RECOMMENDATION 1 . If the City Council wishes to pursue acquisition of the historical grounds �- and buildings direct Staff to prepare tJ a fiscal analysis of the requests; or 2 . If the City Council is not interested in pursuing acquisition, provide Staff with the appropriate direction FINANCIAL STATEMENT : Not yet determined DESCRIPTION At the June 11 , 1991 meeting of the Dublin City Council , the Council received a proposal from the Dublin Historical Preservation Association for the formation of a study group to consider how best the history and culture of Dublin can be promoted. Consequently Staff was directed to arrange a meeting with the Dublin Historical Preservation Association, the Amador-Livermore Valley Historical Society, the Dublin Cemetery, Inc. and the Dublin Fine Arts Foundation to discuss the future of the Dublin Heritage Center. Additionally, Councilmembers Burton and Moffatt were appointed to represent the City Council on the study group. The initial meeting was held on September 41 1991 with representation from the Dublin Historical Preservation Association, the Amador-Livermore Valley Historical Society and the Dublin Fine Arts Foundation; the Dublin Cemetery, Inc. was not in attendance. The focus of the meeting was to discuss the future of the Heritage Center and the City of Dublin's role in its future. Currently the Heritage Center consists of three historical elements; the Old Murray School , the Old St. Raymond's Church and the Dublin Cemetery. Murray School is owned and operated by the Dublin Historical Preservation Association, however they lease the property that the school is located on from the Dublin Cemetery, Inc. The Amador-Livermore Valley Historical Society owns St. Raymond's Church as well as the property immediately adjacent to the church. The Dublin Cemetery is owned and operated by Dublin Cemetery, Inc. All three of the aforementioned groups are non-profit organizations run by a separate board of directors. At -the conclusion of the initial meeting, the study group members concurred that the Heritage Center could best be served by combining the assets of each group under one owner with the City of Dublin being identified as the logical choice. Therefore each group was requested to discuss this concept with their respective boards prior to the next meeting. As the continued focus of the group was to be on the ownership and preservation of the Heritage Center, the Dublin Fine Arts Foundation declined from further participation in the group. ---------------------------------------------------------------------- ITEM NO. 704 COPIES TO: Dublin Historical Preservation Association Amador-Livermore Valley Historical Society Dublin Cemetery, Inc. CITY CLERK FILE 1 191 d Two additional meetings were held with representatives from the Dublin Historical Preservation Association, the Amador-Livermore Valley Historical Society and the Dublin Cemetery, Inc. and, as a result of these meetings, each group has submitted a proposal for consideration by the City Council . Correspondence from each of the groups is attached and, in addition, Staff has prepared a summary of each proposal below. Amador-Livermore Valley Historical Society The Amador-Livermore Valley Historical Society has proposed that the City purchase the Old St. Raymond's Church building and property for $10, 700. The Society has recently painted the church and done roof repairs totaling $10 , 000 and, in addition, purchased a sewer permit for $700 . Dublin Historical Preservation Association The Dublin Historical Preservation Association has proposed that the City accept the Old Murray School as a gift. The gift, however, would have some conditions as follows: 1 . DHPA would be allowed to lease the building in order to operate historical programs and store historical artifacts. 2 . DHPA would hope for continued support from the City to fund future projects and programs. 3 . Ownership would revert back to DHPA in the event that the City could no longer maintain the building 4. DHPA would serve in an advisory capacity as the "historical arm" of the City Representatives from the Dublin Historical Preservation Association have indicated that these conditions are negotiable and serve as a starting point for further discussion. Dublin Cemetery, Inc. The Board of the Dublin Cemetery has proposed that the City take over the Dublin Cemetery, however the membership has not yet ratified the proposal . The proposed conditions for City take-over of the cemetery property include the following: 1. Restricted Fee Title 2. Guarantee of perpetual care 3 . Qualified mortuary to handle burials 4 . No gatherings on grounds except guided tours and funerals 5 . No alcohol on grounds Again, the Dublin Cemetery Board has indicated that these conditions are subject to further negotiation. Study Group Recommendation The members of the study group have determined that no additional meetings are warranted until further direction is provided by the City Council . The study group does however recommend that the City Council consider and take action on the proposals submitted by the three groups . Staff Recommendation If the City Council is interested in pursuing acquisition of the grounds and buildings at the Heritage Center, it is recommended that Staff be instructed to prepare a fiscal analysis of the ongoing operational costs as well as the structural repair costs required to maintain the facilities as public facilities. I We have concluded that, in the best interest of the preservation of the Old Murray School , the City of Dublin is best suited to i ensure that the building will be maintained and restored. This gift, however, would need to have some stipulations: 1. The DHPA would be allowed to lease the building back to operate historical programs and store our historical artifacts presently in the building. We envision using sample leases from the cities of Pleasanton and Hayward with their historical societies as working documents to assist us in the specifics. 2. We would hope for continued support from the city to fund future projects and programs. 3. Should the city ever be in a financial situation such that the building could not be maintained to standards to allow public access, then ownership would revert to DHPA. 4. We believe that the DHPA could become the logical historical arm of the city and thereby preclude any cost associated with a formal city commission. We look forward to continued discussion on this topic and are anxious to work toward total preservation of the entire site for 1 the current and future residents of Dublin. Attn: Dave Burton Paul Moffatt Dear Councilmen; The Dublin Cemetery Board met November 7, 1991 to discuss the conditions we would require to be met for the City take-over of the cemetery property. The following stipulations are merely , a rough draft based on our Board' s informal discussions. The final agreement would have to be ratified by our general membership. The following is a cursory list resulting from our discussions: 1. Restricted Fee Title 2. Perpetual care quarantee 3 . Cemetery Board will be available for the City' s reference 4 . City to contract with a qualified mortuary and to handle burials 5 . No alcohol 6 . No gatherings on the grounds except quided tours and funerals. The grounds ;to be maintained as an area of reverence with respect for those deceased and their families. We are hoping that our organization and the City of Dublin will. be able to successfully reach an agreement that will preserve the cemetery so that our city residences will have a Historical landmark that we can all be proud of.
