FINANCIAL STATEMENT: Proposition 111 will provide an estimated $121, 000 in Gas Tax Funds for Fiscal Year 1992-93 . These Gas Tax Funds were originally intended to be used to fund local street and roadway improvements and are planned for such use in the 1992-93 budget. The City' s ability to receive these funds is conditioned upon the City' s participation in the Alameda County Congestion Management Program. With the additional requirement of a Land Use Analysis Program to the other programs already required of the City by the CMA, Staff anticipates that the 1992-93 cost of participating in the CMA is as follows : CMA IMPOSED PROGRAMS Lane Use Analysis Program $11,700 - $29, 000 Trip Reduction and Implementation 23, 863*- 23,863* Contribution for CMA Staff Costs 10, 326 - 10, 326 $45, 889 - 63, 189 *Represents net cost. CITY CLERK FILE d Net Gas Tax Funds available for street improvements : $57 , 811 - $75, 111 . Given the current level of staffing in the Planning Department, undertaking this program will result in increased turnaround time in reviewing planning applications, building permits, business licenses and responding to customers regarding planning and zoning questions . If additional CMA programs are required, the cost/benefit of continued participation should be closely evaluated. DESCRIPTION: In June of 1990, voters approved Propositions 108 and 111 that govern transportation planning in the state. Under Proposition 111 local governments will receive the new fuel tax subventions by complying with Congestion Management Programs aimed at controlling traffic on California' s transportation facilities. As a condition for receiving fuel tax subventions, the Alameda County Congestion Management Agency (CMA) in addition to other urban county CMAs in the state, is required to develop and annually update a Congestion Management Plan. The CMA adopted the 1991 Alameda County Congestion Management Plan (CMP) on October 21, 1991 . In compliance with the CMP, the City of Dublin is required to adopt a land use analysis program by October 1, 1992 . A draft of this program is attached as Exhibit A. Under state law this is a mandatory component to be included in CMPs . The purpose of Dublin' s Land Use Analysis Program would be to analyze the impacts of land use decisions on the CMP network ( I-580 and I-680 Freeways within Dublin city limits) on an annual basis . The Land Use and Analysis Program is a two-tiered information and review process of local land use projects . Tier I - General Plan Amendment (GPA) requires the City to report GPA applications to the CMA for impacts on the CMP system and inclusion of these impacts and mitigation measures into environmental documentation for the project. Tier II - Annual Forecast Land Use Projections Update requires the City to annually update land use projections for the Year 2000 and Year 2010 for input into the CMP Countywide Transportation Model . These projections take into account market trends, number of building permits issued and other GPA applications . The CMP requires land use data to be broken down by population and/or type of employment within each traffic analysis zone (see the GPA Summary Data Form and Table 1 of Exhibit A) . The CMP requires annual forecasts for the Year 2000 and Year 2010 . The City will also need to estimate existing land use data in order to prepare Year 2000 and Year 2010 totals . The CMA will use this data to update the Countywide Travel Demand Model ' s land use database. The model results will be distributed to Public Works and Planning Staff for analysis and understanding the -2- compounded effect of all projected land use changes of the roadway system. If the City fails to adopt a land use analysis program in compliance with the CMP, the CMA may find the City in nonconformance with the CMP and the City' s Proposition 111 gas tax subventions may be withheld. Costs to Implement the Land Use Analysis Program The staffing costs to implement the Land Use Analysis Program (both Tier I and Tier II ) during 1992-93 would range from $11, 700 to $29 ,040 ( 360 to 880 staff hours) . If a traffic study is needed, the CMP compliance portion would range from $3,000 to $5, 000 . If Staff processes a private project through the program, potential reimbursement would range from $40 to $5,640 ( 1 to 87 Staff hours; $3,000 traffic modeling and CMA staffing) . Ongoing staffing costs are unknown. Implementing the Program' s Tier I component will involve staff time (Associate Planner and Senior Civil Engineer) to report GPA applications to the CMA, interpret model runs and assure/verify that GPA traffic impacts and mitigation measures are adequately incorporated into environmental documents . Depending on the project' s impacts, staff time could range from 1) a minimum of 1 to 2 hours, up to 2 ) 30 to 87 hours . There might also be traffic consultant costs . For private development projects, the City is recommending charging the applicant $3, 000 to pay the City for developing the Tri- Valley Traffic Model and for CMA staffing, and a $500 - $1, 000 deposit for Public Works Staff to review the results of the model run. The Applicant would also be responsible for any traffic consultant costs . For public projects with significant traffic impacts and mitigation measures, the City will hire a consultant to prepare a traffic impact analysis and mitigation measures for inclusion in environmental documents (approximately $3,000 - $5,000 for CMA compliance) . Public Works Staff would review the consultant' s work. Implementing the Program' s Tier II component