The proposed district cost estimate for Fiscal Year 1995-96 is
5395,908. This amount includes the energy and maint.aneeeost
associated with both City owned and PG&E owned stnet lights
throughout the City. A contribution of 5103,196 towa" the cost of
acquiring PG&E owned street lights for the purpose of redu.g
maintenance costs and future assessments to property oWDerswithiu.

estimated 5192,490 is the proposed assessment to property OWBersfor
Fiscal Year 1995-96 cost. Although this total levy miPt vary
somewhat. based on the rmal parcel information developed between
now and the time the City conveys the levy to the County AsseslOr,it
is proposed that the actual aSSes8lDent to each individ.aI property
OWner remain at the same rate for Fiscal Year 1995-96 al wasilevied
in Fiscal Year 1994-95 (i.e. rates would b~ frozen for 'iscal Y~ar I99$-
26).
DESCRIPTION: In 1983, the City Council formed a Citywide Street LiglttiDg
Assessment District to replace the County of Alameda Lighting Service Area. This Assessment District
rmances the cost of energy and maintenance associated with streetlights owned by both the City and
PG&E. The scope of the work for the district will also include the cost of purchasing street lights and/or
repayment of and loans to the district obtained for the purchase of street lights in order to reduce
maintenance costs to property owners.
During Fiscal Year 1993-94, the City of Dublin in conj.unction with ten other ageaeies in Alameda County
initiated the process of acquiring PG&E oWDed street lights in order to reduce maintell'" costs to
customers. It is anticipated that the acquisition of these street lights will be finaliud during Fiscal Vear
1995-96. Since it is not known at what time the purehase will be CODSUlDmated during the Fiseal Vear
1995-96, Staff has assumed tlte same costs for street lights as the City would pay if PG&.E owned the
street lights during the year. Based on this level of expenditures, Staff has assu..edusillg the satDe
assessment for both residential and commercial property owners as was used during Fis~ Vear 1993-94
and Fiscal Year 1994-95. The assessment for a single family dwelling is 519.34 per year. With respect to

commercial property, the assessment is based, on a factor of 5.5 multiplied by the singlefamBy rate of
$19.34 multiplied by the acreage of the property (as shown on page 5 of the EngiDeer's Report).
As of June 30, 1995, it is projected that fund balance in this district will be approximately 5188,220. The
exact amount will not be known until the final expense and revenue accruals are made. For Fiscal Vear
1995-96, Operating Costs are estimated to be financed by assessments, interest earnings, reiulbDl'MJllents
for public damage, and collections on prior year's assessments.
Based upon the projected revenues and expenditures in the District for Fiscal Year 1995-96, a .cam
balance of $88,220 is projected at the end of Fiscal Year 1995-96 to be carried over for replaeelDeDt of
existing street lights which have reached the end of their useful life. The exact amount of r.erves that
are necessary to replace the street lights with light poles will not be known until a SUI"Vey of the .street
light poles is conducted.
Street Light Acquisitioo Options
The Adopted Fiscal Year 1995-96 City Budget also includes an amount of 5431,eoo for purchGingPG&E
owned street lights. The Engineer's Report assumes that $103,196 of the Street Lightiug ~...t
District reserve would be contributed towards acquiring the PG&E owned street lights, witb tbct "_nee
either loaned or contributed by the General Fund.
At the time that the Budget was presented to the City Council, Staff indicated that it wOllld be
appropriate for the Council to determine at a later time whether the funds from the General Fudwould
be a permanent expenditure or a loan to the Street Light Assessment District .Fund to be re,.:}iIl tile
future from energy and maintenance savings.
The City does not have the exact cost of acquisition of the PG&E street lights nor the precise sa'riIlp.in
terms of maintenance and energy if the City acquires the street lights; however, the City's streetliglliilal
consultant estimated in 1993 that the City could save up to $78,000 or 44% .of the cost __tedWitb
energy and maintenance of PG&E street lights annually.
Although it is difficult for the Council to make final determination regarding the finaneingofthis
acquisition until the final costs and savings are known, it would be helpful to Staft'iftlae Couneil
identified the preferred method of funding the Street Light Acquisition.
Staff has identified the following options for Council consideration:

