. By the end of the first week, the documents relating to the transfer and Cooperation Agreement (Sections IV and V, respectively, of the List of Docu- ments) will be submitted to the Pleasanton City Attorney and the Dublin City Attorney for review. 2. I should receive from the Pleasanton Housing Authority the General Certif- icate signed by the Executive Director (see Section III of the List of Docu- ments) . 3. The above documents will be submitted to HUD. 4. Because the HUD office in Washington, D.C. has a general policy position against transfers of Annual Contribution Contracts between housing authorities, 'letters of support from local officials might be submitted with the request to the San Francisco Regional HUD Office. Otherwise such letters might be sub- mitted after the San Francisco Regional Office has forwarded the transfer request to Washington, D.C. MARCH 1. By the second or third week, the San Francisco Regional Office should have time to complete its review of the documents and forward the request for transfer along with its recommendations to Washington, D.C; for approval . This time estimate depends on the work load of the Housing Management staff at the time of our submission. Again, the main concern of the San Francisco Regional Office is the management proposals for the two projects. By the time the formal proposal is submitted to HUD, the various alternatives proposed by the Dublin Housing Authority and the Pleasanton Housing Authority will have been discussed with the San Francisco HUD staff so that we should avoid a delay or rejection based on the management plans. HUD CENTRAL OFFICE REVIEW I. It is difficult to estimate the review time of HUD's Washington office. In a recent case involving the Los Angeles County Housing Authority, Central Office's approval took approximately two months. In that situation, the transfer process took over one year to complete. 2. After Central Office's approval of the transfer, the final adoption and execution of all documents should be completed within two months, which includes the notice period required for the public hearings on the Cooperation Agreement. 3. Upon my receipt of certified copies of all documents executed by the parties, I will submit the final transcript to the San Francisco Regional Office. 4. The San Francisco Regional Office should be able to review and issue its approval letter within three to four weeks. 2
