CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: April 24, 1995 SUBJECT: Municipal Dispute Resolution Consulting Services (Prepared by: Richard C. Ambrose, City Manager) EXHIBITS ATTACHED: Resume of Dr. David Stiebel RECOMMENDATION: I (l~./J:( .1. Authorize Mayor Houston, Councilmember Moffatt and City Manager Ambrose to participate in an effort to identify issues in common with the City of Pleasanton and the Dublin San Ramon Services District 2. Authorize the City Manager to execute an agreement with David Stiebel for mediation services. This authorization would be contingent upon the City of Pleasanton and the Dublin San Ramon Services District also participating in the agreement. FINANCIAL STATEMENT: The extent of services required by Dr. Stiebel is undetermined at this time; however, the Liaison Committees from Dublin/Pleasanton and Dublin San Ramon Services District are recommending that each agency authorize up to $2500 in consulting services, initially. There are sufficient funds in the City Council budget to fund this work. DESCRIPTION: The City of Dublin's Liaison Committee with the City of Pleasanton has been meeting to discuss issues of common concern to both agencies. In that a number of these issues also involve the Dublin San Ramon Services District, both liaison committees invited representatives from the Dublin San Ramon Services District to participate in the Pleasanton/Dublin Liaison Committee discussions. With the hope of improving the relationships between the respective agencies as well as clarifying and hopefully resolving some of the historical issues between Pleasanton and Dublin and the Dublin San Ramon Services District, the Liaison Committee participants are recommending that the cities authorize the engagement of a consultant who is experienced in mediating and assisting public agencies in resolving mutual concerns. Representatives from the three agencies have met with Dr. David Stiebel, an experienced municipal dispute resolution consultant, who has had considerable experience in working with agencies with similar issues. Since the amount of services required from Dr. Stiebel are unknown, it was agreed that the Liaison Committees would recommend that each agency authorize up to $2500 for consulting services and evaluate the progress of the consultant and the three agencies once that threshold has been reached. Any further work would need to be reauthorized by each agency. It is the recommendation of the Council Liaison Committee to Pleasanton and the City Manager that the Council authorize participation in this effort as well as authorize the City Manager to enter into an agreement with Dr. Stiebel not to exceed $2500" contingent upon the participation of the Dublin San Ramon Services District and the City of Pleasanton. As The Business Journal said, he is II an expert in negotiation strategies"--a nationally acclaimed specialist in municipal dispute resolution. A negotiator and mediator, Dr. stiebel has taught at 15 universities, including ue Berkeley and UCLA. His peers elected him (twice) president of the Society of Professionals in Dispute Resolution in San Francisco. Recent Experience Dr. Stiebel has worked on deadlocks over interagency feuds, budget battles, tax-sharing, interdepartmental fights, land use, labor issues, NIMBYs, permitting, redevelopment, annexations, council-staff friction, and EMF. Dr. Stiebel has consulted to the US Department of Labor, to teach labor and management how they can negotiate more effectively to prevent work stoppages. Dr. Stiebel has addressed conferences of the American Society for Public Administration (national and California chapters), Association of Bay Area Governments (seven times), Building Industry Association (twice), California Municipal utilities Association, California Special Districts Association, International City/County Management Association, and League of California Cities (seven times). At UCLA, in the first known study on whether teaching negotiation produces measurable results, Dr. stiebel increased negotiation performance scores 98%. publications Dr. Stiebel has been quoted and his analyses printed in over 40 publications, including the Los Angeles Times, San Francisco Chronicle, San Jose Mercury News, Public Management;, Western City, American City & County, Municipal Attorney, The Chief of police, City & State, and the publications of leagues of cities in nine states. He is the author or contributing author of three books, including Resolving Municipal Disputes: When Talking Makes Things Worse, Someone Won 't Negotiate, There's Nd Trust published by the Association of Bay Area Governments and Resolving Conflict published by the International City/County Management Association. Dr. Stiebel has also produced a League of California Cities audiocassette program on municipal dispute resolution.
