Diversion numbers are calculated by comparing 1990 waste generation numbers, adjusted annually according to population, sales tax and employment growth and actual disposal numbers. Studies have shown that the 1990 base year studies contain many reporting 'errors that are not easily identified or corrected and that even when the 1990 numbers are correct, the adjustment methodology' does not accurately reflect the true diversion efforts occurring today. With the AB939 Year 2000 deadline approaChing, a diversion study will accUrately measure. the City's diversion effbrts and establish a new base year for the City, which can be used for futUre diversion calculations. In response to the City's desire to conduct a diversion study, the City recently received a proposal from Waste Management, offering to pay for the cost of the study. The proposal (Attachment 1) outlines 939 Plus, a Waste Management Diversion program which has been developed by Dr. Eugene Tseng, Project Director for UCLA's Recycling and Waste Management Program in cooperation with Waste Management. The program has been used in several Southern California municipalities and Dublin has been selected as one of the first to participate in Northern California. Dr. Tseng is a leading expert in the field and has been consulted extensively by the Integrated Waste Management Board (CIWMB) for developing diversion study standards. As outlined in the prgposal, the purpose, of the program is to help the City meet, maintain and exceed the AB939 50% diversion goal and begin the process of reaching the 75% by 2010; Alameda County's diversion goal. The program in¢l, udes a new generation study, waste audits of Dublin'businesses, education and outreach, technical assistance, and financial incentives. In addition, the program will identify and/or nominate businesses with. exemplary waste reduction and. recycli_ng p_ra~tices for the CIWMB Waste Reduction Awards.Pr'~)'gr..am, wh!ch offers public recognition for California businesses that reduce, reuse; and recycle their nonhazardous waste. Dr.T~eng will manage the program and will work with City Staff to create a new diversion study and a new base year for year 2000 AB939 reporting requirements. While a primary goal of the program is to develop a new base year, the program is a long-term process of educating businesses and improving the City's waste diversion programs. Trained specialists will visit Dublin businesses to measure their current soUrce reduction and recycling programs. Following each waste audit, the specialists will follow up with specific recommendations for improving their current waste reduction and recycling program. Waste Management will change out old garbage bins for new recycling bins at businesses targeted for increased diversion. The City will not need to enter into an agreement with Waste Management because they are offering to implement the program for the City as part of its commitment to assist the City in achieving AB939 diversion goals as outlined in the City's Solid Waste Franchise Agreement. Waste Management will contract independently with Dr. Tseng to administer and manage the program. In order to demonstrate the City's dedication to the program, Dr. Tseng has requested that the City write a letter (Attachment 2) to Dublin business Owners that can be presented at the time of the waste audit indicating the City's interest in the program and encouraging participation. Dr. Tseng has also requested that the City authorize use of its logo to be included jointly with Waste Management's logo on 939 Plus businesses cards. RECOMMENDATION Staff recommends that the Council receive the presentation from Dr. Tseng, approve the 939 Plus Waste Management Program, authorize use of the City's logo on a joint business card with Waste Management and approve the letter to Dublin businesses encouraging participation in the program. This is an integrated and systematic Waste Management program that results in increased source reduction and diver§ion and assist the City in tracking and meeting its...recycling goals. Waste Management has successfully parmered with municipalities throughout Southern California and is excited about the opportunity to develop this program in Northern California. Dublin is one of the first communities we have approached to discuss the benefits of this program. Attached is a summary of the ten tasks necessary to develop and maintain the 939 Plus process. Our program is not just a one time evaluation and effort. It is Waste Management's intent to develop an ongoing, integrated process and infrastructure that will be maintained through the years to track and enhance waste reduction and recycling goals. Please review the attached summary of the program. Waste Management's Integrated Waste Reduction And Recycling Program Program. Overview The purpose of this program is to help the City meet, maintain and exceed the AB939 waste diversion goal. The program consists of an integrated programmatic approach of targeted research, program implementation, standardized reporting and infrastructure building for 'sUstainable waste reduction and recycling programs. The program includes a new generation study, waste audits, enhanced education and outreach, focused technical assistance, financial incentives and the development of new programs to recognize exemplary diversion efforts by the City's business sector. The program will be implemented at the local level with support and direction fi:om Area and Region/Division management. 