HomeMy WebLinkAbout9.2 Bldg Law Enforce Contract Evaluation CITY OF DUBLIN �000-3o AGENDA STATEMENT CITY COUNCIL MEETING DATE: August 26, 1985 SUBJECT Building Law Enforcement Services Contract Evaluation and Agreement Amendment EXHIBITS ATTACHED Memorandum from City Manager dated August 22, 1985; Agreement; Amendment to Agreement; Evaluation Form; Letter from Vic Taugher dated August 21, 1985 RECOMMENDATION 1 ) Review performance of Taugher & Associates 2 ) Approve amendment to agreement and authorize Mayor to execute said agreement FINANCIAL STATEMENT: Total 1984-85 Contract Costs - $162, 082. 63 Modest increases in the hourly rate for the Building Official and Building Inspector are proposed for Fiscal Year 1985-86 DESCRIPTION On August 1, 1983, the City entered into an agreement with Taugher & Associates for the provision of Building Law Enforcement Services which included: Plan Review, Building Inspection, Zoning Enforcement and Housing Code Enforcement. As is customary with other City contracts, the City annually reviews the performance of the contract service. In order to facilitate the evaluation, the City Manager ' s Office has prepared the attached memorandum evaluating the performance of Taugher & Associates, and has also included an evaluation form for the City Council to use in its evaluation of the contractor' s performance. The City' s present agreement with Taugher & Associates also provides for an annual reviw of rates. Mr. Taugher has proposed the following rate increases for the period beginning August 1, 1985 and ending July 31, 1986 . In accordance with the contract, Taugher & Associates is required to name the City as an additional insured on its insurance policy. The insurance premium for the Building Official increased from $2, 719 to $28,562 for 1985. In addition, the Building Official ' s deductible increased from $1, 000 to $25, 000. Based on the number of hours worked by the Building Official last year, the cost to the Building Official of purchasing this insurance is approximately $22. 00 per hour for the upcoming year as opposed to approximately $2 . 00 per hour last year. Mr. Taugher had originally requested a $2. 00 increase in his hourly rate prior to receipt of his insurance premium renewal. ---------------------------------------------------------------------------- COPIES TO: Taugher & Associates ITEM NO. 6?, -\- AGENDA STATEMENT: Building Law Enforcement Services Contract Evaluation and Agreement Amendment Page 2 He requested an additional $1.00 be added to his hourly rate raising the rate from $62.00 to $65. 00, after he received notice of his insurance premium increase. The insurance for the Building Inspector increased from $1,700 to $5, 000. Mr. Taugher had originally requested an increase of $1. 50 to the Building Inspector' s rate prior to receipt of the insurance renewal premium. He is now requesting that it be increased an additional $ . 50, increasing the rate for the Building Inspector from $38. 50 to $40. 50. The rates proposed by Taugher & Associates will not cause the cost of service to exceed the existing fees received by the City. Based on the circumstances experienced in todays insurance market, and the performance of Taugher & Associates during the last year, the rates proposed appear more than reasonable. Recommendation It is therefore Staff ' s recommendation that the City Council review the performance of Taugher & Associates and approve an amendment to the agreement with Taugher & Associates reflecting the new rates for Fiscal Year 1985-86. It is further recommended that the Council authorize the Mayor to execute said agreement. M E M O R A N D U M TO: City Council FROM City Manager SUBJECT: Building Law Enforcement Services Contract Evaluation DATE: August 22, 1985 Taugher & Associates has been providing Building Law Enforcement Services to the City of Dublin since August 15, 1983.. Services provided by Taugher & Associates include: Plan Review, Building Inspection, Zoning Enforcement and Housing Code Enforcement. In the opinion of the City Manager, these services have been performed in accordance with the contract. As was the case last year, the contractor has provided sufficient permanent personnel and back-up personnel to be available to City Staff, the public and other users of Building & Safety Department Services. The City Manager' s office has not received any complaints regarding the lack of responsiveness of contract personnel related to plan review or inspection. Only one complaint has been received regarding the coordination of fire inspection and building inspection