will involve approximately 360 to 790 Planning Staff hours for the first year to conduct residential and nonresidential forecast land use projections for the Year 2000 and Year 2010 . Planning Staff will need to estimate existing land use data in order to prepare Year 2000 and Year 2010 totals . Each future year should require fewer Staff hours and would depend on then current market and development trends . Conducting land use projections can be entirely funded by fuel tax subventions from Proposition 111, however those funds are currently designated for street maintenance expenditures . -3- Attachment 1 lists the tasks required for completing the Tier I and Tier II components of the Land Use Analysis Program. Each task is assigned a Public Works and/or Planning Staff member, including Staff hours and cost for completing each task. Future Program Modifications The CMA is requesting that the City of Dublin adopt the Land Use Analysis Program (Exhibit A) , which conforms to the ,CMA Tier I and Tier II Land Use Analysis Program Guidelines . Although Staff is recommending that the City Council adopt the Land Use Analysis Program, it is likely that the CMA will find it necessary to modify the CMP and the Land Use Analysis Guidelines . Rather than bringing every modification back to the City Council for approval, Staff recommends that the City Council authorize the City Manager to approve minor amendments to the Land Use Analysis Program. -4- City of Dublin Tier I , Land Use Analysis Program General Plan Amendment September 28, 1992 Background In June of 1990, California voters approved Propositions 108 and 111 that govern transportation planning in the state. Under Proposition 111 local governments will receive the new fuel tax subventions by complying with Congestion Management Programs (CMPs) aimed at controlling traffic on California ' s transportation facilities . As a condition for receiving fuel tax subventions, the Alameda County Congestion Management Agency (CMA) in addition to other urban county CMAs in the state, is required to develop and annually update a CMP. The Alameda County CMP adopted on October 24 , 1991 requires the City of Dublin and other Alameda County cities, to adopt a Land Use Analysis Program in compliance with the CMP. Proposition 111 gas tax subventions to the City may be withheld if the City fails to meet this requirement and provisions of the Land Use Analysis Program. The City of Dublin' s Land Use Analysis Program intends to analyze the impacts of land use decisions made by the City of Dublin on regional transportation systems ( I-580 and I-680 Freeways within Dublin city limits) and estimate the costs associated with mitigating the impacts . Land development projects proposed by Dublin will be reviewed by the CMA to assure that appropriate mitigations are in place or underway at the time of project occupancy. The Land Use Analysis Program has two tiers . Tier I requires the City of Dublin to report General Plan Amendment (GPA) applications to the CMA. Tier II requires the City to annually update land use projections . Land Use Analysis Program Requirements - Tier I 1 . For each GPA application estimated to generate 100 or more additional p.m. peak hour trips above that assumed for the CMP target year 2000, the City of Dublin will submit to the CMA a complete GPA summary data sheet (see Attachment A-1) . All relevant GPA data will be provided to the CMA within the initial scoping period specified by the CEQA. The data required by the CMA includes : ■ Description and map of the precise location of the project. ■ Location of proposed street access and relationship to CMP roadway system. ■ Description of types of uses in the project (e.g. , single family dwelling units; low income senior housing units, etc. ) "r I IT AH B A ■ Qualification of the uses, such as number of dwelling units, square feet of commercial use, number of jobs, etc. ■ Traffic studies prepared for the project (if any) . ■ Expected occupancy date (year) . If a multi-phase project, then the expected occupancy date of each phase. ■ Degree of completion ( ie. , occupancy) by the CIP target year (2000) . '- 2 . The CMA will model the subject GPA on the CMP roadway system (in isolation of other GPA applications) using the Tri-Valley Transportation Plan Model (CMA approved sub-area model) . The City of Dublin will notify the CMA in writing their intention to use the sub-area model for the Tier I Land Use Analysis Program. 3 . The Tri-Valley Transportation Plan modelling data (consisting of travel speeds, traffic volumes, and volume to capacity ratios) will be sent to the City of Dublin Public Works Department within 14 calendar days of the CMA receiving a fully completed and acceptable GPA application. The Public Works Department will analyze the impacts and identify mitigation measures of the subject GPA on the CMP roadway system using the Tri-Valley Transportation Plan modelling data. 4 . The City of Dublin Planning and Public Works Departments will incorporate the traffic analysis and mitigation measures into the environmental documentation prepared for the subject GPA and submit the document to the CMA for review and comment. The minimum public review period for draft Environmental Impact Reports (EIRs) is 30 days, or 45 days when the draft is submitted to the State Clearinghouse for review, and 21 days for Negative Declarations . 