Fire Station Located at the Santa Rita Jail

FINA..NCIAL STATEMENT:
There will be no additional direct costs for use of the Fire Station
located at the Santa Rita Jail. The agreement does provide,
however, that the City would provide fire services to the
immediately adjacent unincorporated area in exchange for the use of
the Fire Station facility.
DESCRIPTION: The Dougherty Regional Fire Authority currently has an agreement
with the County of Alameda for use of the Santa Rita Jail Fire Station.
As a result ofthe dissolution of the Dougherty Regional Fire Authority on July 1, 1997, it is necessary for
the City to secure a station facility in the eastern Dublin area to provide fire services.
The City Manager has negotiated an agreement with the Alameda County Fire Chief which is
substantially the same as the agreement that the Dougherty Regional Fire Authority had with the County.
The agreement is ongoing and provides that it may be terminated by either party 'with 24 months advance
written notice.
The use of this facility will enable the City to defer the construction of a permanent station into the future
until the development pattern in eastern Dublin is more established.
It is Staff's recommendation that the Council approve the agreement and authorize the Mayor to execute
the agreement.

AGREEMENT BETWEEN ALAMEDA COUNTY AND CITY OF DUBLIN
FOR THE USE OF FIRE STATION LOCATED AT THE SANTA RITA JAIL
This Agreement is entered into and dated for identification this day of February 1997 by and
between Alameda County, hereinafter referred to as the "County", and the City of Dublin, hereinafter referred to
as "City".
RECITALS
WHEREAS, fire protection and suppression services are currently provided within the jurisdictional limits of City
by the Dougherty Regional Fire Authority ("DRFA"), a joint powers agency; and
WHEREAS, DRFA will cease to exist on July 1, 1997; and
WHEREAS, City intends to provide fire protection and suppression services within the jurisdictional limits of City
commencing July 1, 1997 by contract with the Alameda County Fire Protection District ("District"), which is a
dependent special district of County;
WHEREAS, the County owns a fire station (Santa Rita Fire Station) located at the Santa Rita Jail, and
WHEREAS, City is capable of providing First Alarm Incident Response to the unincorporated areas adjacent to
the City' service boundaries, and;
WHEREAS, the County and City have agreed that in exchange for the use of the Santa Rita Fire Station, City will
provide to the County the services of one 3 person engine company for First Alarm Incident Response within the
unincorporated areas described in the map labeled Exhibit A.
AGREEMENT
NOW THEREFORE, in consideration of the premises and terms of this Agreement, it is hereby mutually agreed
between the parties hereto as follows:
1. City will provide one 3-person company for incident response within the unincorporated area shown in
Exhibit A.
2. City will respond to any incident requiring multiple engines with no fewer resources than the Alameda
County Fire Department would customarily use to respond to similar incident types within the
unincorporated area shown in Exhibit A. Alameda County Fire Protection District will provide the
necessary resources beyond the first engine company which is provided by City. The City will work with

the County to develop a coordinated response plan with the County Fire Department in order to provide
better service to areas within the City of Dublin and the unincorporated areas immediately adjacent to
the City in order to obtain the goal of a borderless response system where the closest units respond.
The County will provide those areas of the facility set forth below to the City for City's use and
occupancy at 12:01 a.m. on July 1,1997.
Any and all alterations City plans to make which alter the physical condition of the facility and those
minor improvements which do not alter the physical condition of the facility which may include, but are
not limited to, the installation of carpet, partitions, telephones, computer systems, communications
equipment and furnishings must receive written approval from Alameda County General Services
Agency and the Alameda County Fire Department. All efforts shall be made to complete the approvals
within 30 days of the request. Approval will not be unreasonably withheld.
City will provide supervisorial assistance to County which may consist of:
a. Logging OES personnel in and out of the facility.
b. Instruction of County personnel regarding activities that may impact City both in shared and
exclusive use areas of the facility.
County will not permit inmates in the facility except in the presence of the City's station supervisor.
The County and City will share the use of areas in the facility numbered 5, Physical Training, and 9,
Mezzanine, on the attached Exhibit B.
County and City will have exclusive use of the areas listed below on the attached Exhibit B as follows:

9. City will have the exclusive use of ten (10) parking spaces in the area located immediately west of the
facility.
10. Access to and from the facility will be in accordance with the Policies and Procedures contained in
Exhibit C.
11. City will perform basic domestic tasks, defined as the dusting, cleaning, and vacuuming of areas used
daily, associated with the housekeeping duties in both City's exclusive and shared use areas. The
County will perform basic domestic tasks in the County's exclusive use areas.
12. The County will provide basic utilities including electricity, gas, sewer, water and disposal services for
the facility. In addition, the County will perform Building Maintenance functions designed to retain the
building in a condition or good repair and maintain the efficient operation of the mechanical apparatus
and aesthetic areas associated with the facility. Building Maintenance will include, but not be limited to,
the regularly scheduled maintenance of the Heating Ventilation and Air Conditioning Unit (HVAC), and
preventative pest control. City shall perform carpet cleaning and the quarterly cleaning of the kitchen
facilities which will include the ovens, vents, stove tops, refrigerator, walls and cabinet faces.
City's use of the facility common areas shall be in compliance with the reasonable regulations issued by
the Fire Chief of the District.
If a death, serious personal injury or substantial property damage occurs in the performance of this
Agreement, each party shall immediately notify the other of such an occurrence.
Neither party is permitted to assign this agreement.
Each party shall keep the facility and common area as a drug~free workplace in accordance with County
policy.
Each party agrees that no person shall on the grounds of race, creed, color, disability, sex, sexual
orientation or national origin, age, Vietnam Veterans status, political affiliation, or any other non-merit
factors be excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under this Agreement.
Each party shall maintain policies of Comprehensive General Liability Insurance or shall be self-insured
for such coverages in the minimum amount of $1 ,000,000 in the performance of this Agreement.
Each party agrees to hold harmless, indemnify and to defend the other party, its City Council or Board of
Supervisors, officers and employees and servants from any and all claims, lawsuits, losses and
damages of every kind for injury or damage to persons or property arising out of or caused by such
party's negligence in performance of its obligations under this agreement.
Neither party shall have any liability for the direct payment of salaries, wages, or other compensation for
the other party's employees or contractors performing under this Agreement, nor shall either party be
liable for compensation of or indemnity to the other's employees from injury or sickness arising or
alleged arising out of such employees employment.
Employees of City's fire service provider stationed at the facility shall not be under the direct supervision
of any County department unless said County department is the City's Fire Service provider.
Both parties shall cooperate in order to achieve the purposes of this Agreement.

23. No compensation shall be paid by the County to City for City's services to County nor be paid by City to
County for City's occupancy and use of the facility; except as otherwise specifically provided in this
Agreement.

This Agreement shall be effective at 12:00 a.m. on July 1,1997 and shall continue from year-to-year
thereafter. It may be terminated by either party for its convenience upon twenty-four (24) months
advanced written notice given at any time. If both parties agree to an earlier termination date, the
Agreement shall be amended to so provide.
The foregoing "Recitals" are true and correct.

EXHIBIT C
Access Policy for City Employees and Employees of City's Fire Service Provider and guests at
the Santa Rita Jail Fire Station.
The following procedure will apply to persons wishing access to the Santa Rita jail Fire Station.
1. Employees of City and employees of City's Fire Service Provider will be admitted to the property upon
presentation at the west gate.
2. Visitors and guests will be admitted upon presentation at the west gate and upon approval of the City's
Fire Supervisor on duty.
3. In order to address security needs at the jail, this policy may be modified from time to time based on
mutually agreement of the Sheriff and City Manager.