which was related to building code violations, which existed in a commercial building.. During the latter part of Fiscal Year 1984-85, Taugher & Associates hired a zoning investigator to provide 60 hours of zoning investigation per month. This increased the amount of time available for zoning investigation at a lower per unit cost .and increased the amount of time needed by the Building Inspector to keep pace with increased construction activity. The work performed by the zoning investigator has been done in a courteous and professional manner. Due to the controversial nature of the service, complaints are generated. These complaints are primarily related to the enforcement of the ordinance and on occasion, the strict interpretation by the Planning Department of the Zoning Ordinance. However, no complaints have been received regarding the professionalism or lack of public relations exhibited by the Department. With respect to productivity, during Fiscal Year 1984-85, the Department handled considerably more work than during Fiscal Year 1983-84, as evidenced by the 1984-85 Activity Report included with Vic Taugher' s letter of August 21, 1985 ( see attached) . The Department issued 55% more permits and conducted 154% more inspections than in 1983-84. During. the year, the Department finaled 277 dwelling units. It is particularly noteworthy that the inspections/hour have increased by 8% as a result of last year' s evaluation at which time it was recommended that the Building Inspector' s Office hours be adjusted.. With respect to zoning investigation, the Department received 40% more cases and closed 58% of those cases. This is the same closure rate as 1983-84. Total hours/case dropped 17%. The cost of services provided by Taugher & Associates during 1984-85 is broken down as follows: TAUGHER & ASSOCIATES 1984-85 COST FOR SERVICE Service Administration $ 13, 012. 50 Building Regulation 73,687. 73 Plan Review 55, 696. 50 Housing Code Enforcement 293. 00 Total Building & Safety Contract Cost $142, 689. 73 Zoning Enforcement 19, 392. 90 Total Taugher & Associates Contract Cost $162, 082. 63 Page 1 2 In addition to the cost of services provided by Taugher & Associates, the City also incurred the following direct costs related to the support of the Building & Safety function: Personnel Services $ 24, 299 Services & Supplies 4, 745 Capital Outlay 1, 816 Total Support Costs $ 30, 860 The total costs attributable to the Building & Safety function, including the Taugher & Associates contract and support cost is as follows: Taugher & Associates Building & Safety Services $142, 689. 73 Support Services 30,860. 00 Total Building & Safety Services $173 , 549. 73 For Fiscal Year 1984-85, the cost for services was less than the permit fees received by the City, as illustrated below: Revenue $ 321,193. 00 * Costs 173 , 549. 73 * Difference $ 147, 643.27 * * These figures are unaudited. Although it appears that the City has received substantially more revenue than it has incurred in cost, the cost for major projects are often incurred well after the receipt of fees. During the last two months of 1984-85, the City received building permit fees from San Jose Financial Single Family Homes, Arbor Creek Condominiums, Estate Homes, Kaufman & Broad Homes and Automation Electronics totalling $87, 713 . The inspection services on these projects occurred after June 30, 1985. Subtracting these fees from the total Building Permit Fees results in an adjusted total of $233,480, as shown below: 1984-85 Fees $ 321, 193 Less Major Projects 87, 713 Adjusted Fees $ 233 , 480 Taugher & Associates Contract Building & Safety Costs $142, 689. 73 = 61% 1984-85 Fees (Less Major Projects ) $233, 480. 00 Total Building & Safety Costs * $173, 549. 73 = 74% 1984-85 Fees (Less Major Projects) $233, 480. 00 * Does not include general overhead costs, i.e. , rent, telephone, etc. The ratio of cost to fees collected in 1984-85 compares favorably to 1983- 84. Last year, contract costs represented 67% of fees collected (adjusted for late major projects) , and total Building & Safety costs represented 89% of fees collected (adjusted for late major projects) . As evidenced by the above figures, the fees charged by Taugher & Associates have remained within the building permit fee structure, which has not changed since incorporation. It is also important to note that the contract cost/inspection has decreased as well as the contract cost/closed case. In conclusion, the service provided by Taugher & Associates during 1984-85 has been professional, of high quality and cost effective. Page 