'Task 1' Develop a Business Sampling Plan Develop a sampling plan that is consistent with the CIWMB Uniform Waste Characterization Method's 80/20 sampling protocol (statistically representative sample). Task 2: Develop a Technical Assistance/Audit Approach Waste Reduction and Recycling audit methodology and protocols are consistent with the format required by the CIWMB "Diversion Measurement Guide." This audit protocol has been successfully utilized in the City of Ventura Waste Characterization and Waste Reduction and Recycling Audit Program and the Los Angeles County Department of Public Works' Business Recycling Technical Assistance Program. Task 3: Conduct Waste Reduction and Recycling Technical Assistance Audits Waste Management will conduct audits of large waste generating businesses idemified in the Sampling Plan. Audits will be completed according to the format required by the CIWMB Diversion Measurement Guide. Following each audit, the project team will follow up with specific recommendations and technical assistance for those businesses that could be making a contribution to the City's recycling and waste reduction goals. Waste Management will immediately begin swapping out refuse bins for recycling bins _at businesses targeted for increased diversion. Task 4: Develop a New Waste Generation-Based Study The data obtained from the audits and other sources will be used to create a new generation study and a new "base year." Dr. Tseng will assist the City in petitioning the CIWMB for a new base year. Task 5- Document Exemplary Programs and Nominate for CIWMB Waste Reduction Awards Program (WRAP Awards) As part of the on-site waste reduction and recycling technical assistance audit program, the auditors will identify and/or nominate businesses with exemplary waste reduction and recycling'practices for either the CIWMB WRAP Award or a City-sponsored waste reduction award progr ~am. Waste Management and Dr. Tseng will work cooperatively with the City to develop the evaluation criteria for any City-sponsored waste reduction and recycling awards. Task 6: Conduct Waste Reduction and Recycling Workshops for Businesses and/or Business Associations Waste management will sponsor and hold waste reduction and recycling workshops. Workshops can be conducted for local service organizations (e.g., Chamber of Commerce, Rotary, etc.). Waste Management will work with the City to select the best forums for the workshops. Task 7: Develop and Maintain a "Waste Reduction and Recycling Guide" As part of the audit program, recyclable materials, which are identified but are not listed in any resource guides, will be provided to the City for determination of inclusion with City or County guides. Task 8' Enhance Construct/on and Demolition Waste Pro,am Waste Management will continue to provide a differential charge incentive system to encourage construction and demolition contractors for source separate materials and commingle materials that are recyclable. Waste Management will work cooperatively with the City to design brochures and pamphlets for distribution to contractors/architects applying for a construction and/or demolition permit. Task 9: Complete Annual Reports Waste Management and Dr. Tseng will assist the City in completing its AB939 Annual Report and the CIWMB New Base Year Petition and Certification form. Task 10: Conduct Source Reduction and'Recycling Implementation Revie~v Dr. Tseng will conduct a complete review of the existing SRRE to determine the overall status of Council-adopted programs in the Integration Section of the SRRE. With the support of the CIWMB Office of Local Assistance and the City, an integrated programmatic plan will be developed that combines the new diversion efforts with the existing diversion programs in the City. If required, Dr. Tseng will assist in revising the existing SRRE to insure that all selected programs in the SRRE are appropriate for the City and that all new programs are included in the document. In addition, the program will help the City of Dublin comply with a state mandate which~ requires local jurisdictions to reduce the amount o£trash sent to the landfill 50% by the end of the year 2000. In order to accomplish this goal, trained specialists have been hired to provide free, on-site, confidential, waste reduction and recycling technical assistance to interested Dublin businesses. The specialists will review your current solid waste and recycling praCtices and provide recommendations for new waste reduction and recycling programs. The specialists will also assist interested businesses in applying for the State Waste Reduction Awards Program, which offers public recognition for California businesses that reduce, reuse, and recycle their nonhazardous waste. The City would appreciate your participation in this worthwhile community project to help reduce waste and enhance the environment.
