Regular Meeting
A Regular Meeting of the Dublin City Council was held on Tuesday, July 20, 2021, in
the City Council Chamber and via Zoom Communications. The meeting was called to
order at 7:00 PM., by Mayor Hernandez.

The City Council received the presentation on the “To Dublin with Love” and “To
Tri-Valley with Love” local recovery campaigns from Visit Tri-Valley CEO, Tracy
Farhad.
3.2)Acceptance of Donation from McCreary Family Foundation and
Recognition of Paul McCreary

The City Council accepted a donation of $50,000 from the McCreary Family
Foundation and announced that the outdoor sports pool at The Wave will be
named after Paul McCreary to honor his years of service to the community.

The City Council received the presentation previewing the upcoming Splatter
event on September 18, 2021 at Emerald Glen Park.

The City Council welcomed the new City of Dublin interns, Raymond He with

4.4)Confirmed the Mayor’s recommendation of Mayor Hernandez and
Councilmember McCorriston as the 2021 Ad-Hoc Audit Review Committee.
4.5)Adopted Resolution No. 88-21 titled, “Approving the Agreement with All City
Management Services, Inc. for the Provision of Crossing Guard Services for
Fiscal Year 2021-22.”
4.6)Waived the second reading and adopted Ordinance No. 05-21 titled, “Approving
Amendments to the Planned Development Zoning Stage 1 Development Plans
for 2.5 Acres on the GH PacVest Property and 2.0 Acres on the East Ranch
property in Fallon Village, and the Emerald High School Site in Dublin Ranch.”
4.7)Waived the second reading and adopted Ordinance No. 06-21 titled, “Amending

4.15)Adopted Resolution No. 92-21 titled, “Approving Agreements for On-Call
Financial Consulting Services with Fieldman, Rolapp & Associates and
Goodwin Consulting Group.”
4.16)Approved the Second Amendment to the Amended and Restated Agreement for
Legal Services and appointed Jordyn Bishop as the Assistant City Attorney.

4.3) Informational Report on the Human Rights Campaign Municipal Equality
Index
Item 4.3 was pulled from the Consent Calendar by Vice Mayor Kumagai for
further discussion.
The City Council commended Staff for their time and efforts on the report. The
City received a score of 84 out of 100 in the 2020 Municipal Equality Index.
On motion by Vice Mayor Kumagai, seconded by Councilmember Josey, and by
unanimous vote, the City Council approved the Informational Report on the
Human Rights Campaign Municipal Equality Index.

Item 4.11 was pulled from the Consent Calendar by Vice Mayor Kumagai for
further discussion.
The City Council directed Staff to invite members of the Muslim community to
attend the August 17, 2021 City Council meeting to receive the Proclamation.
On motion by Councilmember Josey, seconded by Mayor Hernandez, and by
unanimous vote, the City Council approved the proclamations for the month of
August in the City of Dublin: National Night Out and American Muslim
Appreciation and Awareness Month.

6.1)Outdoor Seating Zoning Ordinance Amendments and Master Fee
Schedule Amendments (PLPA-2021-00024)
The City Council received a presentation on City-initiated amendments to the
Zoning Ordinance to facilitate outdoor seating for eating and drinking
establishments on both a long-term temporary and permanent basis to aid in
economic recovery post-COVID-19.
Mayor Hernandez opened the public hearing.

By motion of Vice Mayor Kumagai, seconded by Councilmember Josey, and by
unanimous vote, the City Council waived the reading and INTRODUCED the
Ordinance Approving Amendments to Dublin Municipal Code Section 8.12.050
(Permitted and Conditionally Permitted Land Uses), Section 8.76.080 (Parking
Requirements by Use Type), Section 8.104.030 (Site Development Review
Waiver), and Section 8.108.020 (Uses Permitted with a Temporary Use Permit),
and Adopted Resolution No. 93-21 titled, “Amending the Master Fee Schedule
by establishing two new application fees, based on time and materials, for

Temporary Use Permit – Outdoor Seating and Site Development Review
Waiver – Outdoor Seating, which are valid until the City’s applicable American

6.2)Energy Services Agreement Amendment with Willdan Energy Solutions
for Efficiency and Infrastructure Improvement Projects and Consideration
of a Financing Plan
The City Council received a presentation and asked clarifying questions on the
implementation of energy efficiency and related infrastructure improvement
projects, an amendment to the design-build energy savings performance
contract with Willdan Energy Solutions, the issuance of tax-exempt bonds to
fund the projects, and allowing the City to be reimbursed for expenditures on
the projects prior to the issuance of bonds.
Mayor Hernandez opened the public hearing.
Upon receiving no public comment, Mayor Hernandez closed the public
hearing.
By motion of Councilmember Hu, seconded by Councilmember Josey, and by
unanimous vote, the City Council adopted Resolution No. 94-21 titled, “Making
Findings Required Under Government Code Sections 4217.10-18 and
Approving an Amendment to the Design-Build Energy Savings Performance
Contract with Willdan Energy Solutions for Energy Reduction, Core Facility
Infrastructure, and Resiliency Upgrades Projects.” and adopted Resolution No.
95-21 titled, “Declaring Intention to Reimburse Expenditures from the Proceeds
of Certain Tax-exempt Obligations and Directing Certain Actions.”

7.1)Consideration of a Resolution Authorizing the Issuance of Special Tax
Bonds for and on Behalf of the City of Dublin Community Facilities
District No. 2015-1 (Dublin Crossing), Improvement Area No. 3 and
Approving Form of and Execution of Related Documents
The City Council received the report on the third phase of special tax bond
financing for Community Facilities District No. 2015-1 (Dublin Crossing) and the
use of the bond sale proceeds to finance authorized public capital facilities and
public capital facility impact fees.
By motion of Councilmember McCorriston, seconded by Vice Mayor Kumagai,
and by unanimous vote, the City Council adopted Resolution No. 96-21 titled,
“Authorizing the Issuance of Special Tax Bonds For and On Behalf of the City of
Dublin Community Facilities District No. 2015-1 (Dublin Crossing), Improvement
Area No. 3; Approving the Form and Authorizing the Execution of a Fiscal Agent
Agreement, A Purchase Contract and a Continuing Disclosure Certificate and
Authorizing the Sale and Delivery of Special Tax Bonds Pursuant to Said
Purchase Contract; Approving the Form and Delivery of a Preliminary Official
Statement and the Preparation and Distribution of a Final Official Statement to
be Derived from the Preliminary Official Statement; and Approving Execution
and Delivery of Other Documents and Taking of Actions as Necessary to
Implement the Issuance, Sale and Delivery of the Bonds.”

The City Council received the presentation on two new small business support
grant programs (Commercial Rent Relief and Outdoor Operations) using
American Rescue Plan Act funding.
By motion of Councilmember Josey, seconded by Vice Mayor Kumagai, and by
unanimous vote, the City Council adopted Resolution No. 97-21 titled,
“Approving the Commercial Rent Relief Grant Program and Outdoor Operations
Grant Program.”

The City Council and Staff provided brief information-only reports, including
committee reports and reports by City Council related to meetings attended at
City expense (AB1234).
By consensus, the City Council directed Staff to return with an agenda item to
prioritize the City’s plan for the United Against Hate Campaign in November and
take a further look into additional signage for the Apex Community entrance
points.
Mayor Hernandez called for a moment of silence for Greg Clark, a Tri-Valley
resident and volunteer that passed away on July 7, 2021.

Mayor Hernandez adjourned the meeting in memory of Greg Clark at 10:30 p.m.
