RECOMMENDATION: 4- Authorize the Mayor to sign the attached
letter (Exhibit A) to the Airport Land Use
Commission
FINANCIAL STATEMENT: None
DESCRIPTION:
The City of Livermore has established an Airport Protection Area
(APA) (Exhibit B) which prohibits new residential uses within its
boundaries in the City of Livermore. Livermore has asked the County
Airport Land Use Commission (ALUC) to include the APA in the Airport
Land Use Policy Plan and has supported that request with a report on
the APA prepared by McClintock, Becker and Associates . The boundary
of the APA would extend into the proposed Eastern Dublin Specific Plan
area and would adversely impact approximately 1, 000 dwelling units in
that plan (Exhibit C) .
The APA is intended to protect the airport from complaints of
residents of dwellings that could potentially be built within its
boundaries . The protection area generally follows the dimensions of
the existing flight pattern for the airport. The flight pattern
directs aircraft take-off paths over the location of the proposed
Eastern Dublin Specific Plan in order to avoid complaints from
residents of Pleasanton. The APA is a way for the airport to maintain
the existing take-off paths and flight pattern rather than revising
the airport master plan (which expires in 1995) to equitably share the
burden of take-off noise and overflights, as has been proposed by
Staff .
On November 17 , 1992 the Airport Land Use Commission met to
receive public testimony on the proposed APA and Draft Negative

Declaration. Mayor Peter W. Snyder made a presentation on the APA and
Dublin Staff reviewed the concerns of the City with the APA. Several
individuals from Livermore and the Pilots to Protect the Airport
recommended that the APA be approved by the ALUC in order to protect
the airport. Representatives of several landowners in the vicinity of
the airport recommended that the APA not be approved because it is
unnecessary, arbitrary and would cause opposition to the airport. The
ALUC heard a Staff report on the proposed APA and the Negative
Declaration, discussed the matter and continued the hearing until
January 13, 1993 .
Staff has several concerns which are included in the Draft
letter:
1 . The APA would allow for the expansion of the flight
operations at the Livermore Municipal Airport beyond that authorized
by the Livermore Airport Master Plan and its environmental impact
report. The Negative Declaration for the APA prepared by ALUC Staff
does not address the environmental impacts of the increase in flight
operations beyond that analyzed in the previous EIR and is therefore
inadequate. An EIR for the APA should be prepared.
2 . There is no factual justification in the McClintock, Becker
report for an APA or its extent based on accident distribution, noise
complaints, noise contours from overflights and individual
overflights .
3 . Flights are intentionally routed over the location of the
proposed Eastern Dublin Specific Plan in order to minimize complaints
from already developed areas rather than distributed equitably.
Development in Eastern Dublin should not be restricted in order to
maintain the existing arbitrary flight pattern.
Staff proposes that a committee be established made up of elected
officials and staff of the cities of Dublin, Livermore and Pleasanton
and the County of Alameda to cooperatively update the Airport Master
Plan.
Staff recommends that the City Council authorize the Mayor to
sign the attached Draft letter (Exhibit A) to the Airport Land Use
Commission to express its concerns with the proposed APA and proposing
an alternative course of action.

SUBJECT: Comments on the proposed Livermore Airport Protection Area
and Negative Declaration
Dear Members of the Commission:
Thank you for the opportunity to comment on the proposed Airport
Protection Area (APA) and Negative Declaration and for the cooperation
of your Staff . The purpose of this letter is to express the concerns
of the City of Dublin with the proposed APA and Negative Declaration.
ENVIRONMENTAL REVIEW
The APA would allow and facilitate the expansion of the number of
flight operations of the Livermore Airport resulting in potentially
significant environmental impacts on the Cities of Livermore and
Pleasanton. The McClintock, Becker report states that the number of
daily operations at the airport is projected to increase from 232,930
at present to 420,700 by the year 2011 . The Livermore Airport Master
Plan which expires in 1995 envisioned a cap of 340,000 flight
operations .
The Negative Declaration prepared by your staff for the proposed
APA states that there is sufficient airfield capacity to accommodate
the forecasted demand at the airport through the year 2011, and no
amendment to the 1975 Master Plan would be required for the forecasted
growth to be realized. The City of Dublin contests this assertion.
The environmental review for the Livermore Airport Master Plan only
addressed the impacts of a maximum of 340, 000 flight operations . Yet,
the Negative Declaration asserts that 420,700 flight operations could
be accommodated without amending the Livermore Airport Master' Plan,
and we presume, additional environmental review. Such an increase
would have potentially significant noise and safety impacts on
existing housing units in the cities of Livermore and Pleasanton.
These impacts should be analyzed in an Environmental Impact Report.

AIRPORT PROTECTION AREA
1 . There is no factual justification in the McClintock, Becker
report for an APA or for the extent of the proposed APA:
A. Accident distribution statistics in the report show a
concentration of accidents near the runway and not in
Eastern Dublin, north of I-580 .
B. Noise complaints are concentrated near the airport runway.
An analysis of Exhibit IV-3 of the report shows that 93% of
the complaints occurred in a band 3, 600 feet north and south
of the runway. No residential land uses are proposed in
Eastern Dublin within 3, 600 feet of the runway so it is very
unlikely a significant amount of noise complaints would
arise from residences which would all be located further
away from the runway.
C. The 65dB CNEL contour recognized by the State Department of
Transportation as the threshold of compatibility for
residences and schools lies well south of I-580 in the year
2011 and will not impact any residential land uses in
Eastern Dublin. The proposed use of the much more
restrictive 60dB contour would be arbitrary and exceed the
State standard.
2 . Exposure to single event overflights by corporate jets will occur
over a far greater area than the proposed APA. Occasional
irritation and isolated complaints are not justifications for an
APA.
3 . Flights are intentionally routed over Eastern Dublin to minimize
complaints from already developed areas rather than distributed
equitably over the Dublin, Livermore and Pleasanton area.
Development in Eastern Dublin should not be restricted in order
to simply maintain the existing arbitrary flight pattern.
ALTERNATIVE TO THE APA
The proposed APA is not the appropriate method to address noise
and safety impacts and complaints regarding aircraft operations .
Instead, the Livermore Airport Master Plan (which is due to expire in
1995) and the Airport Land Use Policy Plan should be updated to
address these potential concerns . This should be done in cooperation
with the cities of Dublin and Pleasanton and Alameda County as opposed
to Livermore seeking to unilaterally apply an APA. i

A Regional Airport Advisory Committee was established in ;1988 by
the cities of Livermore and Pleasanton in order to foster inter-city
cooperation. The Advisory Committee could be used as a model for a
new Committee made up of the cities of Livermore, Pleasanton and
Dublin and the County of Alameda. The committee could cooperatively
update the Airport Master Plan to include:
1 . A revised flight pattern which equitably distributes the burden
of overflights and uses airspaces over highways and commercial
and industrial areas for take-off and landing flight tracks.
2 . Avigation easements purchased from landowners most severely
impacted by the airport.
3 . Placing limitations on the hours of operation of certain types of
noisy aircraft.
4 . Construction standards which attenuate noise.
The Dublin City Council appreciates your consideration of these
comments . We request that the Airport Land Use Commission deny the
request of the City of Livermore to include the proposed Airport
Protection Area in the Airport Land Use Policy Plan. The proposed APA
is unneccesary, without factual support and arbitrary. Furthermore,
we request that you recommend the establishment of a committee to
revise the Livermore Airport Master Plan in a manner which is
acceptable to all parties .
