AGENDA STATEMENT CITY COUNCIL MEETING DATE: October 7,1997 SUBJECT: Review of a General Plan Amendment (GP A) Study (200 acre portion of the Nielsen Ranch) continued from the September 2, 1997 City Council Meeting (Report prepared by Eddie Peabody, Jr. Community Development Director) EXHIBITS ATTACHED: 1) Resolution 5.96 initiating a GP A study for Nielsen Ranch (January 21, J997) GP A Policy 2) RECOMMENDATI~ON: Direct staff to continue processing GPA for the Nielsen Ranch and to instruct staff to inform the applicant to complete necessary processing in accordance with the newly adopted GP A policy. . FINANCIAL STATEMENT: Applicant will need to make a deposit to cover anticipated staff review of their application DESCRIPTION: This matter was continued to this date by the City Council at its September 2, 1997 City Council meeting. Staffwas instructed to prepare a GPA Policy (earlier item on the agenda) and to discuss this Nielsen GPA request in light of this new policy. To date, the applicant has not commenced with required planning and environmental studies. If Council desires, instruct the applicant to proceed in accordance with the OP A Policy. A RESOLUTION OF THE CITY COD"NCa OF THE CITY OF DUBLlN * * * * * * * * * Th:TIl4.TING A GEI\'ERU PL,c\N' AME!\T})l\1ENT STIJDY FOR THE NIELSEN PROPERTY WHEREAS, a General Plan Amendment request has been made by Vmce Fletcher on behalf of Bud Nielsen, the Applicant for an approximately 200 acre parcel located west of the terminus of Brittany Drive and Brittany Lane. The predominant land use designation proposed for the site is residential; and WHEREAS, the Applicant has stated that they would pay the processing costs for the General Plan Amendment Study; and WHEREAS, the proposed project area is not within the City of Dublin's Western E>...""tended Planning A.rea an.d the Sphere of Influence; and ,,"'B.EREAS, Section 65358 (a) of the State of California Government Code states that an amendment to a general plan shall be in a manner specified by the legislative body; and WHEREAS, the initiation request has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of the State CEQA Guidelines; and . ,,"7ffEREAS, the StaifReport submitted one recommendation that the City Council initiate a General Plan Amendment Study for the :NIelsen Ranch project; and '\VHEREAS, the City Council did hear and consider all said reports, recommendations and testimony hereinabove set forth and is in support of a General Plan Amendment study to determine the appropriate land use and General Plan designation for the property before making a decision as to the merits of requested specific entitlements. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby initiate a General Plan Amendment Study for the Nielsen project; and the Staff is authorized to retain consultant services to complete necessary stafi'reports.' PURPOSE- From time to time, various applicants file requests for consideration of a General Plan Amendment for properties in the City and adopted sphere of influence. This policy identifies what is required of the applicant after a GPA study has been authorized and related time tables, REQUIRED ACTIONS BY GP A APPLICANT WITHIN 6 MONTHS OF AUTHORIZATION 1. Start Planning and Environmental Studies a) Determine what kind of project should be considered b) Begin environmental reconnaissance analysis of site c) Start land use feasibility of proposed uses and the benefits of the project to the City d) Contact staff about the applicant's planning team e) Begin discussing alternatives with staff f) Give staff a written montWy report on progress related to activity . 2. File a completed General Plan Amendment application and Environmental Checklist a) Prepare and submit application for a General Plan Change b) Complete environmental checklist regarding the proposed change c) Pay appropriate fees for staff review At the end of six months, staffwill return to the City Council to report on progress. Staffwill identify whether monthly written reports and/or GP applications have been filed in the past six months in accordance with 1 and 2 above, CITY COUNCIL ACTION AT 6 MONTHS REVIEW The City Council, by minute order, will direct staff to continue to process the affected GP A or will,rescind its previous action authorizing the GP A based on compliance with the steps identified above. . dated: October 7, 1997 g:corresp/ep/projspeclgpapol ic eXH!BIT l