2 AMENDMENT TO AGREEMENT BETWEEN CITY OF DUBLIN AND TAUGHER AND ASSOCIATES FOR BUILDING LAW ENFORCEMENT SERVICES WHEREAS, the City of Dublin (hereinafter referred to as "City" ) , and Taugher and Associates (hereinafter referred to as "Building Official" ) , first entered into an agreement on August 1, 1983 to provide Building Law Enforcement Services to the City of Dublin; and WHEREAS, the fees established in Exhibit A of ' the original agreement were to be annually reviewed and adjusted as mutually agreed upon by the Building Official and the City; and WHEREAS, an adjustment of fees for services has been made by the City on August 1, 1984 for Fiscal Year 1984-85 services and on May 13 , 1985 for the services of the new Zoning Investigator; and WHEREAS, an adjustment of fees for services rendered is desired . by both the City and Building Official. NOW, THEREFORE, the parties hereto agree as follows: Section 1: Adjustment of Rates The Taugher and Associates hourly rate schedule (Exhibit A) shall replace the rate schedule which was adopted by the Council and became effective May 13 , 1985. The change in rate shall be effective August 1, 1985 and shall continue in effect until rescinded or amended by the City Council, according to the provisions of the agreement. The rates will be adjusted thereafter annually, as mutually agreed upon by the Building Official and the City of Dublin. In the event that the Building Official is requested to perform services in excess of forty ( 40 ) hours in any one ( 1) week, or in the event that there is an emergency requirement for the services of the Building Official and the City is reimbursed for said services, the Building Official shall be compensated at 12 times the above hourly rates. Standard rates will apply for Building Official ' s attendance at Planning Commission and City Council meetings. * Supervision duties include review and coordination of work performed by Inspectors and clerical support staff. Administrative duties include City Council and Commission meeting attendance when requested, meetings with applicants and developers, inter-agency coordination and coordination with Staff, development of office procedures, operations, etc. AGREEMENT FOR BUILDING LAW ENFORCEMENT SERVICES THIS AGREEMENT is made and entered into this 1st day of August 1983 , by and between the City of Dublin, a municipal corporation, hereinafter referred to as the "City" , and Taugher & Associates, an Individual, hereinafter referred to as the "Building Official" . W I T N E S S E T H WHEREAS, the Building Official has submitted to the City a proposal to provide building law enforcement services to the City; and WHEREAS, the City has determined that it is advantageous and in the best interest of the City to enter into the Agreement hereinafter set forth; NOW, THEREFORE, in consideration of the mutual promises, conditions and covenants herein contained, the parties agree as follows : 1 . Building Inspection Services . Building Official shall enforce the provisions of the City' s Building, Electrical, Plumbing, Mechanical and Housing Codes ; the City' s Zoning Ordinance; and related State laws . Building Official shall make such inspections and investigations as may be required to effect such enforcement and issue permits as are required by City' s Ordinances and Codes . Such enforcement shall include the duties as set forth in the Ordinance of the City for the Building Official and in the performance of such work, the employees of the Building Official shall do the following: a. Plan Review. Building Official shall review the plans prepared by or on behalf of private 'developers for compliance with applicable State and City ordinances and regulations . Building Oficial shall maintain close liaison with the City ' s Planning Director in order that the appropriate .requirements of the Zoning Ordinance are incorporated within such building plans . Building Official shall arrange review by other appropriate agencies having jurisdiction in such matters relative to enforcement of fire codes, sanitation codes and health codes . When satisfied that the appropriate requirements of the City' s codes have been met, Building Official shall issue permits as set forth in such codes . b . Building Inspection. Building Official shall provide building inspection service during the course of construction of private facilities to enforce compliance with the provisions of the applicable State and City ordinances and regulations set forth on the plans for which the permit is issued. In the performance of such duties, Building