DESCRIPTION: At the July 12, 1982 City Council meeting, Willian Tenery, Chairman
of'the Planning Commission, requested a joint meeting between the City Council and
Planning Commission to discuss planning responsibilities. He requested that the
July 3, 1982, memorandum from the Planning Director regarding "Areas of Responsibility-
City Council , Planning Commission, Staff" be provided.
The -areas of responsibility were established by State law and the County ordinances.
The following discussion briefly reviews the applicable laws and ordinances for
each area of planning responsibility.
General Plan: - The Planning Commission shall prepare the General Plan and the City
Council shall adopt it (Govt. Code Sec. 65300). The Planning Commission shall hold
a public hearing before approving the General Plan or any amendment to it (65351 ).
The City Council shall hold a public hearing before adopting a General Plan (65355)/
If the City Council makes any change to the General Plan not previously considered
by the Planning Commission, the change shall first be referred to the Planning
Commission (65356). The City Council shall adopt the General Plan by resolution,
(65357). A new City shall adopt a General Plan within 30 months following incorporation
(65302.5). It should be pointed out that General Plan issues would be identified
by the Commission. Subsequent to the identification of those issues, a draft
plan would be prepared by staff and/or a general plan consultant. That draft would
be revised or modified by the Planning Commission.

Zoning Changes on a Site or in the Ordinance: The Planning Commission shall hold
a public hearing on any amendment to the Zoning Ordinance (65854). The Planning
Commission shall give its recommendation to the City Council (65855). The City
Council shall hold a public hearing on the amendment (65856). If the City Council
makes any change to the recommended amendment not previously considered by the
Planning Commission, the change shall first be referred to the Planning Commission
(65857).
Subdivisions: A tentative map shows the design and improvements of a proposed sub-
division (66424.5). A final map shows the survey information, parcels, boundaries,
and other detailed information (66434). An advisory agency is a designated official
or an official body having the authority to approve, conditionally approve or dis-
approve maps (66415). The County subdivision ordinance designates the Planning
Director as the advisory agency for subdivisions (8-1 .3). Any action of the advisory
agency may be appealed to the City Council (Govt. Code Section 66452.5). The City
Council shall approve a final map if it conforms to the State Subdivision Map Act
and the local subdivision ordinance or, if it does not conform, disapprove the
map (66458).
Variances, Conditional Use Permits, Site Development Reviews: State laws regarding
zoning regulations are intended to provide only a minimum of limitation so that a
City may exercise maximum control over local zoning matters (65800). The County
Zoning Ordinance designates the Planning Director as the Zoning Administrator (8-23.8).
The Zoning Administrator shall act on variance applications (8-93.1 ) and conditional
use permit applications (8-94.1 ). The Planning Director shall act on site development
review applications (8-95.1 ). The Planning Commission shall hear appeals on alleged
errors in ordinance interpretation and site development reviews (8.92.0). The City
Council shall hear appeals on actions of the Planning Commission, Planning Dirrector
or Zoning Administrator (8-102.0) .
ALTERNATIVES: Staff has identified the following alternatives for City Council
consideration:
1 . Confirm existing areas of responsibility
2. Direct the Planning Commission to review Planning Director actions
on planning applications (variances, conditional use permits, site
development reviews, tentative maps, etc. ) for a three month period and
report back to the City Council .
3. Indicate changes in areas of responsibility and direct staff to draft
amendments to the ordinance as necessary.

The City Council has established the following areas of responsibility for
itself, the Planning Commission and the Staff.

- Subdivision final maps
- Appeals from administrative decisions
PLANNING COMMISSION
Responsible for recommendations on:
- General Plan issues
- Zoning changes
• - Ordinance changes
Responsible for acting on:
- Surface mining permits
- Alleged errors in ordinance interpretation
- Appeals of site development plan reviews
STAFF
Responsible for acting on:
- Tentative subdivision maps
- Site development plan reviews
- Private streets
- Variances
- Conditional Use Permits

This concept concentrates the efforts of the City Council and Planning
Commission on policy development. The Council and Commission will develop
the City's planning policies and programs.
The Staff is given the responsibility to implement the City's policies and
programs. All Staff decisions are appealable.