5 . The City of Dublin Planning Department will notify the CMA within 14 calendar days after the subject GPA has been approved. The CMA will then update the Countywide Travel Demand Model Land Use Database. Exceptions A GPA (that is estimated to generate 100 or more additional p.m. peak hour trips ) is exempt from this Tier I GPA Land Use Analysis Program if : 1 . it is adopted before October 1, 1992, and/or: 2 . a Notice of Preparation for a Draft Environmental Impact Report or Negative Declaration for the subject GPA has been distributed for public comment before October 1, 1992 . 'A process to ensure analysis of GPA impacts beyond the level of completion by the target year will be developed during 1992-1993 . 2 - As stated in the CMP legislation (Section 65089 . 3(c) (5) ) , "traffic generated by the provision of low and very low income housing" shall be excluded from the determination of conformance with Level of Service (LOS) standards . Therefore, vehicle trips generated by low or very low income housing may be discounted in determining the LOS on the CMP roadway system. The City of Dublin Public Works and Planning Departments will provide the CMA a written report describing the low income housing types, the number of low income housing vehicle trips that were subtracted and the methodology used- to identify and subtract these trips . Attachment A-2 depicts the review process for assessing impacts of local land development decisions on the CMP network. - 3 - City of Dublin Tier II , Land Use Analysis Program Annual Forecast Land Use Projections Update September 28, 1992 Land Use Analysis Program Requirements - Tier II 1 . The City of Dublin Planning Department will update Dublin' s forecast of land use projections annually for the CMP target year, The CMP target year is the last year covered in the seven year Capital Improvement Program (CIP) for a given CMP. For the 1991 CMP, the target year is 1998 . Since a 1998 land use database is not available, the CMA will use year 2000 forecasts as the target year forecasts for the first CMP cycle. 2 . For the first CMP year ( 1992) there will be only one data submittal . The Countywide Travel Demand Model ' s land use database will be updated accordingly. Model runs depicting operating conditions on the CMP roadway system will be generated by the CMA and distributed to the City of Dublin Public Works Department for analysis . Data Submittal Schedule 1 . Year 2000 and 2010 forecast land use projections will be submitted to the CMA no later than February 1, 1993 . 2 . In future CMP years, year 2000 and 2010 forecast land use projections will be submitted annually to the CMA no later than August 1 of each year (beginning in 1994 ) . The CMA will incorporate the land use changes into the Countywide Travel Demand Model ' s land use database. By September 1 of each year the CMA will prepare a countywide model run of operating conditions on the CMP roadway system using the revised land use database. The data from these model runs '(consisting of traffic volumes, speeds, and Volume to Capacity ratios) will be distributed to the City of Dublin to be used in understanding the compounded effect of all projected land use changes of the roadway system. Data Requirements Annual land use updates must be transmitted to the CMA. Land use updates should include all forecast land use projections anticipated to occur in addition to GPAs that have been approved in the last year. The City should also take into account market trends . Adopted GPAs submitted to the CMA in connection with the Tier I, GPA Land Use Analysis Program, need not be resubmitted. If the City of Dublin does not have any forecast land use projections to submit to the CMA, this must be indicated in writing and submitted to the CMA. If the City of Dublin fails to submit either a land use projections update or letter stating there are no land use updates by the August deadline, Dublin may be found in nonconformance with the CMP. GPA SUMMARY DATA FORM - Tier I, GPA Land Use Analysis Program August 21, 1992 To conform to the Alameda County Congestion Management Agency's Tier I, GPA Land Use Analysis Program requirement, a jurisdiction must complete and return this Form, and a copy of the subject GPA application document to the CMA. If required, an ASCII file format of the data may be requested by the CMA. This Form is not complete unless all questions are answered (attach additional pages, if required): 1. Project description, including location of proposed street access and relationship to CMP roadway system. 2. Attach a study area map to this Form. 3. Describe the types of uses to be included in the project (e.g. single family dwellings, low income senior housing units, etc.). 4. Will any trips generated by low or very low income housing be excluded in determining if this GPA generates 100 or more additional PM peak hour trips? Yes_ No_. If yes, attach supporting documentation describing the low or very low income housing, and the methodology used to identify and subtract those trips from total trips. 