1. The Assessment District contributes $103,196 from Assessment District Reserves and ..fU. General
Fund permanently contributes the difference (presently estimated at 5327,8(4) to . make .p the
amount necessary to complete the acquisition. This would result in a reduction in~ts to
all property owners in the District in Fiscal Vear 1996-97 in the run amount of the ..__ realized
by the District.
2. The Assessment District repays the General Fund without interest for. the cost of tile Street. Lipt
Acquisition through future assessments. Assuming a savings of 578;OOO/year to the J>Utrict
through ownership of the lights, the loan would be paid off in approximately 5-1/2 years,atWhieh
time the assessments to property owners could be lowered to the fuB amount.
3. The Assessment District repays the cost of the purchase with interest at the City's tUll rate of
investment. This alternative would be similar to the District borrowing money fro. a .urce
other than the City. In this alternative, there would be no net impact to the General FGd. 1'JUs
would extend the time required to payoff the General Fund and reduee usesSDleDtsto properiy
owners.
4. The Assessment District contributes 5103,196 in Reserves plus any savings realizedduriltg J'iseal
Year 1995-96 as a result of an early acquisitiOn of the Street Lights before the end of F.nl Vear
1995-96. The difference necessary to acquire the Street Lights could be funded, then,eitberwith
options 1, 2 or 3 as discussed above.

In addition to these options, there are certainly a number of variatiollS on each. of these OptioBS that the
Council could consider; however, it would be helpful if the Council did provide some peliey direetion
with respect to the generally preferred alternative for acquiring the PG&E street lights. .o.ee tile &laI
acquisition costs are known and the City has several months of actual energy savings experience, the
Council could then rmalize the preliminary direction at a subsequent Dleetillg during FiseaI Year 1'"'-
96.
Recommendation
Starr recommends that for Fiscal Year 1995-96, the Assessment for Street Lip.g be frozea at its
current level. Starr would also recommend that. the City Council provide SOBle directioD repnl&lcthe
preferred funding option for the acquisition of PG&E Street Lights.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AMENDING RESOLUTION NO. 27-95
DIRECTING PREPARATION OF ANNUAL REPORT FOR
STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-1
WHEREAS, on August 2, 1983, by its Resolution No. 38-83, this City Council ordered
the formation of and levied the first assessment within the City of Dublin Street Lighting Maintenance
Assessment District ("the District") pursuant to the provisions of the Landscaping and Lighting Act of
1972 (commencing at Section 22500 of the California Streets and Highways Code) (hereinafter, "the
Act"); and
WHEREAS, Sections 22620 et seq of the Act provide for the levy of annual assessments
after formation of the District; and
WHEREAS, within said District, the existing and proposed improvements and any
substantial changes proposed to be made to the existing improvements are generally described as energy
and maintenance work for and to all street lights and acquisition of street lights within the City Limits of
the City of Dublin;
NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council does hereby
designate the Dublin City Engineer as Engineer for purposes of preparing and filing with the Clerk a
written report in accordance with Section 22565 et seq of the Act; said Engineer is hereby directed to
apportion said assessments in accordance to the benefits received from said improvements by the lots,
pieces and parcels of land within the District, and said Engineer is hereby directed to accomplish such
preparation and filing forthwith.

APPROVING PRELIMINARY ENGINEER'S REPORT,
CONFIRMING DIAGRAM AND ASSESSMENT
CITY OF DUBLIN STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-1
WHEREAS, by its Resolution No. 27-95, a Resolution Directing Preparation of Annual Report
for City of Dublin Street Lighting Maintenance Assessment District No. 83-1 (the "District"), this Council
designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing
in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report
in writing as called for in said Resolution No. 27-95 and under and pursuant to said Act, which report has been
presented to this Council for consideration; and
WHEREAS, said Council has duly considered said report and finds that each and every part of
said report is sufficient; and that said report neither requires nor should be modified in any respect;
NOW, THEREFORE, BE IT RESOLVED
a) That the Engineer's estimate of the itemized and total costs and expenses of the acquisition of
improvements and maintaining said improvements and of the incidental expenses in connection therewith, as
contained in said report be, and each of them are hereby preliminarily approved and confirmed;
b) That the diagram showing the assessment district, description of the improvements to be
acquired and maintained, and the boundaries and dimensions of the respective lots and parcels of land within
said District, as contained in said report be, and it is hereby preliminarily approved and confirmed;
c) That the assessment of the total amount of the cost and expenses of the proposed acquisition and
maintenance of said improvements upon the several lots and parcels of land in said District in proportion to the
estimated benefits to be received by such lots and parcels, respectively, from said acquisition and maintenance,
and of the expenses incidental thereto, as contained in said report be, and they are hereby preliminarily approved
and confirmed.