Official shall provide prompt inspection for each project at the completion of the various stages of construction to determine compliance. C . Zoning Enforcement. Building Official shall provide enforcement of all aspects of the City' s Zoning Ordinance and .will make all necessary investigations and follow-up inspections to assure compliance with the Zoning Ordinance and the conditions cf approval of various variances, conditional use permits , site reviews and other zoning approvals . Enforcement will include preparation of cases for citation hearings and criminal proceedings in municipal court. Building Official shall perform other activities as directed by the City. d. Housing Code Enforcement. Building Official shall enforce the City ' s Housing Code by investigation of complaints regarding sub-standard housing ccnditions and where necessary, prepare cases for citation hearings, criminal proceedings in municipal court, and civil abatement proceedings . Building Official shall perform other activities as directed by the City. Page 1 e. Facilities for Records . The City shall provide an office for conducting the duties set forth in this Agreement, and shall provide necessary furnishings, telephone, permit forms and codes . Within this office, Building Official shall assemble such records customarily maintained by a City Building Department. Such records shall, at all times, be the property of the City. 2 . Ccllection of Fees . All fees to be collected in connection with the carrying out of the functions set forth above, shall be collected by the City. Building Official shall review the appropriate ordinances and fee schedules in effect by the City, and shall compute the amount of such fees to be collected by the City. 3 . Compensation to Building Official . Building Official shall be compensated monthly for services rendered in accordance with the schedule contained on Exhibit "A" which is attached hereto. 4 . General Conditions . a. Avoidance of Conflicts . During the life of this Agreement, Building Official shall not provide services to any client for a project which requires any permit or approval from the City. b . Compliance with Laws . Building Official, his agents and employees, shall comply with all laws, ordinances, rules and regulations of the State, County, the City of Dublin, and all governing bodies having jurisdiction applying to work done or to be done under the Agreement. C . Insurance -and Indemnification. Building Official shall assume liability and pay all costs of defense, including legal fees and court costs , and hold the City harmless from loss, damages, costs or expenses caused by any negligent or wrongful acts , errors, or omissions of Building Official ' s officers, employees and agents which may occur in the performance of the terms , duties and obligations of this Agreement. Building Official shall provide a certificate of insurance to the City, to be included as part of this Agreement, which will give evidence of general liability insurance of not less than $1, 000 , 000 .00 for personal injury, accidental death and property damage; and further provide to the City a Certificate of Insurance, which gives evidence of automobile liability insurance coverage of not less than $1, 000, 000 . 00 for personal injury and accidental death, and $50, 000 .00 for property danage per occurrence. City shall be named as an additional insured in any such liability insurance policy. Building Official shall pay all premiums for said insurance . Building Official shall also provide the City with a certificate of insurance, to be included as part of this Agreement, which will give evidence that Building Official ' s employees are covered by worker ' s compensation insurance. All certificates of insurance which are a part of this Agreement shall be approved by the City Manager and City Attorney as to form and content. d. Assignability. Building Official shall not assign this contract without prior written consent of the City. e . Clerical Support. City agrees to provide adequate clerical support to the Building Department function as mutually agreed upon by City and Building Official . f . Subcontractor. The name, background and experience of any and every firm to which any work outlined in these specifications is to be sub-contracted by the person or firm to which the prime agreement is awarded must be submitted to the City Manager for his approval . Unless a sub-contract is approved by the City Manager, the holder of the prime agreement must do all the work outlined in these specifications , using his own equipment and personnel . It must be clearly understood that the holder of the prime agreement, Page 2 irrespective of any approved sub-contract, will be held entirely responsible for the quality and quantity of work to be done under the terms of the agreement. No sub-contract to do any work outlined in these specifications is to run longer than one year, and the extension or renewal of any such sub-contract agreement can only be made with the approval of the City Manager. The agreement will not be assignable in whole or part, without the express written approval of the City Manager. 