Request for initiation of a General Plan Amendment study for the
Shea Business Properties project located on former Southern Pacific
right-of-way south of the Arroyo Vista housing project and west of

RECOMMENDATION:
Adopt resolution initiating a General Plan Amendment study for the
Shea Business Properties project
FINANCIAL STATEMENT:
Costs for the study would be borne by the Applicant
DESCRIPTION:
Shea Business Properties is proposing to construct 209 apartments on a 8.9 acre property formerly owned
by the Southern Pacific Railroad Company. The property is located west of Dougherty Road, south o~
the Arroyo Vista housing project, and north ofM-1 zoned land accessed by Sierra Court and Trinity
Court.
The current General Plan designation of this site is "Medium Density Residential" which permits 6.1 to
14.0 dwelling units per acre and allows duplexes, townhouses, and garden apartment developments. The
applicant is requesting a General Plan Amendment to "Medium High Density Residential" which permits
14.1 to 25.0 dwelling units per acre. The project is proposing a density of23.5 dwelling units per acre.

The site was rezoned on June 26,1996, from M-1, Light Industrial, to PD Single Family as part of
the Trumark project.

The General Plan was amended on April 14, ] 996, from "Transportation Corridor" to "Medium
Density Residential" as part of the Trumark project. ~., .
Staff estimates that should the City Council authorize this Study, there would be no impacts to, or delays
of, other projects. The General Plan Amendment review would involve little Staff time or resources
beyond that necessary to process the Planned Development Rezone, Tentative Map, and Site
Development Review also associated with this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN
INITIATING A GENERAL PLAN AMENDMENT STUDY FOR THE SHEA BUSINESS PROPERTIES
PROJECT

WHEREAS, a General Plan Amendment Study initiation request has been made by Shea Business
Properties for a 8.9 acre parcel located west of Dougherty Road, south of the Arroyo Vista housing project, and
north of M~ I zoned land accessed by Sierra Court and Trinity Court.
WHEREAS, the existing General Plan land use designation proposed for the site is Medium Density
Residential and the proposed General Plan land use designation is Medium-High Density Residential; and
WHEREAS, the Applicant has stated that they would pay the processing costs for the General Plan
Amendment Study; and
WHEREAS, Section 65358 (a) ofthe State of California Government Code states that an amendment to a
general plan shall be in a manner specified by the legislative body; and
WHEREAS, the initiation request has been reviewed in accordance with the provisions of the California
Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of
the State CEQA Guidelines; and
WHEREAS, the Staff Report recommends that the City Council initiate a General Plan Amendment
Study for the Shea Business Properties project; and

WHEREAS, the City Council did hear and consider all said reports, recommendations and testimony
hereinabove set forth and is in support of initiating a General Plan Amendment study to determine the appropriate
land use and General Plan designation for the property before making a decision as to the merits of requested
specific entitlements.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby initiate a General Plan
Amendment Study for the Shea Business Properties project; and the Staff is authorized to retain consultant
services to complete necessary staff reports.
BE IT FURTHER RESOLVED that the Appl icant shall pay for all processing costs involved with the
General Plan Amendment Study.
PASSED, APPROVED, AND ADOPTED this 3rd day of June, 1997.