5. Cirelli, Associate Planner SUBJECT: Alameda County Congestion Management Program - Land Use Analysis Program Implementation In compliance with the 1991 Alameda County Congestion Management Program (CMP) adopted by the Alameda County Congestion Management Agency (CMA) on October 24, 1991, the City of Dublin is required to adopt a land use analysis program by October 1, 1992 . Under State law, this is a mandatory element to be included in CMPs . A draft of the Dublin' s program is attached. There are two parts to the program, Tier I - General Plan Amendment Application requires local jurisdictions to report General Plan Amendment applications to the CMA, and Tier II - Annual Land Use Update requires jurisdictions to annually update land use projections, taking into account market trends . The CMP requires land use data to be broken down by population and/or type of employment within each traffic analysis zone (see attached GPA Summary Data Form and Table 1) . The CMP requires annual forecasts for the Year 2000 and Year 2010 . The City will also need to estimate existing land use data in order to prepare Year 2000 and Year 2010 totals . The following is a list of tasks that need to be completed for the land use analysis program (Tier I and Tier II) . Public Works and/or Planning Staff is assigned to each task, including staff hours needed and cost for completing each task. Tier I --General Plan Amendment (GPA) Application 1 . Determine 100 or more additional p.m peak hour trips for each GPA application. Staff : Public Works Department - Senior Civil Engineer - 1 - AtMmt I Hours : 1-2 hours (with complete square footage, number of dwelling unit and other land use information) Cost: Staff time ( if private project, will be charged to applicant) If the project will not generate 100 or more additional p.m. peak hour trips, further compliance with the Land Use Analysis Program is not necessary. 2 . Complete GPA Summary Data Form (attached to draft Land Use Analysis Program) Staff : Planning Department - Associate Planner Public Works Department - Senior Civil Engineer ,(Determine relationship of GPA to the Congestion Management Plan (CMP) roadway system; develop methodology for identifying and subtracting trips generated by low or very low income housing units from total trips generated by GPA project, #1 and #4 on the GPA Summary Data Form) . Hours : Planning - 5-10 hours Public Works - 3-5 hours Cost: Staff time ( if private project, will be charged to applicant) 3 . Model GPA on the CMP roadway system. The City will have the CMA run the Tri-Valley Model and this is no additional cost to the City other than what the City already pays for CMA staffing and the Tri- Valley model costs . The City may establish a fee to the Applicant to run the model . Staff is recommending charging the applicant ( for a private development project) $3, 000 to pay the City for developing the model and for CMA staffing. The applicant would also be required to deposit $500 - $1, 000 for Public Works Staff to review the results of the model run ( 10 - 20 staff hours) . If the results of the model run show no project impacts, it is not necessary for staff to proceed with the next step, #4 . 4 . Analyze impacts and identify mitigation measures of the GPA on the CMP roadway system and incorporate analysis and mitigation measures into the EIR or ND. Staff : Consultant for private/City project, and Public Works Staff Hours : a. private project with major impacts and mitigation measures : 20-30 hours for Staff ' s review of consultant' s traffic study Cost: Staff time (will be charged to the applicant) - 2 - Hours : b. City project with major impacts and mitigation measures : 8 - 40 hours Staff time for reviewing consultant ' s work 3 - 10 hours Staff time for CMA compliance Cost: Estimated minimum cost - $10, 000 - $14, 000 (project processing - $7 ,000 - $9 , 000; CMA compliance - $3, 000 - $5, 000) . This is estimated cost to hire a consultant for preparing traffic impact analysis and mitigation measures for the environmental documentation 5 . Notify CMA within 14 calendar days after GPA has been approved. Staff : Planning Department - Associate Planner Hours : . 5 hour Cost: Staff time ( if private project, will be charged to applicant) Summary Depending on project impacts, implementation of Tier I could require 30 to 85 Staff hours, plus potential consultant costs for the traffic study. A private project would be charged for any Staff hours, modeling costs, and consultant costs . Tier II - Annual Land Use Update 1 . Submit Year 2000, and Year 2010 forecast land use projections annually to the CMA no later than August 1 of each year beginning in 1994 ( for this year, it would be February 1, 1993) . Land use updates are to include all forecast land use projections anticipated to occur in addition to GPAs approved within the last year (except those GPAs submitted to the CMA under Tier I) . These forecast updates should take into account current market trends . Staff : Planning Department - Associate/Senior Planner Hours : Dennis C. has updated land use information for residential developments by TAZs . However, the City does not currently have updated land use information for nonresidential developments . In order to attain this information, Staff must research Building Department files . Approximately 98% of nonresidential building square footage information is available in files kept by the Building Department. All nonresidential developments completed within about the last three years must be obtained from CeCe' s 'current building permit files . Land use projections are necessary for the existing Dublin area, including the future Eastern and Western Dublin Planning Areas . Staff 3 - time would be spent identifying and projecting existing, Year 2000 and Year 2010 floor area and land use information for each multi-family, nonresidential and public/semi-public land uses ( 325 parcels for existing Dublin area) and aggregating this information per land use category up to each Traffic Analysis Zone (TAZ ) and overall City and future Eastern and Western Dublin Planning Areas . Hours : 360 - 790 Staff hours for this year. Each future year should require fewer staff hours and would depend on then current market and development trends . /cmpland - 4 -