APPOINTING TIME AND PLACE OF HEARING PROTESTS
IN RELATION TO PROPOSED ASSESSMENTS
CITY OF DUBLIN STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-1
WHEREAS, by its Resolution No. 27-95, a resolution directing preparation of annual report for
City of Dublin Street Lighting Maintenance Assessment District (the "District") this Council designated the
City Engineer as Engineer of Work and ordered that Engineer to make and file a report in writing in accordance
with and pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report
in writing as called for in said Resolution No. 27-95, and under and pursuant to said Act, which report has been
presented to this Council for consideration; and
WHEREAS, said Council has duly considered said report and each and every part thereof, and
finds that each and every part of said report is sufficient;
NOW, THEREFORE, BE IT RESOLVED that a public hearing shall be held on July 25,
1995, at 7:00 p.m. at the Dublin Civic Center, 100 Civic Plaza, Dublin, California, at which time the City
Council will hear protests and will consider and finally act upon the Engineer's Report.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to give notice of said
hearing by the following means: publishing a notice once a week for two weeks in a local newspaper published
and circulated in the City, and conspicuously posting a notice at not less than three public locations, said
noticing to be completed at least ten (10) days prior to the date herein set for hearing or protests and action on
the Engineer's report.
BE IT FURTHER RESOLVED that said notices shall contain the following information: the
estimated assessment per parcel, the general description of the purpose or improvements the assessment will
fund, the address to which a protest may be mailed, and the date, hour, and place set for the above described
public hearing.

WHEREAS, on March 13, 1995, the City Council of the City of Dublin, California,
pursuant to the provisions of the Landscaping and Lighting Act of 1972, adopted its Resolution
Directing Preparation of Annual Report for Maintenance Assessment District 1983-1 for the
acquisition and maintenance of improvements more particularly therein described; and
WHEREAS, said Resolution directed the undersigned to prepare and file a report
pursuant to Section 22565, et. seq., of said Act;
NOW, THEREFORE, the undersigned, by virtue of the power vested in me under
said Act and the order of the Council of said City, hereby make the following assessment to cover
the portion of the estimated cost of acquisition of and maintenance of said improvements and the
cost and expenses incidental thereto, to be paid by said District.

As required by said Act, a diagram is hereto attached showing the exterior
boundaries of said street light maintenance assessment district and also the lines and dimensions of
each lot or parcel of land within said landscaping maintenance assessment district as the same
existed as of March 1, 1995, each of which lots or parcels having been given a separate number
upon said diagram.
I do hereby assess the net amount to be assessed upon all assessable lots or parcels of
land within said street light maintenance assessment district by apportioning that amount among the
several lots or parcels in proportion to the estimated benefits to be received by each such lot or
parcel from the acquisition and maintenance of said improvements, and more particularly set forth
in the list hereto attached and by reference made a part hereof.
Said assessment is made upon the several lots or parcels of land within said street
light maintenance assessment district in proportion to the estimated benefits to be received by said
lots or parcels respectively from the acquisition and maintenance of said improvements. The
diagram and assessment numbers appearing herein are the diagram numbers C!Ppearing on said
diagram, to which reference is hereby made for a more particular description of said property.
The scope of work includes the cost of energy and maintenance of street lights within the
City of Dublin. The scope of work shall also include the cost of purchase of street lights and/or the
repayment of any loans to the District obtained for the purchase of street lights.
Each lot or parcel of land assessed is described in the assessment list by reference to
its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year
1995-96 and includes all of such parcels excepting those portions thereof within existing public
roads or rights of way to be acquired in these proceedings for public road purposes. For a more
particular description of said property, reference is hereby made to the deeds and maps on file and
of record in the office of the County Recorder of said County. Because the names of the several
owners are unknown to me, I hereby place the word "unknown" opposite the number of each lot of
parcel of land assessed, the amount assessed thereon, and the number of the assessment.

METHOD OF APPORTIONMENT OF ASSESSMENT
The assessments shall be spread using a method of "factor rates" assigned to different land uses.
The establishment of the apportionment of a factor rate of" 1 " will be calculated by dividing the
total assessment of the year by the sum of factor rate numbers assigned wherein the factor rates are
assigned as follows:
