CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: April 24, 1995 SUBJECT: Initiation of Study to Establish Right-of-Way Lines Dublin Boulevard Between Hacienda Drive and the Easterly Access Road to the East Dublin BART Station. Report by: Public Works Director Lee Thompson EXHIBITS ATTACHED: 1) 2) Resolution Map and Legal Description RECOMMENDATION: Adopt resolution initiating study to establish right-of-way lines for Dublin Boulevard from Hacienda Drive to the easterly access road to the East Dublin BART Station. FINANCIAL STATEMENT: Staff time for processing the study is budgeted in the Engineering Operating Budget. The County Surplus Property Authority has contracted with the consulting firm of CH2M Hill to supply the technical documents needed. DESCRIPTION: As part of the Eastern Dublin Specific Plan, several proposed arterial streets were mapped in general alignment, and provision made for future specific plan lines to be adopted after further study. The proposed segment alignment for Dublin Boulevard between the easterly BART access road and Hacienda Drive is being proposed by the Alameda County Surplus Property Authority, in order that the utility extensions to the Homart site can be designed to fall within a planned roadway segment. Staff has been working with the Surplus Property Authority and their consultant to determine the best alignment for this roadway. The alignment is basically a straight line extension to the west from Dublin Boulevard along the Homart frontage, with a reverse curve near the BART Access Road to match at that intersection. Alameda County is working with the Army to obtain about 40 acres of land between the County property and the BART lot, and between Dublin Boulevard and 1-580. This new Dublin Boulevard alignment would become the northerly limit of the new parcel. At this time, it is proposed to only establish right-of-way lines for the basic roadway, as driveway locations for future development have not yet been determined. Any right-of-way that is needed for turn lanes in the future is proposed to be obtained in conjunction with development. Pursuant to the Dublin Municipal Code, the following steps must be taken to adopt specific right-of-way lines: 7.68.030 Initiation may be accomplished by: (A) petition of one or more affected property owners; (B) resolution of the City Council; OR (C) resolution of the Planning Commission. 7.68.040 The proposal is to be referred to the Planning Commission and the City Engineer for report and recommendation before any City Council action is taken. 7.68.050 The Planning Commission shall hold at least one public hearing regarding the proposed right-of-way line. The hearing shall be noticed at 7.68.060 7.68.070 7.68.080 7.68.090 7.68.100 least five days in advance of the hearing date by publication and posting the notice along the planned right-of-way. Upon receipt of a report from the Planning Commission, the City Council shall adopt a Resolution of Intention which designates the right-of-way lines to be established. The Resolution of Intention is to be published or posted at least 10 days prior to the date established for hearing objections to the proposal. The time for hearing objections to the proposal shall be not less than fourteen (14) days or more than thirty-five (35) days from the date of adoption of the Resolution of Intention. Any person having interest in any land upon which the right-of-way lines are proposed to be established may file a written objection at any time not later than the time set for hearing objections. At the time set for hearing, the City Council shall proceed to hear and pass on all protests or objections to establishment of the right-of-way lines. The City Council's decision is final and conclusive. Following the hearing of protests, the City Council may abandon the proceeding or deny the protests and adopt an ordinance establishing the right-of-way lines. Staff recommends that the City Council adopt the resolution initiating a study for the establishment of right-.of-way lines for Dublin Boulevard between Hacienda Drive and the easterly access road to the East Dublin BART Station. g: ldbxlrw1424init RESOLUTION NO. -95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN INITIATING STUDY FOR ESTABLISHMENT OF RIGHT-OF-WAY LINES DUBLIN BOULEVARD BETWEEN HACIENDA DRIVE AND THE EASTERLY ACCESS ROAD TO THE EAST DUBLIN BART STATION WHEREAS, as part of the Eastern Dublin Specific Plan, several arterial streets were proposed in general alignment and provision was made for adoption of future specific plan lines~ and WHEREAS, in order to facilitate the design of utility extensions to proposed development so that said utilities fall within planned right-of-way segments, the Alameda County Surplus Property Authority has requested that the City of Dublin adopt specific right-of-way lines for Dublin Boulevard between Hacienda Drive and the easterly access road to the East Dublin BART Station; NOW, THEREFORE, BE IT RESOLVED that, pumsant to Section 7.68.030 of the City of Dublin Municipal Code, the City Council does hereby initiate a study to establish specific fight-of-way lines for Dublin Boulevard between Hacienda Drive and the easterly access road to the East Dublin BART Station. BE IT FURTHER RESOLVED that the study area shall be as shown on the map and in the description attached hereto as "Exhibit A." PASSED, APPROVED, AND ADOPTED this 24th day of April, 1995.