5 . Responsible Individual . The individual directly responsible for the performance of the duties of Building Official as hereabove set forth shall be Victor L. Taugher, a California Registered Civil Engineer, License #9556, and Fire Protection Engineer License #911. Upon mutual agreement and direction of the City Manager, Building Official may substitute other individuals in the above capacity as responsible individual . 6 . Term of Agreement. a. Term of Agreement. This Agreement shall be effective until terminated. This Agreement may be cancelled by the City, upon thirty (30 ) days advance written notice. This Agreement may be cancelled by Building Official upon ninety (90) days advance written notice . b. Notices . NOW, THEREFORE, the parties hereto agrees as follows : Section 1 : The agreement first entered into on August 1, 1983 to provide Building Law Enforcement to the City of Dublin is amended to substitute "laugher and Associates, Inc . , a California Corporation" for "Taugher and Associates an individual" . Section 2 : Taugher and Associates Inc . hourly rate ..schedule (Exhibit "A" ) shall replace the previously denoted as Exhibit "A" in the Agreement adopted on August 1, 1983 and amended effective August 1, 1984 . The attached activity report indicates the increase . Highlights of the year have been: 1 ) Substantial completion of 555 units in Amador Lakes . 2 ) Substantial completion of 79 units in Heritage Commons . 3 ) Continuation of the Estaste Homes Project with 77 dwellings given final inspection this year. 4 ) Completion of 11 dwellings on Shannon Court. 5 ) Completion of Shamrock Chrysler and Valley Datsun auto dealerships . 6) Completion of the shopping center at Dublin Boulevard and Regional Street. The following major projects are underway: 1) 77 room addition to the Howard Johnson Hotel . 2 ) 3 buildings in the Town & Country Shopping Center. 3 ) 11 industrial buildings by Bedford on Sierra Court. 4 ) An office for Automation Electronics . 5 ) 84 units in Arbor Creek. 6 ) 13 dwellings by San Jose Financial on Rhoda Court. 7 ) 6 dwellings on Hansen. 8) Continuation of the Estate Homes Project. 9 ) Completion of 3 model homes by Kaufman & Broad and the beginning on the balance of the 80 units . In addition, two major projects have been checked and are about to be issued; the Great Western Savings at Dublin Boulevard and Golden Gate, and the KB Shopping Center on Dublin Boulevard next to Great Western Savings . Productivity has increased. Inspections per hour are up 8% . Finally, as last year, the revenue has been far in excess of the cost of services provided. Mr. Richard Ambrose, City Manager August 21, 1985 Page 2 On May 15, 1985, a part-time Zoning Investigator was employed. While it is too early to evaluate the effectiveness of this added position, it appears that the backlog of cases pending will be substantially reduced. Here again productivity is up. The hours per case has been reduced by 17% . The Housing Code Enforcement activity is a very small portion of the Building Law Enforcement program. While the statistics are favorable they have little effect on the overall program. It is proposed to combine these statistics with the Building Regulation Program in the the next year. During the past year the following additional specific items have been accomplished: 1 . An ordinance adopting the 1984 National Electrical Code has been developed and adopted by the City Council . 2 . An ordinance adopting State Regulations for Access to buildings for the handicapped has been prepared and adopted. 3 . An ordinance relating to imposing additional requirements for fire sprinklers has been prepared and adoption is pending. 4 . An ordinance regulating storage of hazardous materials has been prepared and is awaiting typing. In closing I want to express my appreciation to you and the City Council for the support received. It is gratifying to know that the City of Dublin supports strong enforcement of Building Regulation and the Zoning Ordinance. Victor L.
